The case of Windsor vs. Overstreet and a civilized society gets its first big hearing today. Allie has a motion to dismiss while Bill got vexi with it yesterday by throwing up 15, yes count them, 15 motions or notices. Bill is trying his best to give the Judge no other option but to hold him in contempt of court.....let's review what factors can lead to such action:
A finding of contempt of court may result from a failure to obey a lawful order of a court check, showing disrespect for the judge double check, disruption of the proceedings through poor behaviour you can count on this, or publication of material deemed likely to jeopardize a fair trial ummm like allieoverstreet.com?.
But before Bill heads to court for a very possible contempt detaining, along with watching Allie be dismissed from the case, he left everyone with a funny story that did or did not happen to him the other day:

I was driving over to the courthouse in Lexington Missouri this morning about 70 miles per hour on the Interstate crazy old me who shake and can't hear shouldn't drive that fast. Up on my right came a man in a pickup truck honking and waving and motioning for me to roll down my window he wanted to point out that you were in the median. I did. He was VERY excited to tell me: "MY cousin is in that movie!" I'm sure he meant the real movie with Tom Hardy and Shia Labouf His cousin was filmed in Minnesota if it was with you he means youtubed. I love it when things like this happen out of nowhere. It helps remind me how important the movie is to people did you bother to mention to him that you have given up the movie idea and moved on to stalking people 24/7.
I worked until 4:30 you mean vexaited, dont call that work am preparing my filings, and then I was up at 7:30, off to the UPS Store for notary service and copying, then over to Lexington its not easy being vexatious is it?.
We have hearings in Lexington Missouri tomorrow in the case of Windsor v. Overstreet and the world. According to my reading of the laws and case law involved, I should prevail on everything to bad you have no training or understanding of the law whatsoever. Fat chance in your case that's always true, though. But I'm told the judge is excellent, so we shall see that means you have zero chance of prevailing, zero.

DeleteI don't have any inside information (and I'm missing most of the content of the motions, etc., at issue today), but my bet/guess is that today's hearing isn't going to be determinative. That is, I think there will still be a live lawsuit after the hearing.
ReplyDeleteMy prediction is that the court will (1) throw out most or all of Windsor's motions and whining and whatnot, (2) take a small number of Windsor's requests under advisement for a future written decision, and (3) take most or all of Ms. Overstreet's motions under advisement in the same manner.
I see (and am glad) that the court dismissed Mr. Supanich from the case, but the legal issues involved in the Windsor-Overstreet suit are a little more complicated, so I'd be surprised (though not shocked to the core) if the court threw out the entire lawsuit in the courtroom today.
I'm also guessing that Windsor will not be found in contempt today... but I'll have to admit, the man is talented in that respect. He could surprise.

My prediction is still that no one (except, I guess, Mr. Supanich) is going to "win" today—but any decision on a motion to dismiss would be significant news.

The main question at this point is what the status of Ms. Overstreet's motion to dismiss is. Windsor claims the judge denied it; it's also possible the judge took it under advisement and will issue a decision in the next handful of weeks or months.
DeleteIf Windsor's claim is true, this really wasn't a bad day for his case. If the motion to dismiss has been denied, then it's full speed ahead with discovery. I do expect Ms. Overstreet's attorney to clean Windsor's clock in a deposition and/or discovery requests and responses, but today's events, if I'm understanding them correctly, make clear that Ms. Overstreet will be subjected to Windsor's questions. (I certainly hope her attorney returns the favor at Windsor.)
The less-technical account that Ms. Trooth has provided here makes it clear that Windsor irritated Judge Rolf just as much as we might have guessed he would. And that's certainly not good news for his case; it's hard to imagine that the judge will give the benefit of the doubt on any close point to someone who is (as usual) so clearly abusing court proceedings. Antagonizing a trial-court judge is always a horrific mistake, and it would appear that Windsor is already doing that in a major way.
Still, from Windsor's perspective his main goal today was (1) not to lose the case entirely and (2) not to be held in contempt. Sounds to me as if, by that standard, he did okay.
I still expect Ms. Overstreet's counsel to beat Windsor pretty badly in the end—but unless our witnesses missed something very important, that beating didn't happen today.
yeah I think given then possibilities as you said, Bill considers this day a win. But if discovery goes forward, it goes both ways. Bill says that Allie cost him his marriage, maybe its time to depose Barbara?

This case is a long way from going to trial, and Ms. Overstreet's best bet at this point is still disposing of the case via motion practice—a motion for judgment on the pleadings, possibly, or more likely a summary judgment motion. Either one would eliminate the need for a trial.

DeleteActually it's as simple as obtaining a subpoena from the deponent's jurisdiction (assuming the defendant's have sufficient cause to compel) and setting up a phone deposition. It's not slow or complex and should be done during the discovery phase, which is now.

So one article I read talks about what is or is not bashing. Someone puts themselves in the public eye, like bill or Janus. Someone sees this and gets on the bad side of these people. Bill and/or Janus post articles saying this person is a liar relying on each other and personal opinion comments posted across the internet.
A blogger writes several articles about the truth of claims made by Janus or bill (much like gs and several others have done). They present their opinions, they create a parody regarding statements made by bill or Janus, or they even refute statements made by bill or Janus by posting screenshots and links to court documents, dockets, etc and prove that these statements are false. Sometime the internet is a good thing. Sometimes not so much.

