Comment Overflow

Bill is now saying Boushie's name online...still no one cares.  He's facing the rest of his life in prison and he knows his days as a fugitive are nearing an end.  His incoherent ramblings and feckless threats continue to be more off the wall and wacky.

  4. I haven’t wanted to telegraph my visit to the Shawnee County Courthouse in Topeka Kansas today. Today was the trial of Claudine Dombrowski on stalking charges. Case 13D-1747.

    Claudine Dombrowski has been ordered to post nothing about me and remove all postings in regard to me. I doubt that Claudine Dombrowski can comply with the order, so I believe she is destined for criminal charges and contempt charges.

    If she has a weapon, I believe she is restricted and may lose it. She could also be prosecuted for interstate travel to commit stalking or violence and interstate stalking.

    There was another Claudine Dombrowski victim at the trial, and she is even happier than I am. Others will likely be following with actions similar to mine. Since Claudine Dombrowski IS the American Mothers Political Party, it seems to me that their Facebook pages and web pages will have to disappear. I hereby advise them to make copies of everything they remove as these are subject to subpoena in both civil and criminal matters that are pending. All the Muthas must heed this requirement, or they could be found guilty of the crime of destroying evidence.

    I think I’m going to find a piece of pie.

Very true, and, Mr. Windsor didn't serve Claudine, he pulled the serve the state, and there is no proof they even forwarded it to her, let alone was proper to serve the secretary of state--so she didn't have a chance to defend herself. Mr. Windsor on the other hand, was served and filmed it himself. He's not only a hypocrite, he is a shady monkey fucker to boot.

  10. Attorney: How can he just continue to drive around and not be prosecuted? Is there really still a warrant out of him in Texas and Montana. Can't Montana do anything? This just seems too ridiculous to continue. How and why did he get out of jail the first time????

    1. I'm afraid you're asking the wrong lawyer, Anon 3:49. I wasn't at the hearing at which Windsor was released, and in fact I have spare little experience in criminal law overall. There are other practitioners who occasionally post here who have an advantage over me on one or both of those scores.

      I believe that, yes, there are warrants for Windsor's arrest in both Montana and Texas. The reason he "can he just continue to drive around and not be prosecuted" is that, to date, he has succeeded in evading law enforcement.

      As I've said on previous threads, I'm relatively pessimistic about the prospects for Windsor being apprehended any time soon: he doesn't appear to be the kind of fugitive that many government entities are interested in spending significant resources on capturing. As a result, he may be able to stay "on the lam" for quite a while yet.

      On the bright side, Windsor's fugitive status is now placing serious limitations on his efforts as a civil litigator (a sector I know far more about). It is very difficult to maintain lawsuits, or have any success in prosecuting them, when one can't show one's face in court for fear of being arrested.

    2. fugitives can go on like this for years. They might get him today, they might not get him for years...thats just how it goes.

      As to why is he out now....he benefited from perfect timing. The governors warrant ended up coming in one week after his hearing with Judge Cindy. Had it been in for that hearing he would still be sitting in jail in MT. But as it is, Judge Cindy didn't have it, she felt she could no longer keep him there in TX without a bond so she gave him one. Obviously in hindsight, that proved to be a foolish ruling, but we don't get to operate with the benefit of hindsight

    3. In foresight, its garnered Billy about 2000 more charges per violation of the order, and made the charges crystal clear as to his wackadoodle mental status. When they do catch him, he has somewhere between .0000000& and .01% chance of getting a bond to get out of his new pretty jumpsuit.

  12. I was there, Anon 3:49. Patrick Wilson did a workmanlike job, but failed to convince Judge Ermatinger (who is exceptionally inexperienced as a judge) that Bill was a flight risk. Personally, I think the moment Bill stated his Texas residence was a motel, she should've held him over for at least two weeks and told Patrick to hustle on the governor's warrant.

    In any event, the Texas experience has cost Bill dearly. He's down, what? $430K between his civil case and forfeiting his PR bond (which means the immediate loss of $100K!).

    I also think Bill is probably not nearly as important to the authorities in Mintana and Texas as he believes, and that they probably won't go to extraordinary lengths to catch him. However, I can think of a Houston lawyer who has about $330K reasons to hire private investigators or bounty hunters to track him down ...

    But something happened today that scared the bejeezus out of Bill Windsor. He doesn't want to share the details as he doesn't want to give ideas to the bad guys, but he reports he was terrorized for about an hour. So, a quick change of plans and a new state. Good thing there are 50 of them.

    Bill Windsor is taking a stand about Freedom of Speech, but will many people ever know about it or care?


    So, what he is saying is, he's taking a stand so long as he cannot be held accountable for his "stand", and, putting his personal interests far above any principle he may be pretending to serve, has decided to run and hide rather than "take a stand".

    Unsurprising.

    As an attorney, my experience is that the biggest pains in the butt are pro se litigants -- even ones who aren't as ignorant of law and procedure as Bill. They typically misunderstand the interaction of the law, they have little idea how a case developes, and they typically do stupid or pedantic stuff that does not advance their interests, but simply makes the entire process drag out longer and become much more expensive for everyone.

    Then there are people like Bill who are pedantic (elevating form over substance), ignorant of the law, and generally nowhere near as smart nor as capable as they think they are.

      Translation: Nothing happened, but pretend it did, because Bill said it did. Bill has no proof or evidence to back up this statement, but it doesn't matter. Bill will just state as fact, therefore, it is Bill's evidence.

