Probably going on right now down in Corsicana Texas, Joey Dauben's freedom is on the line. The boy, now 19 year old man, who accused Joey of sexual assault in 2007 is on the stand. The prosecution came out swinging yesterday and teed everything up for the accuser to come in and knock it out of the park. Two things to watch for in today's testimony. How graphic and detailed oriented will the boy be in describing exactly what happened in the shower with Joey. How credible will he look to the jury.
Today we will also get a good look at just what Joey's defense is going to be under cross-examination. We have certainly been given hints that they plan on attacking this boy's credibility. That may be a tough sell. So far we have learned that he came from a divided home but its hard to connect any of that to what Joey is accused of. The defense has got to establish holes in his testimony, and not incidental ones but holes large enough to create reasonable doubt that the boy is telling the truth.

Poor Presley, she hasn't got a clue what is about to happen to her. I guess the number one key to being a daubenista is a complete detachment from reality. She is a cave dweller, she hasn't seen sunlight in years.
DeleteI have a very strong gut feeling... Joey will not be out until he is 45. If they brought up "he has a history" and show examples from his site with him doing that.... It's all over folks.

I really do not believe he will survive hard time. Seriously, I think he's in very big danger in prison.
They hate:
1) White people
2) Child Molesters
3) People who stir rumors
4) People who talk B.S.
5) People who sling mud
6) People who accuse others
7) People who make up stuff & call others names
He's also at a disadvantage unless he fights good for his size.
If he starts a paper there, and starts slinging mud at prison gangs, gang members, or psychos.... Or even at the cops... things won't be good.
I wish he would just be honest. Yes, this is a very big deal. Sure you can make arguments that Joey might not have been much more mature than the kid at the time. Maybe the kid initially was the aggressor. It still doesn't absolve Joey of responsibility. If it happened, Joey KNEW it was wrong. Joey was an adult.
ReplyDeleteFrom the testimony already reported, it seems like the kid had a lot of questions/anxiety/issues after the events. Yeah, he might have had the exact same issues if he'd done the same things with a peer. However, you add the adult/leader child/camper aspect to this, and you've just piled on a whole other group of issues with trust. Those can last for a lifetime. However, (if the allegations are true) all of that damage has already been done. It is time for Joey to GROW UP and be an adult. He continues to be an "abuser" and cause this boy more and more pain by denying the allegations.
I think Joey just thinks that if he keeps denying the allegations, some miracle will happen and he will be acquitted. But, the reality is, if he did it, the truth will be revealed. No matter how hard it is, he will be exponentially better off if he would tell the truth. However bad it is, it is made soooo sooo much worse by lying.
Oh, question for David (or anybody who knows): There was talk about this kid being a foster child and having made prior accusations. Has there been any indication that the child was in the foster system at some point? Obviously we already know there was some family turmoil going on with his father, but was this a foster family or does that just seem to be totally unfounded.
I thought the weirdest thing about the case is the disappearance of the victims father and stepmother. Very strange