DeleteOk, before dickhead can make it sound like he "won" anything, here's what happened. The judge dismissed the case against Mark based on jurisdiction. He continued the case against Allie and I and denied the request to have me served by email or any other way than serving me personally. I have no doubt it will be thrown out. I am going back to California to stay with my brother until the end of August so good luck having me served asshole. The judge strongly suggested he get an attorney and told him those were the most poorly written motions he's ever seen. Bill was a pasty, shaky mess. Dropped his mountain of worthless papers all over the floor. RAN to get his camera immediately after and videotaped Mark and Allie walking out and Allie flipped him off. Lmao. The judge told him he has to serve me before he is granted any other subpoenas or drop me. Bill claimed to have a private detective looking for me and has my address in Kansas City. Lolol. Apparently I live in a huge ass 5 bdrm 4 bath house. I wonder what I do with all that space. So....no. the case wasn't dropped today. But it will be because he has NOTHING! Everything he has tried to say Allie has done to slander him is a lie. I'm still not sure WHAT hes suing ME for. I have my own company and can work from anywhere. So I can leave anytime I want to. Bill looked like he was on the verge of a stroke so we may not even have to go to court again.

DeleteIf I drive to Kansas City and run somebody over on the street, I can't run back to my home state and say "Gee, sorry, person I ran over, I don't live in Missouri, so you can't sue me there." The fact that I traveled to Missouri and committed a tort there would be a sufficient contact with the state to give Missouri's courts personal jurisdiction over me.
I gather the court's ruling today was that Mr. Supanich didn't have any contact with Missouri that had anything to do with the acts Windsor was accusing him of. Therefore, Mr. Supanich doesn't have sufficient contacts with Missouri for that state's courts to be able to exercise personal jurisdiction over him in this case.
That argument wouldn't work for anyone (such as Ms. Overstreet) who lives in Missouri. It probably wouldn't work for anyone, from any state, who posts allegedly defamatory things about Windsor while he or she is visiting Missouri. But it appears that it works for Mr. Supanich. Which isn't terribly surprising, given the facts of this case.
So if they posted allegedly defamatory things but were never in Missouri, does that rule them out? I think it was also that he really had absolutely nothing to accuse mark of except that he said he was part of the "death notice conspiracy" and that he was dating Allie ( which we all know was really the ONLY reason Bill hated him). I'm %100 certain mine would be dismissed too because, well, there's nothing. The only thing he's accusing me of is being part of the "death notice conspiracy" which is beyond ridiculous!

I have a different perspective--as one who WAS married to a mentally insane individual. Like it or not, insane people have rights. Probably more than the rest of us. As his ex, there is nothing Barbara can do any more. She can't commit him, nor can his children. As far as the truth of why they are estranged from Bill? I couldn't care less. Nor will "the truth" help any of these other people. As I have found, dealing with mentally ill people, stating the truth doesn't set you free, instead, it makes you a walking target. Sadly, the only one who can stop this now is Windsor. And well.....we all know how that will end. The rest of us? Hunker down and hang on until the runaway train crashes or gets derailed.
Delete@Anon, you are missing the point. Windsor is blaming the "haters" on the demise of his marriage and family. The Ex Mrs. knows the truth. She was out of the picture a long time before he turned into a stalking, harassing, vindictive monster. It is her testimony that will prove he is not entitled to a fricken dime, if the case even gets that far.

Personally, I don't really care either. And I don't expect Barbara or Ryan.to have Bill commited. His only hope to win his lawsuit is that the judge believes he lost his family because of the stress and threats to his family from the "haters". All his other claims can easily be disproved. And I do believe it is her moral obligation to stop this of it is in her power to do so. And it is.

DeleteTrue Tiny. Usually the pictures are of his car in an empty parking lot (or close to empty), like in the Curtis one. Looked like they were closed. Funny thing in that photo, he couldn't even manage to park straight. He's one of "those" drivers.
DeleteIt's comical to see the former believers act like they knew all along he was a few full ingredients short of a full pie recipe. All of them were completely on board with Windsor, no questions asked. No questions by them if he was legit or a nutter just as long as long as they could get into a YouTube video(SMH) and cry corruption or by him if their story was supported by facts or a mirage of bullshit as long as he could get people to pat him on the back and give donations. They all would thank him for all he did which was mainly bash someone for them using a high quality camera. Over the top supporters turn into over the top bashers in the blink of a "peye". Maybe if the initial "Billy, he is our man, if he can't do it, nobody can" supporters thought about it, they wouldn't have put themselves in the situation in the first place. But then again, Claudine wouldn't be here and then it would be one less place where Claudine could talk about pricks and balls.

The 9:19 - 9:36 comments are sad. Seems to be more of the "more hat than cattle" but with a darker twist. The boyz in blue probably have better things to do than look out for a fat white haired old man in the middle of July.
