After sending out the call for donations, errr I mean, buy these T-shirts that I'm going to forget to mail you, Billy knows he has to skip town. He does need a new group of lemmings, that much is clear, but other than that there really is no other reason to go back on the road other than fleeing the authorities.

In comments yesterday, Sluggo posted a screen shot-- http://tinypic.com/view.php?pic=2u62153&s=6 --of the PACER docket report for the last several filings (docket numbers 356-367, filed between January 24 and March 4 of this year) that have been made in the lawsuit Maid of the Mist filed against Windsor (several years ago!) in Georgia federal court. I thought I'd explain what the filings are for those of you playing along at home.
#356 is Judge Duffey's order from January 24 ordering Windsor to start paying his contempt fines or risk imprisonment. This has been discussed in comments previously.
#357, filed February 7, is Maid's statement of how much they ran up in attorney's fees getting the court to issue #356. Maid says that that cost them just over $13,000.
#358-36, filed February 28, are Certificates of Service in which Maid states that it has served discovery requests on both Bill and Barbara Windsor. The requests themselves haven't been filed (nor do they need to be) with the court, but clearly they involve Maid demanding, with the power of the court behind them, that the Windsors (1) allow Maid to inspect one or more pieces of real estate (presumably the Windsors' property, which could conceivably be attached in order to pay Bill's court debts), (2) provide written answers to written questions called "interrogatories," and (3) turn over specific documents (presumably financial reports).
#363-364 and 366, filed March 1, are Windsor's requests to the court to allow him to file various motions in response to the discovery requests. It's a rare (and, to my mind, humiliating) thing that a party to a court case has to ask the judge permission before even filing motions like these; Windsor is in this position because he has been declared a "vexatious litigant"--a person who files overwhelming numbers of documents in court for illegitimate purposes.
Volume 2:
ReplyDeleteWindsor's requests themselves are not visible to the public (such as you and me) because of the consequences of #367--but from the PACER listings, it's clear that he was asking the court to let him file the following motions:
#363: A motion for a protective order allowing him (and probably Barbara) to refuse to comply with some or all of the discovery requests Maid filed on February 28. Windsor wanted to prevent Maid representatives from inspecting his and Barbara's property, and/or he wanted to refuse to answer some or all of Maid's interrogatories, and/or he wanted to refuse to turn over some or all of the documents Maid requested.
#364: A motion to give the Windsors more time to respond to the Feb. 28 discovery requests. Under the normal rules, they'd be required to answer the interrogatories and allow access to the requested documents within 30 days (which, here, means by April 1, because March 30 is a Saturday). He wants more time.
#366: A motion "to set aside orders." He wants Duffey to reverse his decision on some unspecified matters from earlier in the case. It's not clear which orders he's referring to, but I'd bet #356, the one ordering Windsor to pay $500 a day to meet his contempt fines, is among them.

#365, also filed March 1, is Windsor's announcement that he's appealing something to the Eleventh Circuit Court of Appeals. It seems very unlikely that an appeal at this point, by this mechanism, is procedurally permitted.
Finally, #367, filed March 4, is an order from Judge Duffey denying Windsor's requests in filings #363-366 (including the appeal notice at 365) as "dilatory and frivolous" and ordering court staff to shove those filings into a "secure, segregated location" so that they're not accessible to the public. The Court of Appeals can have those filings if they ask for them, but that's it. (As Duffey makes clear, this approach is one that the Court ordered for Windsor's filings back in October 2011.)
In #367, Judge Duffey also denies Windsor's request (which I don't see on the PACER list; maybe it's contained within #365 or elsewhere) to proceed in forma paupers, which means "too poor to afford filing fees," because "Windsor is acting in bad faith."
Volume 3:

