The Vexatious Litigant Rides Again


Apparently, District Judge Fernado Gaitan doesn't mind turning his court room into an all out circus freak show.  If Bozo the Clown isn't booked yet, he could call the court in to session, and I hear they are trying to get the Blue Man Group to perform the opening act.  Yes, that's right, a judge whom Bill would like to see executed (along with his peers) for treason, is willing to hear just how vexations Bill Windsor really is.  Bill filed a lawsuit, after being given permission, against Allie, Mark, and John Does 1-1000.

Bill rattles off 220 statements of facts...of course none of which can be independently verified.  Its mostly a redo of the counter claim he tried last month against Allie when she filed for a protective order.  Around 92% of it has nothing to do with Allie or Mark, but I guess that's why he adds John Does 1-???.  Think of this lawsuit as Bill Windsor vs. A Civil Society, because that's really what we are dealing with here.

Among the mis-statements of fact, we have a cameo of Judge Snooty as Bill offers her up as an "expert witness", I can only assume she got that title by wearing her glasses down to the tip of her nose.  Bill says he has never operated a scam, swindled anyone, tricked or cheated anyone out of their possessions, never had a parking ticket (wth?), is not sexually attacked to children, isn't a bigot, paid his taxes, is a grandpa, only been to jail as a visitor, didn't have women sitting on his lap, doesn't get nude with woman especially in a hot tub, didn't have sex with animals, did not solicit or accept any investments to Lawless America, doesn't drink alcohol, only cusses on Wednesdays (I just made that up, but it seems to fit), and is stalked and harassed to no end by these "stalkers".....who also (gulp) put out his personal information such as his home address and date of birth (you know stuff he posts himself).   And much much much.....more.

So you can continue to keep quiet and sit in the corner and work on your karate chopping Schied, Bill has better things to do than play with your imaginary friends all day long....no no, forget all that stuff, he is getting back to his bread and butter of being a vexatious litigant, its better than a sugar rush from too much pie.

  2. Thats some funny right there!! As of this morning, all I can see is teh procedural ok for Bitler to file. Its not a real suit as of yet. Allie said she was served, but Im not sure by who as of yet. My bet it was just some moran Bitler hired to give her some papers, aka harassment and paper terrorisim. Bitler most likely thinks this is all needs to do. Most likely hes wrong, a good general assumption.

    3. Thanks to a tip from Ms. Overstreet below, I've found the case on the Missouri court online filing database.

      It's case number 13LF-CV00461. (13 must be short for 2013; LF is very likely Lafayette County; CV is civil; and 00461 means this is probably the 461st case, or perhaps the 461st civil case, filed in Lafayette County in 2013.)

      You can see the database entries for the case by surfing over to https://www.courts.mo.gov/casenet/cases/searchCases.do and entering the case number above.

      The Missouri database does not appear currently to carry any of the documents that Windsor has filed in the case. I see, however, that "Bill Windsor Files" has posted links below to scanned PDFs of case documents posted on Google Docs.

      Nonetheless, I presume that the Missouri court website will be a useful place at which to get case updates later in the litigation.

  3. I wonder 1) exactly WHO gave Billy permission to file this suit, if it exits, and 2) does this permission satisfy Thrash's order to have any potential suit vetted by a FEDERAL JUDGE before filing? IMHO, getting a district court judge's permission doesn't qualify.

What I also find interesting is that the woman involved in the rumour still has her videos posted on LA despite telling me some less than flattering things about Bill.

    I would say, unless you are contacted about dates, or another case number it is only an administrative matter at this point.
    Im not sure of the process or if there is one to notify Thrash. Id hope that Sluggo is right adn the State judge does not have full knowledge or authority to even issue the order giving him permission.
    Personaly, I refuse to even acknowledge any loony lawsuits. Bitler included.

    If the lawsuit or administrative proceeding names federal judges or court employees, the Plaintiff must also tender a $50,000.00 cash bond or a $50,000.00 corporate surety bond sufficient to satisfy an award of Rule 11 sanctions since such actions are presumably frivolous. Failure to obey this Order, including by attempting to avoid or circumvent the intent of this Order, will be grounds for sanctions including contempt.

  14. @ Sluggo, one of the 1000's could be the Judge from the PO case. He was mad because he dismissed Bill's B.S. I am sure he will name a Judge or two in this suit. Perhaps he will drag the Maid Judges into it for libeling him or slandering him as a vexatious litigant. Since he has no names for the Doe's, he could really put whoever the hell he wants in there if he wins. Now how's that for Justice.

