The Defense Has Concluded Their Dog and Pony Show
It sounds like Joey has taken over on his defense team as they have spent the morning bringing up character witnesses in an effort to get Joey probation. They have called a messianc mother of 9 who said Joey was always good around her kids. Prosecution asks her if Joey was ever alone with any of them....No, would you want Joey to drink around them...No (I would have also asked why anyone would have 9 kids).
Then comes the Kevin's house story. Joey trots up there the mother who came to Joey about abuses at Kevins House. She said she wanted to notify someone, so she told Joey. Then up comes her son who is a convicted felon (drug crime) and his testimony backfires to some degree.
Next we have Joey's probation officer I guess to say that Joey sort of followed his probation. Then the defense rested, Mommy and Daddy sitting on the sidelines deciding not to beg for mercy. So now the jury is deciding on how long he will be in prison.

Ahhh yeah, I almost forgot about this one. Lets paint the picture.....Joey had just been raided, as he said, for the Ellis County case and he was already saying on his blog that he had protection of the press in not having to reveal his sources or be accountable for them. I and a couple of others told him on his blog that he is not the press, he is just a blogger and nothing more and he better take those charges seriously. I dared him post his tax returns if he really thinks he was some sort of media group. Instead of that, he decided to give us a tour of his messy blazer. Ahhh memories. Back then he thought I was a female process server in DeSoto (thats what his criminal buddy Margetis told him), now he thinks I'm some guy in Ennis.

Joey Dauben Now Faces His Future
A court room in Corsicana is about to be called into order and the jurors will hear pleas from Joey's parents on what to do with his future. Let's be clear on this, there is no way Joey doesn't get at least 10 years in prison. The jury has no choice, even by Joey's own words. I would say its 10 at the low end in and 25 at the high end. His parents may be able to shave a few years off, but thats about all they can hope for.
I can't think of anyone in the world more unprepared and unfit for prison than Joey. Then throw in the fact that he will be in there for sex with a young boy and the odds will be all against him. I still say he belongs in a prison mental institution but most likely he will be heading down to the state's general population. If he survives, and thats a huge if, he will no doubt be a drastically changed person when he gets out. In some ways that can only be a good thing, but will he try to make the best of his time there? Learn some real life skills. Try and equip himself so that the mid 40 year old man that re-emerges from prison will have a chance at some sort of life outside those walls. Or will he fall victim to himself and the system and become someone who can not make it outside of the new system he must learn to adapt to?

Meanwhile, The Pie Man Contines His War
The War of the Pies update:
So after Windsor backs out of a showdown in Montana that he ordered, Daddy Dauben's new messiah has continued with his paid vacation around the country. He has learned that he needs to use cars with GPS (I guess he still hasn't figured out that he has it on his phone).
He went to Hawaii and now there is a pie shortage in the island state as a result.
Loryn and Connie set up a new facebook page to attack Lawless America.
Another group has out smarted Bill as they have actually made application for the trademark of Lawless America and may force Bill into using another name. The Pie man responds by saying he has the rights to it because of his fake movie on IMBD and that he called it a copyright, even though he never actually did it.

Joey Dauben's Own Words Are Used Against Him During Sentencing

I could spend a couple of hours of "I told you so" on this, but I will spare everyone that. I will have to do one though. Many have disagreed with the name of this blog..joey is a little kid. Oh he most certainly is:

That is not a man, that is a child and its really as simple as that. The authorities took away the kids toys and he cries about it.
Now, on to the penalty phase. I really can't say it any better than what the daily sun did:
"Dauben testified that as a publisher he had criticized the Ellis County District Judge and District Attorney for giving child sex offenders probation. Instead, Dauben had urged giving sex offenders an automatic death penalty. He said he’s since had a change of heart."

“I couldn’t agree with you more, Mr. Dauben, pass this witness,” Wolf said smoothly.
When his defense attorney, Ed Jendrzey, asked Dauben if he was asking the jury for probation, Dauben paused for more than two minutes, looking at the floor and pursing his lips before saying that if the jury were to hold him to the same standards to which he had held convicted sex offenders in Ellis County then they would not give him probation.
“If you’d be merciful and give me probation, that’s great,” he said. “If you were to hold me to the same standards as the Ellis County Observer, then no.”
Dauben described one case in which he falsely accused a man of sexually abusing his children based on the word of the man’s estranged wife. In that instance, he was arrested and convicted of the fraudulent use of identifying information in Ellis County.
“I made a mistake,” he said. “I falsely accused a man of the same thing I’m accused of.”
At that time, Dauben was put on probation and told he couldn’t get on the Internet anymore. His probation was revoked when the newspapers continued publishing. Dauben said he didn’t do it, though.
It was unclear Friday evening if Dauben realized the irony of the situation — that he claims to be falsely accused, just as he falsely accused others; that he advocated the death penalty for child predators, but asked for mercy for himself after he was convicted of it; that within half an hour of his conviction, he took the stand and cried as he described his role as sole defender of children.
“I’ve learned I’m not a judge,” he said. “I didn’t have mercy on people. I was not forgiving of people.”
These revelations came to him the second time he went to jail, Dauben said.
Dauben also said he accepted the jury’s decision, but he refused to admit having sexually assaulted a 14-year-old boy in 2007 while at a church retreat at Navarro Mills Reservoir, insisting that he was falsely accused. When Wolf asked him if the purpose of probation wasn’t rehabilitation, and wasn’t a necessity of rehab that the person admit guilt, Dauben dithered and finally said yes, adding: “I’m not going to admit to something I didn’t do.”
So once again we have Joey basically saying I take full responsibility for my actions, but I didn't do it. I would still say the mental institution should be on the table here.
