Joey Dauben's Own Words Are Used Against Him During Sentencing

http://corsicanadailysun.com/local/x2056581705/Dauben-found-guilty-Friday

I could spend a couple of hours of "I told you so" on this, but I will spare everyone that.  I will have to do one though.  Many have disagreed with the name of this blog..joey is a little kid.  Oh he most certainly is:
"However, almost immediately began the punishment phase of the trial, and Dauben cried on the witness stand as he described his various activities as publisher of the online newspaper The Ellis County Observer."

That is not a man, that is a child and its really as simple as that.  The authorities took away the kids toys and he cries about it.

Now, on to the penalty phase.  I really can't say it any better than what the daily sun did:

"Dauben testified that as a publisher he had criticized the Ellis County District Judge and District Attorney for giving child sex offenders probation. Instead, Dauben had urged giving sex offenders an automatic death penalty. He said he’s since had a change of heart."

"Dauben testified that as a publisher he had criticized the Ellis County District Judge and District Attorney for giving child sex offenders probation. Instead, Dauben had urged giving sex offenders an automatic death penalty. He said he’s since had a change of heart.

Under cross examination by Assistant District Attorney Andrew Wolf, Dauben said it would be hypocritical of him to ask for probation when he hadn’t been merciful to men in his same position just a year or two ago.

“I couldn’t agree with you more, Mr. Dauben, pass this witness,” Wolf said smoothly.

When his defense attorney, Ed Jendrzey, asked Dauben if he was asking the jury for probation, Dauben paused for more than two minutes, looking at the floor and pursing his lips before saying that if the jury were to hold him to the same standards to which he had held convicted sex offenders in Ellis County then they would not give him probation.

“If you’d be merciful and give me probation, that’s great,” he said. “If you were to hold me to the same standards as the Ellis County Observer, then no.”

Dauben described one case in which he falsely accused a man of sexually abusing his children based on the word of the man’s estranged wife. In that instance, he was arrested and convicted of the fraudulent use of identifying information in Ellis County.

“I made a mistake,” he said. “I falsely accused a man of the same thing I’m accused of.”

At that time, Dauben was put on probation and told he couldn’t get on the Internet anymore. His probation was revoked when the newspapers continued publishing. Dauben said he didn’t do it, though.

It was unclear Friday evening if Dauben realized the irony of the situation — that he claims to be falsely accused, just as he falsely accused others; that he advocated the death penalty for child predators, but asked for mercy for himself after he was convicted of it; that within half an hour of his conviction, he took the stand and cried as he described his role as sole defender of children.

“I’ve learned I’m not a judge,” he said. “I didn’t have mercy on people. I was not forgiving of people.”

These revelations came to him the second time he went to jail, Dauben said.

Dauben also said he accepted the jury’s decision, but he refused to admit having sexually assaulted a 14-year-old boy in 2007 while at a church retreat at Navarro Mills Reservoir, insisting that he was falsely accused. When Wolf asked him if the purpose of probation wasn’t rehabilitation, and wasn’t a necessity of rehab that the person admit guilt, Dauben dithered and finally said yes, adding: “I’m not going to admit to something I didn’t do.”

So once again we have Joey basically saying I take full responsibility for my actions, but I didn't do it.  I would still say the mental institution should be on the table here.

Gingersnap: This part made me wonder if the reporter has been reading your blog.

    1. might be. I'm sure it was pretty hard to put into words all the circular reasoning and logic going on here. But this could have just as easily been Connie or Presley up there, they all sound so insane its impossible for a sane person to follow what they are saying.

      Delete
  2. Webb's story is up. Looks like Presley fled even before the trial started, proving just how much a fraud their "relationship" really was. At this point, the only true thing about Presley is her first name, every other thing in her life is a lie.

They are rolling out everyone with a sob fest to try and get Joey off with just probation, including mommy and daddy next Monday. I don't think its going to matter as the jury now hears of Joey's other recent conviction that came with probation.

Joey gets to spend the weekend at home with his family. I am glad for that, and I hope they can start preparing their child for the reality he is going to face instead of chasing unicorns and lightning storms.

Very troubling news for Joey is that the prosecution is asking that the sentences be stacked instead of concurrent. Even I would say that would be overly harsh in this case.

    1. I disagree that it is harsh. Child sex offenders, especially those with responsibility over children *IE camp counselors, teachers, scout leaders etc) should get them stacked!

    2. Well this stuff is drawing to a close fast.

Joey is convicted of 4 more felonies.
Lawless is banned by Connie & Presley and them by lawless.