  18. Isn't 60 pages pretty long for the initial filing? It seems like included large blocks of text in the filing rather than including them as supporting documents in the entirety.

    Per that text he just wants to sue Allie and her bf. Wouldn't the judge need to know it's also John Does 1-1000. I mean, that's a little ridiculous and speaks to him being very frivolous. I mean how exactly are they going to be able to separate out what a bunch of individuals are accountable for? I'm not an attorney, but it doesn't seem like it can legitimately be lumped together like that??

    1. Thrash needs to chit chat with Gaitan. Just like Thrash was sued, this Judge will be too. No one is immune from Windsour, and the courts aid the sickness of frivolous people with a vendetta. Had this Judge known the history behind the man, he probably would never have agreed to let him file.

      Right there, he calls Thrash corrupt. Hellooooo, heads up, he just insulted the integrity of another fellow Judge.

Allie, this is my opinion and only that, I in no way am an attorney nor am I even trying to give you advice in general, but the way I see it is that this filing is so ridiculous that you should be able to get it dropped on your own. For the very same reasons you couldn't get a PO against Bill, now the shoe is on the other foot and he is the one now that has to justify his request, and about 90% of the stuff you simply have to respond with "that has nothing to do with me".

    But, and I think he may have opened himself up here, if you wanted to go after damages in a counter-suit, I think you would need representation to pull that off. Thats my two cents.

    15. I've been a juror on three cases, two civil and one criminal (felony) and was the foreperson on one of the civil and the criminal case (verdicts on all cases). IMHO, this case won't get to a jury, but if it did, Windsor would have his ASSHAT handed to him.

  26. Yep, and all you wanted was for Windsour to leave you alone, stop harassing you, remove all his posts about you etc. and the Judge only focused on the Gun. Not bright. There are numerous was someone can stalk someone else, and Windsour just proved it by filing this. And driving by snapping photos of your house, driving by again several days later, etc. Something tells me, the Judge will regret not taking this more seriously. Based on the vexatious title, it should have been a BIG indicator of his harassing personality.

    Who knows the names of the pedophile cases he is defending?

    Who has the information on the convicted pedo, Woodruff fellow, who was working with LA?

    Every single number on that complaint can be disputed and proven a lie. There are 1000 people listed as does, so, lets pull together and get all this proof for this case.

    Interesting. He refused to produce documents to Maid relating to LA claiming he had no ownership in LA. Now, it is "his company."
    This lawsuit should provide ample opportunity for full discovery on LA, all of his e-mails, Facebook entries, etc.

    You need an attorney. Your attorney should send him a notice immediately to preserve all of his records, computer files, etc for purposes of the litigation. Thereafter, along with your answer, send extensive discovery, including a request for access to his computers for forensic examination, request for all of his web pages, Facebook pages and passwords. Could be interesting.

    2. Tortious interference claims are rich. Opens the door for all kinds of inquiries as to the specific business of LA. What current or prospective business or contract was interfered with? For example, Windsor claimed he turned down a deal from a Hollywood agent for the LA movie, if I recall correctly. Given the tortious interference claim it is perfectly relevant to ask about that deal. Who was it with? What were the terms? Why did you turn it down? Who else did you have meetings with.

      His website and Facebook pages will be a goldmine for specific questions like these. Good luck

      I am in total agreement with your statements & advice to @AllieGate.

      & @AllieGate~ Windsor, (in my opinion) has just opened himself up for intense scrutiny in EVERY aspect. This is a great opportunity he's given, not only to you, but many future victims of his.
      You have some very staunch supporters, much more than you may realize or that you are 'seeing'.
      As stated several times recently, the readership here on Ginger's blog has continually grown. Those that read are a vastly larger group than just those that post comments. We know several LE agencies have been reading regularly for months. We also know that at least some judges have also been reading & following his online activities that have been mentioned & linked. Now, with Windsor's filing against you most recently, he's leading even more scrutiny to his "activities".
      The Anon above used GOLDMINE in their comment, where we had been referring to his ish as "nuggets" as we have detailed his absurdity satirically. Windsor's own words & actions could be used against him now, to STOP him, and at his very own "invitation".

    8. Anonymous @1:37 has very good points about roasting Windsor in discovery. An aggressive legal team could make Windsor very sorry that he filed this lawsuit.