Defendant William M. Windsor is a vexatious litigant. As the United States Court of Appeals for the Eleventh Circuit has observed, “the volume of [Mr. Windsor’s] filings poses a burden to clerical and judicial operations and is an impediment to the administration of justice.” Maid of the Mist Corp. v. Alcatraz Media, LLC, 388 F. App’x 940, 942 (11th Cir. 2010). A portion of Mr. Windsor’s misbehavior is summarized in this Court’s Order dated October 26, 2011 [(docket #)319].
In this case, Mr. Windsor has failed to pay the Eleventh Circuit’s April 2010 sanctions award under Federal Rule of Appellate Procedure 38 for taking a frivolous appeal [54] and this Court’s September 2011 award of attorneys’ fees and costs under Federal Rule of Civil Procedure 37 for failing to cooperate in post-judgment discovery in aid of collection of that sanctions award [293].
After first attempting to manage Mr. Windsor’s misbehavior with less restrictive measures, see, e.g., [Oral Order (by docket entry only) dated September 24, 2010], that Mr. Windsor repeatedly violated, see, e.g., [99], this Court ordered Mr. Windsor to show cause why a broader filing injunction should not be entered [316]. After receiving and considering Mr. Windsor’s response, this Court entered a filing injunction on October 26, 2011 that provides:
"IT IS ORDERED that no paper submitted by Mr. Windsor in this case shall be filed unless leave of the undersigned has first been obtained to file such papers. The Clerk is DIRECTED TO HOLD in a secure, segregated location, and without docketing, any papers submitted by Mr. Windsor in this case, pending review by the Court and further instruction.
Mr. Windsor may bring any future appellate challenge in this case as a petition for mandamus. ‘This procedure assures the sanctioned litigant sufficient review without enabling the abuse of the courts.’"
[319 at 11 (quoting Hong Mai v. Doe, 406 F.3d 155, 157 (2d Cir. 2005)]. That filing injunction remains operative in this case.
On March 1, 2013, Mr. Windsor submitted the following filings: (1) Request for Specific Approval to File a Motion for Protective Order and Objections to Discovery [363], (2) Request for Specific Approval to File a Motion for Extension of Time [364], (3) Notice of Appeal [365], and (4) Request for Specific Approval to File a Motion to Set Aside Orders [366].
Having reviewed each of Mr. Windsor’s four latest filings, the Court finds that they are dilatory and frivolous. Each of Mr. Windsor’s requests for specific approval to file new motions is DENIED, and the Court CERTIFIES that, because he Windsor [sic] is acting in bad faith, Mr. Windsor is not eligible to proceed in forma pauperis on his notice of appeal. See 28 U.S.C. § 1915(a)(3).
Per the terms of the Order dated October 26, 2011, the Clerk is DIRECTED to hold Mr. Windsor’s pleadings without filing in a secure, segregated location so that they are available to the Eleventh Circuit, if requested by that Court. As stated in the Order dated October 26, 2011, Mr. Windsor may bring any appellate challenge by petition for mandamus.
SO ORDERED, this 4th day of March, 2013.

ReplyDeleteAs I said, there's nothing terribly shocking about Duffey's ruling; he points out that he ordered pretty much all this same stuff in October 2011. The upshot of this series of filings, though, is that Bill and Barbara are going to have to hand over documents, answer written questions, and allow Maid's representatives to inspect their real estate... all by April 1.
Of course, if the Windsors break those rules, they'll just be in contempt of court again--which is something that doesn't seem to bother Windsor all that much. So who knows what they're going to do?
#367, though, makes it clear that Duffey has no further patience for Windsor's games and profligate filings. Clearly at some point, continued contempt will have to mean incarceration for Bill. When that is, and whether Windsor will keep pushing Duffey until he gets there, are open questions.

I suspected way back when he announced the change from the grand jury filings on April 1 to May 1, that it was due to some kind of legal action against him, but he played it off that some people weren't ready. Love it when the gut is right on the mark.

While I can understand his stubbornness refusing to comply with the courts, I have a hard time understanding his wife doing going along with it when it's clearly to the detriment of her own retirement / financial security.
It's scary to think he's either convinced her it's the best way to go or he's so controlling, she may feel she has no option. Given how he's treated many other women, I'm leaning towards the latter.

I quick glace for Mr. Welsh lists him as a divorce Atty, but also corporate law. Its interesting that she has retained counsel, while pie tard is not able, or willing, to do so.
I'm not certain, but I believe that the court forced Barbara to retain counsel. One of the fits Bill threw in the recent past happened when he discovered that the "power of attorney" Barbara executed naming him didn't actually give him the power to act as her attorney. This apparently caused his brain to explode. (If you look, one of his loony legislative proposals is to reverse that decision.)

