Is It Really Joey Sandusky? Day One of The Joey Dauben Trial

David Webb once again gives us a play by play of the prosecutions opening round.  I have mentioned the similarities between Joey and Jerry several times on here.  No question Jerry is a much bigger monster than Joey but we can't help but notice the striking deja vu going on here. So far from Joey we have heard that the boy is a liar and then we hear some deep conspiratorial plot as the reason for this accusation.  Now we are taken back to the shower rooms.

Joey is accused of sexually assaulting this boy in the shower at this camp ground site in Navarro.  Joey was stupid and left a myspace message to the boy that mentions a "shower waiting".  Context is needed on that statement but once again we have a situation where if the prosecution can just establish that this boy and Joey showered together, its game set match for Joey Dabuen.  Why in hell would Joey be showering with an underage boy alone?  It seems that other witnesses are going to be able to establish that at the very least they were together alone in the shower.

The other fact that comes out today is that this boy didn't want to make these accusations and reluctantly admitted them to his mother, but he made them shortly after the incident and has stuck by them ever since.  His behavior was withdrawn and isolated after this incident. 

The prosecution has teed up the ball for day two.  If the boy comes in to testify and can establish what was alleged today, the ball will be out of the park and I don't think it will matter what Joey says in defense at that point.  Even if he didn't actually engage in sexual intercourse with the boy he is going to be guilty by proximity.

    1. I think so, and honestly right now I feel pretty bad for Joey. Not because he doesn't deserve what he is about to get but because I don't think he can survive it. Joey is weak and insecure, he will have a terrible time trying to make it in a prison with hardened criminals.

    2. He needs protective custody the entire time. The Joey I know would not make it out of prison. If he runs his mouth, that will be it.

      What is he a buck sixty, insecure, runs his mouth, talks rumors, molested a child (boy for that matter)..... not good.

  2. He will have a definite hard time in prison. No doubt. But, he should have thought about that before he decided that teen boys were his thing. 15 is not the age of consent. Maybe in Daubenville, but not in Texas. Now think of the poor child that is traumatized for life! There is a special place in hell for child molesters.

    I figure by Friday or Monday, Joey will be convicted in this Trial By Jury. He would have been better off to have taken the plea. But, Joey isn't that smart.

    2009 is when the investigation begin. Wow. Now, fast forward to 2013. And he's on trial. Rangers are the home team. Over 90 percent conviction rate. Now, my odds are on the Rangers and the home team. I dont think the Dauben Camp is going to stand a chance at winning this ball game.

    1. Not really going to mince words but I think Webb's article states he was 3 months shy of his 15th birthday? He was a 14 yr old child. 14.

      Joey's own ego prevented him from taking a plea imo. Rangers have, I believe 99% rate.

      1,735 felony arrests, 193 misdemeanor arrests & 1927 convictions.

      Joey is a has been. What I do know of Joey, I agree with Ginger 100%. He won't be able to handle hard time. This is where a strong male influence would have helped Joey make the best out of a bad situation. Plea, plea plea plea. Instead, they paint up poppa wheelies and take pictures with Savior Billy. smfh.

      I'm still royally p*ssed at the smear campaign wagered against this child. This is such a sad day. :(

    "Shower waiting". However, of course there is more trial... If this guy comes out and describes the acts in full detail, remembering details... Joey will be toast.

    Is the prosecution still going for life?
    Is it still 4 felonies against him?

    If so I think Dauben a minimum of 20 years.

    I do not think Joey will be able to handle hard time. If he goes, he needs to SHUT his mouth. SHUT IT FAST. They'll shank him in prison for talking garb on people. Hah, if I was his dad I'd be telling my kid to go steal a car and run to Mexico without passing "GO". LOL

    Joey's family REALLY needs to give him several "prison survival guide" reads off the internet. Tell him to shut his fingers... no papers. not to talk b.s. about people. Basically STFU on all agendas.

    Geeze, aren't we jumping ahead a little? It's only day one of the trial. I agree Joey, if sentenced to prison, will have a difficult time. But, IF he is found guilty the minimum punishment is probation. The trial for the Ennis teacher just concluded; he was found guilty on 5 counts and received 5 years for each count to be served concurrently. Maybe we should at least wait to hear Joey's defense before we convict him to a life sentence.

    My point is, nobody has heard all of the facts yet and you can't ever predict a jury's recommendation. Remember the OJ trial?