      However, that process would require at least a few months of work (Windsor's entire history suggests it could take several years) and cost many thousands of dollars. Unless there are attorneys (such as Maid of the Mist's?) who are willing to do the work pro bono or for drastically reduced fees, going to war in the manner Anon 1:37 suggests would be extraordinarily costly in both money and time.

    9. That's why I asked what kind of lawyer could she look for . . and I briefly mentioned "ambulance chasers" . . and I don't mean that as a derogatory term towards all attorneys. But, there is a certain type of personal injury lawyer, the kind that heavily advertises, that is actually right person to fight for you. Some cases they just dial in because they are working for a portion of damages won. So, maybe, if they think Bill would owe court fees and damages in the end and Allie was just interested in justice more than money . . . maybe that could be a win-win deal?

      I'm just talking (writing) outta my butt.

      It just seems like Bill does a good job of creating a lot of work for other people just to follow him. He's endlessly writing and accusing. He can't be succinct in the least.(not like me. this is short and sweet and to the point. shut up. I know.)

  34. What kind of lawyer does somebody look for in a situation like this? I mean, I know that there are times that even an "ambulance chaser" type attorney is right bet. However, this seems like a time when you want somebody that is really on the ball and takes personal offense to Windsor's use of the courts. How does Allie even go about finding affordable representation and know what specialties are right?

But, then we know he's accepted donations for this supposed 501c3, but is that really being tracked? It doesn't seem like it. I would the the law would be very specific about accepting donations or gifts or whatever when you tell people that it's tax deductible?

    2. Doc 2, the Complaint, is interesting. It demonstrates for the nth time that, for a non-lawyer, Windsor is a pretty mediocre lawyer. His recitation of facts is chock-full of absurd irrelevancies (WTF is the point of lengthy recaps of online conversations with Ms. Overstreet?). Then, the most important portion of the Complaint, the actual Claims (or "causes of action"), are hollow, conclusory nonsense.

      Most of the time, courts will let pro se parties slide on issues like that—but given Windsor's history (which the court in this case should be well aware of by now), one hopes the Missouri state judge won't cut him any slack.

      There's also a major question regarding personal jurisdiction—that is, whether the Missouri court has the power to adjudicate a case against any defendant other than Ms. Overstreet. Making that argument would require some research regarding Missouri and federal law on internet defamation and other torts Windsor names, though.

      Windsor is the plaintiff in this suit, so he will have to prove all elements of his claims (such as damages) at trial. The standard of proof depends upon Missouri law, which I have no direct experience with—but I'm guessing Windsor would have to prove his claims by the preponderance of the evidence.

      Of course, it's entirely possible this case will never go to trial. A huge proportion of lawsuits settle or are determined on pre-trial motions such as motions to dismiss and motions for summary judgment. (This irritates Windsor to no end; among his absurd legislative proposals are destroying these kinds of dispositive motions entirely. ...Which would cause American court systems to collapse under the resulting case load.)

      does Bill have the burden to show that he didn't do things?

      Probably not. Missouri law could be entirely different from the law I'm familiar with (though I doubt it), but generally the cliché is that "truth is an affirmative defense to a defamation action." In other words, if

      * Windsor accuses Overstreet of publishing a statement that Windsor committed Crime X;

      * Windsor alleges that he didn't commit Crime X; and

      * Overstreet's defense against the defamation (libel or slander) claim is that Windsor did too commit Crime X,

      then under common law Overstreet would have the burden of proving (usually under a preponderance-of-evidence standard) that Windsor did the crime.

      Overstreet and other defendants may well have other, less fact-dependent defenses against Windsor's defamation claims, though.

      That's almost certainly not illegal. (Just massively asshole-ish.) Nor does it really have any effect on whether Ms. Overstreet can counterclaim against him. Ms. Overstreet can counterclaim because he's just filed litigation against her. That's all she needs, presuming she can make out a colorable argument that he's committed a tort such as defamation, fraud, harassment, intentional infliction of emotional distress, or whatever.

      And even if a counter suit was successful and he ignored it, what could a court in Missori do to a guy in Georgia?

      Well, a "counter suit" (this is why the terminology matters) isn't a "suit" at all; it's just one or more additional claims that the defendants in the current lawsuit can file, directed back at the plaintiff (who then gains the added title "counterclaim defendant"), within this very same litigation.

      Conceivably Ms. Overstreet or anyone else could file an entirely separate lawsuit against Windsor back in Georgia, but that would be pretty much pointless for anyone who's already a defendant in Missouri.