DeletePetunia, I don't feel all that qualified to predict what he's going to do, because I find it so hard to understand why he's blithely committed all the contempt of court he has to date. It's nutty to provoke a federal judge (indeed, several federal judges) this way, but he's doing it nonetheless.
My semi-wild guess is that he's going to just keep doing what he's been doing--refusing to obey the court's orders, refusing to hand over the dough, until incarceration becomes a very real threat to him. Then he'll pay up, presuming he can. (If he really, truly can't, I think it's likely Duffey will accept that fact.)
As for what I'd tell him to do, that's much easier. Quit antagonizing federal judges. Pay the Maid people what the court has ordered you to pay them, and then get on with your life.
As I've said before, I think Windsor actually has a promising idea in the concept of a Lawless America TV show, if it were run by competent reporters. Examining disputed legal decisions (including ones involving alleged corruption by lawyers and/or judges) could make for fabulous journalism, maybe even popular journalism. But it would require someone much more competent, and much more interested in telling a careful and even-handed story, than Windsor himself is.

If you printed that, rather than a copy-and-pasted version of my comment, the judge in your case would immediately recognize it as a court decision, and his/her staff would then be able to find out as much about the Maid case from the Georgia federal court's website as they would like.

Yes, he filed against many Judges. It's on his .com WWW post my life story and feel sorry for me. He will use the WWW to file his fake charges against anyone and everyone. If you go against him, he will add your name to his "list". Is there merit to his www stories? Accusations? Charges? Filings? Hell no, none of the Judges were charged, but he will just keep going. (and if he does this to Judges, it should be pretty clear, that there are more "frivolous" charges against all the regular folks now on his "list" of court filings.
DeleteOh, absolutely. Judge Duffey is one of a very large number of judges that Windsor is incensed at for daring to rule against him.
DeleteIronically, Duffey has been considerably more reticent to unleash the full power of the federal courts' law-enforcement authority on Windsor than he is required to be. Bill would be in much more of a world of hurt right now if Duffey had really wanted to punish him. In Duffey's rulings, to my eyes, the judge comes off as very rational and careful in the face of immense provocation. Windsor is extraordinarily lucky to have his fate in this guy's hands.
yea that's what I have noticed with these bottom feeders that we have covered, unfortunately Bill isn't the only one. When they go on and on about how corrupt and horrible these judges are, the reality of the situation is its usually a very kind judge who is going out of their way to be fair (even to people who are directly slandering them all over the internet)
DeletePetunia, I don't feel all that qualified to predict what he's going to do, because I find it so hard to understand why he's blithely committed all the contempt of court he has to date. It's nutty to provoke a federal judge (indeed, several federal judges) this way, but he's doing it nonetheless.
DeleteMy semi-wild guess is that he's going to just keep doing what he's been doing--refusing to obey the court's orders, refusing to hand over the dough, until incarceration becomes a very real threat to him. Then he'll pay up, presuming he can. (If he really, truly can't, I think it's likely Duffey will accept that fact.)
As for what I'd tell him to do, that's much easier. Quit antagonizing federal judges. Pay the Maid people what the court has ordered you to pay them, and then get on with your life.
As I've said before, I think Windsor actually has a promising idea in the concept of a Lawless America TV show, if it were run by competent reporters. Examining disputed legal decisions (including ones involving alleged corruption by lawyers and/or judges) could make for fabulous journalism, maybe even popular journalism. But it would require someone much more competent, and much more interested in telling a careful and even-handed story, than Windsor himself is.

We had a person up north who was scheduled to film. I have the schedule so I sent off messages about the cal. page. He responded. he explained that he sent in everything and did not get a schedule date, but instead was pounded by emails requesting donations. So he dropped out.
That person had to be Diane G or maybe another volunteer. I know Loryn was scheduling so who ever was in charge of contacting emails was definitely screwing things up on purpose. Twelve in one day did not show up, I think this is why....
Do you remember when everyone was accusing Bill of doing the movie for the money? This is why, these donation forms were being sent out in multiples with no other information.