    And, if Joey is guilty, what he did was sick and disgusting. But, Joey has shown absolutely no indication that he is a pedophile. This word has been soooo over used, thanks to the lightening twins, that it seems to have lost all of it's meaning.

    1. I have been pretty resigned to the fact that he is going to be convicted based on the Texas Rangers bringing the charges. At that point him being found not guilty is about as likely as the skies clearing up in the next hour and not raining any more today (its possible but lets not count on it).

      I think he is looking at 12-15 years. Yes I hold out for the defense to take a shot starting today when the boy takes the stand (they are going to have to put some holes in his story) but I don't think there is going to be much they can do especially if they can't explain that "showers waiting" message.

    2. Also consider that Joey should have tried to go on trial for this first before his Ellis charge.

      1st time offenders (probably like that teacher) often get a break. I don't know the details of the teacher, but it could have been one romp.

      If Joey did this over an entire weekend in more than one place, the jury WILL consider this MORE than one romp. This will be on top of the fact that he is already a FELON.

      I smell 20 years if he is convicted. I really do feel bad for Joey, and the victim (if it happened). Joey because I do not believe he will survive 20 years. The victim because when you are 14, who wants a 26 year old.... The whole situation is sad.

      Even if the victim made up the story, it is sad.

      I did not know his mother filed things with the cops in 09. That makes a large difference in my mind. I was wondering for a long time why 4 years??? Why 4 years!!??

      Of course things turn up in a trial. We'll see what happens. This is the prosecution stage.

      If the defense uses some "conspiracy story" that is long and elaborate, he's toast.

    3. I'm not sure if it was just one event or spread out over the weekend but the other problem Joey is going to have is the messages we already know exist from Joey to this boy after the incident where Joey seems to be worried that the boy is going to report something.

      On the sentencing I think 20 is the max, there is no way they don't run all the sentences concurrently. You are right if he would have taken his medicine on this one first he would have had a lighter sentence but I still don't see him getting the max, but I also dont see him getting probation either.

  7. Jimmy you know little about the courts if you think that Joey had any choice as to which trial went first or the timing of either.

    It isn't wise to "cop a plea" if you know you've done nothing wrong even if it takes longer to prove. I'm not saying he did or did not abuse this boy, just thinking out loud about the possible reason for going forward with a full jury trial. Unlike some here, I believe there is a possibility of innocence.

    There is a lot involved with the victim's family according to Webb's story that could indicate a false allegation and there are a lot of questions like why did this father have supervised visitation? Will the judge even allow that to be said? Did Joey know the father was not in the pictur? Where did the father disappear to after this so called out cry and why and why did he move to the other side of the country?

    It's not uncommon for a victim of abuse to accuse someone else when it is difficult to accept that someone in their own family could be responsible. I hope Joey has a lawyer who is vested in the truth and willing to bring on expert testimony. Unfortunately often public defenders couldn't care less about the outcome of a case, they get paid even if they do a horrible job, so there's little incentive or personal consequence.

    I also wonder what authorities found on Joey's computer that may also indicate people willing to commit crimes against him and/or others and if other charges will be forthcoming. MVZ obviously comes to mind, but who knows there may be many others! Joey crossed someone whose family is deeply involved in the CO$ and Fair Game allows for any "SP" to be harassed for life particularly in the courts with false allegations (Look it up on wikipedia or google "Paulette Cooper". A CO$ was set up in Irving in 2009, so there are obviously practicing members locally.

    So many possibilities!

    1. So someone that had it in for Joey in 2008 decided they would take years of trying to nail Joey for some fabricated crime? Words in print more than likely water down the emotion in the courtroom and all I can think of is this young man being forced to appear in court today because Dauben.

      I recall Dauben saying this was a foster child. Apparently he is a child of divorced parents. Not only does this boy have to testify but also his brother and you think it could be something created as revenge against Joey. Give me a fricking break!!!!!!

      It's not a conspiracy and if Joey tries to tie this in to anything like that, it will only make him look worse. He is before a jury before his peers (well actually I doubt there are 12 other former parking lot attendants/bloggers/fake newspaper publishers in the county but I digress) and I seriously doubt these people will give much credibility to any such notion.

      Why does Webb insist on using 15 or 3 months shy of 15. Usually I hear things such as a person was/is "** days shy of their Nth birthday" or even "** weeks shy of their Nth birthday" but months?