      Under other circumstances, Windsor could ignore a lawsuit filed against him in Missouri by arguing that the Missouri courts don't have what's called "personal jurisdiction" over him. Personal jurisdiction is a thorny issue that law students spend weeks or months learning in civil procedure class—but in this case, it's basically moot as to Windsor, because he filed this lawsuit in Missouri. By availing himself of the Missouri courts, he has clearly given up any argument that Missouri courts have no jurisdiction over him.

      So if Ms. Overstreet or other defendants counterclaimed against Windsor in this case, they could (if they win on their counterclaims) get a judgment against Windsor. Then they can take that judgment to Georgia, file it in Georgia courts, and enforce it against him. I can't see those kinds of jurisdictional issues being a problem on the defendants' side in this case.

      On Windsor's side, things are different. I have no idea what connections Mark Supanich has with Missouri, but potentially he has a strong argument that that state's courts have no personal jurisdiction over him. The same probably goes for most if not all of the Does. A lot depends on Missouri's law (and federal law) regarding internet defamation, though. I'm sure that has a major effect on the personal-jurisdiction argument, and I'm not sure what the outcome is.

    9. Brannon's referring to the so-called "public figure defamation" standard established by the U.S. Supreme Court in New York Times v. Sullivan, 376 U.S. 254 (1964). I can't say for certain, but it appears to me that that might indeed present a serious problem for Windsor's defamation claims. It's very difficult for public figures to overcome the "actual malice" requirement created by the NYT case.

      I believe Windsor has asserted that he's not a public figure, but that seems to me highly dubious.

      (NYT could present a problem for one or more of the defendants to the current litigation, as well, if they decide to counterclaim against Windsor for his own defamation of them. Arguably one or more of the defendants are public figures, too.)

    13. @Attorney and Brannon, yes the "public figure" thing can be big, as it was in fellow LA follower and local malcontent John Margetis decided to file on me and Oreader (and threw in google). Google's attorney's established that he was a public figure which means just about anything outside of a direct and specific threat of bodily harm is fair game. And Windsor, who claims to be starting his own political party, is far more public than John was.

    15. I've never edited Wikipedia, but I've read enough testy Talk and History pages to see that the problem isn't just "fixing it" by a temporary edit but making the edit stick. Windsor can simply revert anything an editor changes, unless the Wikipedia higher-ups intervene.

      Which is why the higher-level editors are important. Windsor is abusing Wikipedia, and one hopes the site's leaders (or even volunteer middle managers, of whom I believe there are thousands) would prefer that that not happen.

      While the people he attacks have to take time away from their real jobs, losing their hard earned money to defend themselves against his relentless, frivolous, and malicious attacks.     Rik Little I've met Both parties personally and I believe Allie over Bill anyday (though Bill is really good). I post anti-Feminist posts and I have never made a anti-Woman post. Certain woman and men try and manipulate that FACT and when a woman or man uses feminist tactics, feminist speech patterns, does feminist behavioral modes (especially in the social media) I conclude that that person (male or female) is a Feminist. And FEMINISM is BAD and the GREATEST BULLSHIT I HAVE EVER WITNESSED DEVELOP IN MY ENTIRE LIFE. It is the cause of Americas biggest problems. Bill cyber raped me and was dishonest about a lot of things about me, Allie and himself. I watched him drink a pint of beer in Washington DC a few months ago and he says that he does not drink alcohol. He lies like a Feminist, pathologically.

Again, we only discuss what he says and does. First amendment, and him being a public figure and all, we have the right to our opinions to critique him. He doesn't like what people are calling him out on, or the fact that his lies are being documented. Clue for the very self promoted public figure/producer/wanted-to-be-public official, you can't stop public opinion of your very public life.

    1. My guess is Windsor had other people doing his dirty work to monitor and report back to him. He was probably worried about IP tracking and whatnot. However, my guess is that he's not so worried about it now and regularly checks in. It's just a hunch though. My hunch is that other people from his real, non internet world are here too. And, I don't think any are very happy with him.

  65. No Woodruff is not the state of fl la coordinator. It is Glen Gibelina and he is truly a piece of work. I would have to dig but he files about every other week against his ex wife. She has had one or two (or more cant remember now) ro's against him (they expire she tries to move on he won't allow it so she refiles for ro). Glen Gibelina also runs the act of courage fb page and various sites. It is Glen who posted that horrible stuff about vawa and how women need to shut up blah blah blah whatever it was. WS do you remember what it was?