Presley has probably bailed on the entire situation. (which is probably the best choice so she can get on with her life)

Joey's parents are just doing what parents do, which is beg mercy from the jury. (can't blame them for just being parents in this case)

      Stacked sentences....

The question is just how long total?

That's up to 80 years... all 2nd degree felonies.
      (Isn't life considered 30 years?)

In consideration he was already a felon... how long people?

      Delete
    3. Actually Jimmy, you have a good question given that he is a felon, it may make a difference in sentencing being convicted in Ellis first. I don't think he's looking at 80 years. This time last year I figured 20-25 but now I think he's looking at 12 to 20 years. I'm not sure he is able to be in the category of "time off for good behavior".

I'm also concerned the judge released him. He could be so distraught, he has all kinds of options to just off himself which is what cowards often do...

  3. Dauben's girlfriend with whom he has been involved for about a year moved out of state prior to the trial and did not return for it. The defendant said she urged him to take the witness stand in his own defense, while his lawyer, family and friends urged him not to do that.

So Presley basically convinced Joey to hang himself. Presley - who takes advice from a diagnosed schizophrenic who uses bible codes to make her life's decisions convinced her 'non' boyfriend to take the stand. Wow They deserve one another. Why didn't Presley stand by her man? Didn't she want to hear REALITY?

    1. "If your hearts are as loving and forgiving and merciful as mine has changed into, then I'm asking you for probation," said Dauben, who claims to have had a spiritual awakening while serving time in jail in Ellis County in Waxahachie after his conviction last year.

A man who TRULY had a spiritual awakening doesn't get out on probation and spend the summer slander, libeling and attacking his victims. Men that included Shane Crowe WHO (he claimed was me- yappy in his 'book' ) and Shane was never charged or convicted but extensively investigated and cleared. Going after Erica relentlessly was pure vengeful hatred, nothing more. Attacking the family of a murdered child claiming he knows who Ambers killer is? Even though the family begged and pleaded for him to go away? He has not changed his spots - at all. What a pile of crap.

      I agree, crocodile tears.

Did anyone see an apology in Joey's statements? I might be a tiny bit more sympathetic if Joey had named his victims, with apologies addressing the specific injuries he caused. It's not enough to say he knows he was wrong. He's been using that as an out for, what, at least 9 years?

    3. Its amazing how Joey and Presley pull out the water works, but they can't get them to jive with their actual verbal communication. Remember Presley's crying Lawless video where she looked like she was doped up on cocaine or something? Well here we have Joey crying at the wrong times. For instance, we have Joey breaking down and crying when the boy went into the details of his sexual assault but then Joey gets ups there and defiantly says the boy lied about that. Its like his emotions and his lips cant seem to sync up with each other.

      Delete
    4. And yeah yappy, if he wants to play the "spiritual awakening" while in jail card, we have 4 different manifesto's from Joey that prove not only that he didn't change, but he actually got much worse in his unfounded attacks on people.

      Delete
    5. 4 different ones? Heck I didn't even read one, people only sent me pieces of it.

      Delete
    6. Yes, 4 of them. I posted them and dissected them on the old blog. Two of them, ironicly in case you haven't had enough irony already, accuse Brandy of wanting to engage Joey in sexual activities.

    7. I don't see Joey ever standing before anyone and admitting he stuck his !@#$% in another dudes !@@ or that the reverse occurred.
I do see the contempt Joey has foe our legal system here. Sure he may make great claims and even Brannon said Joey would never be found guilty of this but the truth speaks for itself.
While at one time I would have taken a bullet for Joey I won't anymore. Joey has through his fingertips slammed the door on any friendship we had.
Joey is now the punch to any and all bad Ellis County jokes you may be able to tell.
As for any blog war Brannon has promised it didn't come to pass. I don't think we will be seeing much of him. I do wish him well and hope he can find his way past three feet of Joey.

    9. My anxiety kicked into overdrive yesterday, knowing there was a 50/50 chance Joey could get off, and I hid from the rest of the world. Upon awakening this morning, my husband delivered the news via phone that Joey is now a convicted sexual predator.

Just like his other victims, I cried, rejoiced, and am now feeling safer than I've felt in two years. Joey - you are a lying, angry, bitter SEX OFFENDER -- a child molestor and pedo who was put in his place by 12 people yesterday who saw through your bullshit. I, for one, will not only feel safer, but may just have to find the courage to write my own story now and tell the world about your reign of terror.