      Or, he got into a fight with a Pizza guy, who wasn't there within 30 minutes, so Bill refused to pay--then threatened to sue, they tussled with the pizza box, and it landed on the floor, leaving Bill with an upside down pie, and he had to scrape the box for the toppings. So tragic! Surely, this will be part of the "Saga of the Pie Man Fugitive." His constitutional rights to a pizza delivery on time were denied and violated by a corrupt pizza place, who is most likely conspiring with the Government paid "Joeys."

    Bill you will likely be getting major media attention soon. Remember King Solomon's most important advice in proverbs; A wise man can accept criticism and thank the man who gave him the advice. But we can see a fool because a fool gets angry if anyone criticizes him or gives him advice.

    Okay Bill, here is my advice on your recent post. I say this only because you are probably going to get national media attention soon, and some reporters will be poring over every sentence you write, to look for anything they can twist around back at you.

    * Don't need to mention ebola. Just talk about your case. Be somber and clear.

    * Don't use the word "evil". This can make some reporters immediately think you are some nutty born again Christian who will be citing Biblical phrases about the end of the world.

    * when you wrote "A UNIVERSITY OF MONTANA EMPLOYEE attempted to murder him." this can sound like a rash statement that many people might use on youtube. Reporters are either going to want to see the evidence now, or they will drop your story and think you embellish things way too much. If the guy shot at you, say son. just say what happened.

    * I wouldn't say anything like "he is hiding out in exotic places like Tahiti and Bora Bora. All of that was true except the last four words.". That is just going to allow reporters to figure you are making things up already, so what else are they going to read from you, where you later say "Oh well that part was false when I wrote that". I would remove that immediately and just state the facts. Not what someone "was going to do to you" or "tried to do to you". Just list what factually happened and show the evidence. your case is powerful enough on its own merits. The key now is to get national reporters to pick your story up. Many of them won't if the immediately see the word 'evil" and that someone was going to kill you, but they didn't, and talk of ebola, and then an untrue statement you retract as a joke. Detractors will quickly jump on that and say Bill makes lies and then retracts them. whew, I would amend that soon, then delete my comment here so your opponents don't read it. What I am saying here is what a legal secretary will say to his client privately, not publicly. In fact, i will delete this and PM it to you instead Bill

      Poor Tim, he just doesn't get it. He seems semi bright, yet, won't read or research anything Windsor related--as far as court documents, and things not written by Bitler.

      If the "media" were to get involved, they will dig. They will research, they won't take Windsor's word. If they are true "Media" not like Windsor, they wouldn't stake their reputations on one sided slants, without actually reading court documents to verify facts. SMDH That is why the "Media" will steer clear of Windsor, unless of course, they decided to cover a story of a maniacal Anti Government Sov Cit type fellow, who is currently a fugitive on the run, taunting everyone including Judges, DA's, LE, and Court staff by writing absolutely false and defamatory articles.

  22. This morning, for fun, I looked over the Appellate Brief Bill filed on January 26. He claims 19 issues for the Court of Appeals in Waco to decide. Given that he already has three other appeals before the Waco court, I suspect he has already worn out his welcome with them.

    I wondered about the reason for his filing the latest appeal, then realized it has to be about both recovering the $100K bond forfeiture money and taking another shot at trying to avoid extradition to Montana without being a fugitive from justice.

    The brief itself is, as one would expect, amateurish; still, it gives an interesting look into the mindset of a vexatious sovereign citizen litigant.

    I strongly suspect the Waco Court of Appeals will pour Bill out because he’s asking for habeas relief, yet is no longer incarcerated. "In any habeous corpus proceeding, if the petitioner is released during the pendency of the appeal, the appellate proceeding is terminated." Ex Parte Erwin, 7 Tex.Ct.App. 288 (Tex.Ct.Crim.App. 1879).

    A few of the issues Bill raised are worth commenting upon, though.

    Issue #2 ("Were [Bill's] rights violated when he was not read his rights?") reflects a common misconception. Bill, like many SovCit vexi litigants, tends to want to elevate form over substance and has the mistaken belief that failing to read a Miranda warning violates someone’s rights. It doesn’t unless the officer questions the suspect without reading the warning, in which case a prosecutor cannot use the results of that interrogation against the accused in court.

    Issue #9 (“Is the lack of access to a law library in the Ellis County [jail] a violation of [C]onstitutional rights?”) No, for two reasons. First, Bill did get access to the county law library, albeit limited access. Second, as the case Bill cites in support of his Issue #8 states, “[p]risoners must have reasonable access to a law library or to persons trained in the law.” Bill had a Cedar Hill lawyer present for at least two hearings.

    Issue #10 (“Was the bond of $100,000 that was allegedly set excessive?”) – the answer is no, for the simple reasons that Bill both was able to pay the bond and failed to appear either in Texas or Montana, which was a condition of the PR bond. Generally, a bond amount is not too high under those circumstances.

    Issue #14 (“Was the ... [b]ond . . . invalid as it was not fully executed?”). This is another instance of Bill placing form over substance. I'm not sure there is any evidence the bond application was incomplete. Even if he had an argument that the Bond was invalid, he ratified the bond by presenting the collateral of $100K and therefore waived any objection.

    I could go on and on; I’m really trying to avoid finishing up a status report to an insurance adjuster. In any event, I suspect all of this is moot because the Court of Appeals will deny the habeas petition as moot since Bill is no longer incarcerated.

    2. My understanding was that Bill used a bond agent. If so, that agent almost certainly would have insisted on collateral, particularly given that, as is my understanding, area bonding agents knew that Bill was considered a high flight risk.
