Requests for Admissions can't require the recipient to "explain" anything. By their nature, they can only ask binary (basically yes/no) questions. If a party seeking discovery wants another party to explain something, she's required to use interrogatories and/or depositions. Is Mr. Fleming being ordered to answer some of those as well? (That seems possible—but I can't imagine that Windsor would be permitted to force Mr. Fleming to answer "approximately 1,000" interrogatories, or questions during a deposition.)<br /><br /><i>I heard a great analogy for Flemming: "not a lot of difference between Flemming and Windsor, different tax bracket & generation"</i><br /><br />Come on, now. Mr. Fleming has not, to my knowledge, been declared a vexatious litigant by numerous courts in several states. But the events described in the above report would quite possibly place Windsor at least one significant step closer to the actual "P" word. If he did indeed say things <i>during courtroom testimony under oath</i> that <i>he knew were false</i>, and did so <i>with the intent of gaining an advantage in litigation</i>, that does look a lot like perjury.<br /><br />Now, it still would require law enforcement (presumably the Ellis County district attorney) to decide to <i>prosecute</i> Windsor in order for that arguable perjury to actually stick as perjury, but if the transcript of the hearing looks the way Anon 12:52's report suggests it looks, that's not unthinkable.<br /><br />I'd say perjury charges are still unlikely, but who knows? Once again, it's really up to the prosecutor.<br /><br /><i>Huge thank you to Barbara H the attorney for her hard work for everyone!</i><br /><br />In case my bias isn't obvious, I should probably cop to the fact that Barbara H., as well as Ms. Overstreet's counsel and any other member of my profession who does the important work of taking on vexatious abusers of court process, are the characters in this whole saga whom I'm rooting for the most. Attorneys, as a profession, take an enormous amount of garbage from a whole lot of people, and not all of the criticism is unjustified—but we also do a lot that we have every reason to be proud of. Good on Barbara (et al.) indeed.