Ginger, Yappy, NBTDB, and most of all, Slimmy - I love you guys. Thanks for giving us a place to vent and feel supported. Guilty, guilty, guilty, guilty, GUILTY! How's it feel, Joey? How does it FEEL to have the world know you're a child rapist? Now, at least, your libelous words will be nothing more than the psychotic rant of a convicted sex offender; and I, for one, couldn't be happier!

Screw you, Joey - you earned it!

    10. I'm glad you feel better and vindicated Erica. Your story with Joey is both interesting and classic Joey. One of the main reasons I started this blog was to give Joey's victims a place to tell their story and feel like they have a chance to tell the internet world the truth vs what Joey did to them.

While I'm not celebrating the demise of Joey, I am happy to see Joey's victims feel like a huge burden has been lifted off them. I can't imagine the horror that Joey's lies has done to them. I'm sure they are nervous just leaving the house not knowing what nutcase might be out there armed with Joey's lies and slander.

@ W/blog: I look forward to reading your story. Please don't forget to let us know when you've posted it.

My kid has been an interesting victim study. Any time I tried to relay information or blog discussion about Joey during the last 2 years, the kid would just shut down, didn't want to hear a word about him. When Webb posted his report on 1/10, the kid all of a sudden couldn't get enough discussion. Once Gingersnap posted the that jury was in deliberation, I was asked for updates every 15 or 20 minutes until there was notice the punishment phase would continue on Monday.

I realize now that the kid retreated from all discussion about Joey as a way to deal with the pain he caused. When the verdict was posted, the kid wasn't happy - what I saw was vindication and relief. The realization that Karma is alive and well put a new light in my kid's eye and indeed, a burden was lifted.

      Delete
    12. "Vindication and relief." You nailed it.

While it may appear to some that we're bitter, angry enemies of Joey's who are celebrating his going to prison, that is most likely not the case. I can only speak for myself here, but you absolutely hit the nail on the head - it is vindication at knowing his words no longer have validity, and it is the peace of mind knowing he will probably never have keyboard access again. Knowing that he'll be shackled and used as a prison toy is just a bonus; maybe it's a petty form of karma from which we'll find solace.

But the bottom line is, we're all safer, and our sanity is in tact knowing that Joey Dauben can never again use his words to incite fury amongst other Internet whackjobs who believed his rants. For those are the people who -- at Joey's mandate -- felt compelled to rid the world of our "evil." People like Brannon, Presley, Babs, Vicki, Connie, etc., who felt it was their personal responsibility to come after us, when they had no idea they were being manipulated by a con artist who was desperate for the truth never to be known.

When I say I slept with a gun by my pillow, that was not an exaggeration; nor, was I the only one who felt that way. But I'm still amazed that we owe it all to one teenager who had the strength to come forward, tell his story, and fought until the bitter end to put away the almighty Yahweh, and end his madness once and for all.

No way in hell he will get probation. The door is about to slam, and slam for good. Now THAT is Texas-style justice!

"But I'm still amazed that we owe it all to one teenager who had the strength to come forward, tell his story,"

We've been so caught up in Joey's history and the legal process that I've just started to digest the profoundness of this situation. One boy, that had the courage to stand up for himself and on behalf of potential future victims, accomplished what so many adults were unable to do - shut Joey down.

I'm sorry for the boy that it's taken nearly 6 years to resolve his case. At first, I thought if only he had gotten the support he needed at the time of the event, so many other people would have been spared the pain Joey caused. But, in taking the time it took, the boy got stronger and brought the full impact of Joey's behavior to light in front of a jury. Where Joey might have been sentenced to probation if the case had been tried in '07 or '08, I have confidence what Joey has done since then will be considered in the final judgement and that will send him to prison. The only question is, for how long?

And, I agree with what yappy said on another thread. I don't think this boy was Joey's first victim. In reading about the testimony, the assault seemed too smooth. Joey has probably done this before. Also, it doesn't seem likely that Joey all of a sudden developed these urges in his mid 20's. If there are other victims, I hope what this boy has done will give the others the strength to come forward.

It's good to have the trial over, and I must say that I was surprised reading that the deliberations were so short. It's probably good, and makes me think the evidence was very convincing.

Reading the articles(thanks Webb)made me sad. That poor boy went through so much. I really didn't expect Joey to accept any responsibility or guilt. He doesn't roll that way.

I am sort of worried he will do something stupid this weekend. I hope he shows up on Monday.

On a side note, Conster got banned for 30 days, and Presley is saying it is for posting pictures of some bruises that happened when "dt raped xxxxxxx". Yappy this is a new accusation right? I don't have my notes here, but I don't remember any bruises to the back of the head being from an assault. Not in any of the ever escalating claims of abuse.

