The Defense Has Concluded Their Dog and Pony Show

It sounds like Joey has taken over on his defense team as they have spent the morning bringing up character witnesses in an effort to get Joey probation.  They have called a messianc mother of 9 who said Joey was always good around her kids.  Prosecution asks her if Joey was ever alone with any of them....No, would you want Joey to drink around them...No (I would have also asked why anyone would have 9 kids).

Then comes the Kevin's house story.  Joey trots up there the mother who came to Joey about abuses at Kevins House.  She said she wanted to notify someone, so she told Joey.  Then up comes her son who is a convicted felon (drug crime) and his testimony backfires to some degree.

Next we have Joey's probation officer I guess to say that Joey sort of followed his probation.  Then the defense rested, Mommy and Daddy sitting on the sidelines deciding not to beg for mercy.  So now the jury is deciding on how long he will be in prison.

  2. Again I ask, Why does society give so many chances to criminals??? VICTIMS DON'T GET SECOND CHANCES.

Slapped wrists, or time outs, don't make these people suddenly productive members of society. History...that tells where this persons mind is at, as far as where their future will go.

Here's a news flash...don't want to go to jail??? Don't break the law.

It was/is/and never will be a victims actions that created the problem, it was solely the act of the criminal...the victim is just the innocent target of a personal decision to ignore the law.

    1. How so? He was convicted on all four counts. If the jury is dumb enough to give him probation, that doesn't mean they didn't believe the victim, or they would have cleared him of all charges.

    2. Because anytime you have two choices, going to jail or not going to jail, not going to jail wins, hands down. Hell, he can live with mom and dad and watch TV or play Xbox or whatever it is man-children do to pass the time away after being convicted of raping a teenage boy.

    3. If you wrote the first comment, it appeared as though you were saying he got probation because the jury didn't believe the victim. So, read the above comment again.

I bet the jury will sentence today. In my experience (I'm a lawyer) jurors hate having to come back more than absolutely necessary once the two sides have closed.

  12. I think 20 years at least.

However, I would not entirely disagree with probation. He has his Ellis conviction, and would be a registered sex offender. He so much as farts the wrong way then, he'd be toast.

This is coming by just he Joey I knew. I did not see him as dangerous. I did no see him as a home invader. I did not see him as a bank robber. I did not feel threat near him.

Since its been so long since it came to trial, he's been locked up pretty much for a year, no credibility in writing... AND if he was on a long time sex offender registry... He'd be dog meat if he did anything else.

So anyway, that's my bias, and why I would be dismissed from a jury.

I think this jury will see his crimes, his former, and his lack of admitting it. I think 20.

Just wondering....if Joey gets probation, will Ellis County whoop out those charges they have in reserve for the porno pics? That's another felony.

On another note: Loryn has some guy who says he's a PI that really went after Bill hard. Bill ain't even playing, this is getting uglier.

  18. I thought for sure there would be a decision by the time I came home today.

Did they actually find child porn on Joey's computer? It really is sad that this took so long for the charges. I bet there have been a lot of illegal things on Joey's PC over the years. However, by now he's probably had new computers or rewritten over the data with new data.

    1. I think it's the opposite. I think since they came to an initial verdict, they were all way on the guilt page. So it's probably long sentence vs longer sentence. I doubt probation is on the table based on the time to convict.

    2. I agree with OReader on this one.

Longer means they are discussing 10 to 40 years.

    1) Lower the fence for JimmyS, so that hopping back & forth won't be such a challenge. **He knew Joey. he didn't know Joey. Joey should get probation, Joey should go to prison. Joey will do very little time, Joey will do 80 years.
    2) Get JimmyS some new pants because he has ripped crotch out of least 5 pair since Friday with his fence jumping & I predict he will at the very least shart in the ones he's wearing today, regardless of what jury decides.
    3) Please have Internet connection to JimmyS go on fritz immediately after sentencing is announced & stay on fritz for at least 72 hours so that our eyes do not bleed from reading any more his goofy musings.

  26. Jimmy, don't use double negatives. I can't tell if you do or do not want Joey to ever get out of prison.

    2. With most convicts, I'd agree, but child rapists are a different class -- liek I said, the recidivism rate is very high. I'd only want it under close supervision (perhaps lifetime ankle monitor, to start), and only then if I thought he would not be a threat, on any level, to anyone.

The idea of Joey on the streets, as reckless as ever, but hardened with a first class prison education, scares me.

      Delete
    3. Also anonymous, the instances of Homosexuals in prison being raped, killed, & pimped out is NOT good news for Joey.

Child molesters in general are not treated well. Gossips, rumor mongers, and false accusers are often shanked.

I do want to see him make it out of prison, have a family, and a good life. I'd want that for anybody who has truly changed.

    5. I understand all that, Jimmy, and think it is a sad commentary on our prisons. If necessary for his safety, he should be kept out of the general population. But I also think that if he is convicted, one consideration in sentencing has to be whether he will pose a threat to others when he gets out.

    6. OReader, not according to my gaydar. I've said that since I've been posting on here.

It is sad that our prisons are that way. Also, I feel it is hypocrisy when people laugh about being "bent over" for "bubba", almost like its advocating rape for Joey - because they are so outraged at Joey raping.

    8. Supposedly, but experimenting doesn't make somebody gay. Granted, I think he is, but he says he's not, and he has a girlfriend. When you say you want him to eventually have a family, do you mean with a gay partner?

You seem to be giving credit to the Presley relationship, but that's a farce if he is gay.

"In closing arguments, his attorney asked the jury for probation, arguing that it was one incident and that his client would benefit from rehabilitation."

REALLY? Only one incident and his client would benefit from rehabilitation? One would have to admit guilt, which he didn't, but apparently his lawyer thinks otherwise.

My heart goes out to the victim and hope that he knows this was not his fault and that his bravery may have saved others.