DeleteI had never heard of AMPP, but one day many good female activists were posting links to the page. It couldn't have been more than 2-3 days later that Bill was blasting them. I thought it was directed at LR and whoever else was the administrator. I never understood how they could have been truly harmful so quick if at all. What I saw was a bunch of angry women, but they were angry at pedophiles. And really if you have been in a room full of middle aged women when they start dissing men, I really didn't think it was a big whoop. I think it was just that somethings maybe shouldn't seen by the public. Imagine if male locker room humour was on a fb page and then called out as a sexist group. Allie yeah I would bet you are blocked cuz I can see the link. Petunia was looking for names and screen shots of fathers rights people. There are about 400 comments on that thread. Kim W stated early on she did NOT think Lawless was a mens rights advocate. Lorraine Tipton said the mothers were divided and she hoped Bill Windsor did not throw mothers under the bus. Maureen Walden Lasher asked Kimberly to post the article about SPLC and Lawless (I had see the article from SPLC but Lawless was not mentioned on there as a hate group, betcha that is where that rumour started). Some of the people on that thread have deleted their comments or have me blocked, or maybe I have them blocked. LOL I know I have Julia Fletcher blocked, but I do believe she is the one that tagged Lori and Bill. The conversation in general was about the fathers rights and it sounds like there were issues within the women's group of women who were involved on both sides. I can see where if Bill just saw one chunk of the comments he would have thought he was blasted. There were some AMPP on that page but there were also people from other groups. Maria Melinn was on there, no idea what group she was in. Elizabeth posted that Bill had just sent her a pm about being a coordinater and she was a bit angered. I read my exchange posts between Allie Overstreet, aka Lorraine Renee Yeager. And talk about a bunch of bullsh$t. Allie was the moving party in having all the mothers who liked a page removed from the project of L. America. I was on the thread where she posted a rant about AMPP and how they were father haters. That was when I blocked her, and the only reason I blocked her. She knew full and well the volunteers- Loryn Ryder, myself and others had liked the AMPP page, and she lead the way to have all of the 36 testimonies removed. Now I see Allie wants to be a hero to this page as well, she is a hypocrite and fake. I did not ask myself to be removed from the project, this was Allie and Bill's doing after I posted I would not be running any activism through my personal page. She wanted to be top female and Bill windsor's right hand girl.....what a joke. And as for the saying my daughrs name, I slipped the first time, he cut the camera and told me he promised to bleep it out before posting, told me to continue using it if it made the testimony flow better, and the bleeping would be done asap. I do have a notorized and sworn affidavit to that effect by a person who was in the room with us.

Cox until I was removed from the project:D...actually, I was lead to Crystal's page by Bill Windsor three days prior to being removed from the project because I had a fake crystal cox page come to my wall and try to get my address and last but not least, threatened to be put in a box with Bill windsor and crystal cox....So, I actually didn't get to know Crystal cox until after I was blocked, and I know her only in messaging and as a fellow citizen who was filmed and blocked as well......what a joke this page is. Allie basically set up the conflicts between everyone,..... told Mary B, that she shouldn't complain that she was blocked, that it was okay for everyone else to be blocked but now that Mary B was blocked it was wrong?.....so what is up with that Allie, now that you are blocked with Mary B, it isn't alright? DeleteOh, and least I forget, I apologized to the AMPP webmaster on Bill Windsor's thread....It was blown way out of proportion by Allie and Bill....I had the intentions of actually helping people in mind...not like some others who had their own self interests at heart. I did speak clearly on Deanna Kloostra....I said I wouldn't work with her after she wrote 'Lovebirds, vomit' in the chat during Windsor's talkshoe while I was talking....she is sick to even suggest it, and her comment made me want to vomit....so if anyone wants to post that comment I sent to Bill, I beat them to the punch...too bad really, I had researched Deanna Kloostra's case as well as her abused swan issues...I actually signed a petition on her behalf at one time and put her issue on my wall....but it doesn't take much to warrant a 'slam' insult from people who don't have much brain...I actually had compassion for her and still do...just won't work with someone who doesn't get her facts before making up gossip .....