      Ummm yes he did, the defense is the one that delayed the trial so long that the Ellis county case ended up going first. I guess you could say that Joey needed that time for his attorney to find a miracle but it was still up to him.

      If anything in the rest of your statement is what Joey's defense is going to be based on, he might as well start walking down to Huntsville right now. Whatever was going on with the boys parents in their custody battle doesnt change what ever did or did not happen that night in Navarro. And as soon as you start talking conspiracies its really over. Turn out the lights.

      So anonymous believes that because a dad had supervised visits that it may show that the boy was sexually abused by his dad?

      Thus the boy in fear/shame blames Joey? Now even 4 years later is taking the stand.

      Look I hope Joey did not do it, but I do not believe that a 20 year old would take the stand against somebody 4 years later - against an innocent person - for something their own father did.

      Whaaa?

      The only possibility of Joey being innocent of this, is if this guy had a serious vendetta against Joey or Joey hurt his family in such a way. If this was Amber Haggerman's brother (hopefully it was not), I would understand why he would be so mad at Joey.

      Otherwise, I would like to know a REAL motive of why this MAN is going to testify against Joey 4 years later.

    4. I agree with Gingersnap on this one (and obviously I have not agreed in the past with him on SEVERAL things).

      If this is Joey's defense, he's going to Huntsville.

      I HOPE Joey did not do this. I pray he didn't. For his sake and the alleged victims.

      But if this is his defense, just to smear the young man, foster care, VERY speculative daddy abuse backed by NOTHING except "well look he had supervised visits".... Joey is TOAST.

      If this is 4 felonies he faces, all for sexual assault of a minor and if this is his defense.... I know exactly how it will play out in the jury.

      There will be parents on the Jury who are outraged.
      There will be Christians on the Jury who think "church camp"
      There will be those against homosexual behavior

      They will combine the 4 acts all punishable by 20 years EACH.

      They will see that he is a convicted felon already.

      Outraged at minor sex at church camp, with gay sex they will say "once in the shower, once in the boat" Combine the 4 charges into 2 "real ones". (Cuz you know going from a BJ to pokey pokey is kind of all in the same with "sex" going on)

      1 shower felony
      1 boat felony

      20 years each
      Convicted felon

      They may look at his history of no jobs. They may find pity on him. I don't know on this one.

      I smell a combined 20 years.

      2 sexual assault charges - 10 years each.


      If he took this on first (before Ellis), they would have combined the charges to the first being deferred, the second being 7-10 years.

      Ellis then would have gotten him 1 year. (because print is print). So that would have been 8-11 years.

      WOW.

      Joey in prison is going to have to SHUT UP. No papers. Look forward. Punch the hell out of the first guy who takes his milk..... I don't see that in him. He runs his mouth and insults people, smears gangs, runs a paper against ANYBODY, they'll shank him, rape him, beat out his teeth so he can't bite. Those guys in prison are very hard core... Especially to a child molester.

      This has disaster written ALL over it. It's so disturbing.

      I hope his defense is rock solid.... If I was in his shoes I would already be applying for jobs IN PERSON in southern Mexico.

      There is nothing to indicate false accusation and EVERYTHING in Webb's article to indicate his behavior is well within exact actions of other teens who have been raped. A contentious divorce happens often and IF there's a fasle accusation against a father, its always the mother making it. I do not believe the actual divorce or its details have anything to do with this case, only to mention for fact how long this family has been seeking justice and what happened to the father (why he can't testify).

      Please back your points up with statistical fact and documentation (because they're both so sick its laughable). Your second point... I used to work with abused teens for a living anonymous! It is NOT common at all to accuse someone else.

      Your conspiracy quacking at the end makes you sound exactly like a Daubenista. What FLAVOR of koolaid are you drinking today anonymous? Nice try but what a load of manure.

    Presley Renae Dauben-Tuma That was the Ellis County charge, but it was created to be used for identity theft cases ie stolen credit cards etc NOT publishing a story. That case is clearly a First Amendment Case...and the case that the State of Texas thought my abuser, Shane Crowe, would possibly be a "legit witness" to. The Ellis County DA, Patrick Wilson, had to seat two grand juries to even get an indictment. the second GJ was planted with two people who have a known bias against Joey. These cases are so crazy, I mean at least the screaming demons aren't calling Joey Elijah or Moses (lmao), but there are a whole lot of weird connections that I hope all come out this week!