Idiot that she is, she gets a ban on one page, and then proceeds to post the same crap on the other page. Maybe she just wants a vacation?

Guess there haven't been nearly enough pies eaten, as now Bill says he wants to keep filming forever, and do it in an RV, for a weekly tv show. He says he has been discussing this with people that will pitch it to 6 to 8 networks. All she can point out are people like Oceans and myself speaking out against her story - and labels our posts as being DT.

Connie, I'm sorry but I was the one who was able to get you banned for 30 days. I took a chance the FB police would view your threats and rants for what they are. But since you claim to have hacked me, you should have known it was yappy who reported you. lol aww but I'm sure you'll keep up your lie about it being DT. It is kind of funny to see you silenced for 30 days given its my first time reporting anything on FB. BOOM

Its doubtful that's even a photo of her child and a handful of people blindly see it as evidence? Guess they've never heard about photoshop before either.

What I don't see - ever - are any doctors reports backing up all these claims of abuse or agreeing with Connie. 4 years of her screaming online and the ONLY 'national media' she's ever had was Joey, a real life child rapist. Irony

Yeah good call on that Presley, the last thing you tell Joey as you are running away like a coward, is to take the stand. And do you know why everyone says it was disastrous? Not because of what Joey was wearing, but because of the content. He said what you and your scissor sister Connie say and think all the time. That should tell you something about the unbelievably pathetic state of Presley's so called life. Unless she changes just about everything in her life, and more importantly, her reprobate head, she is doomed to end up joining her fake boyfriend someday.

  15. More importantly, it's also what he did after the conviction.

He did not own up to it.

"He said he wasn't going to admit to something he didn't do."
This could really piss off a jury bad. Especially if it was 100% obvious in the court room. If the tones, sounds, gestures of the accuser were very accurate... And if Joey was (sounded like) he was just rambling on an on. (President? I mean WHAT???)

    Joey's errors in this were:
    1) Raping a child
    2) Not taking the plea bargain
    3) Taking the stand
    4) Testifying and proclaiming innocence when he should have immensely apologized, cried for help, and promised to get psychological help, counseling, etc.
    5) Not fessing up after conviction, or at least saying that he was responsible, or at least apologizing to the teen, court, and jury afterwards.

I think his best parts of the trial is where they were talking about probation, and he said "If I held somebody in my position to my own standards, then no"... I hate saying this, but that took some balls.... Perhaps it was his only good part of the trial.

I really think though, he should have taken the plea, shut up, and became a trucker or something. Just join the registry... Drive a truck for a living. Gab/B.S. on the CB. and generally just "vanished" from everything.

I would be VERY surprised if he got less than 4 years each count. I think it will be around 20 total.

Often 1st time felons get a break.
Second time felons usually see 1/5 to 1/4 the max time.

But somewhere between 3-5 felonies real time gets added.

This is just so crazy. After that 1st felony in Ellis he should have RUN and NOT WALKED to the plea bargain.

    I'm guessing 20 years. He'll serve around 12-14.

In Texas I've noticed that the time is:

    Lighter on drug user crimes
Light to medium on property crimes

Very tough on victim crimes involving violence.
Very tough on victim crimes involving sex.

Like I said way back... I knew a guy who was BARELY over the age limit and his GF (now wife) was under the age limit.

He served a YEAR in jail for it. 1st time felon.
(It was a 3 year difference back in the early 90's) This was a 18 year old (who just turned 18) and a 15 year old who was almost 16 (by two weeks).

In Joey's case - This is a 26 year old man and a 14 year old boy. Joey is a convicted felon already. This is 4 sexual assault crimes on him. (And YES I think the gay factor will play into it a bit).

I seriously think 20 years. Joey's parents need to print joey some prison survival guides.... seriously. I don't know if Joey can make it that long.

As a convicted felon in the State of Texas myself, that did some 'hard' time in prison, I want you to print that survival guide AND read it YOURSELF.
You have flipped & flopped so many times that you have ripped the crotch outta your pants at least 8 times hopping from one side of the Joey's guilty/innocent fence in just the last 48 hours.
You are making my head hurt & my eyes are beginning to cross from your goofy repetitive posts.
Let me give you a piece of TDC advice that works well on the outside, too..."if you just don't say (post/comment) ANYTHING when you know very little (absolutely nothing) about something, you will appear VASTLY wiser than you may actually in fact be".
      Sit down.
      Back away from the keyboard.
Let someone else comment for awhile...we ALL know what you have to say, for TODAY anyway.
Be VERY thankful it is not YOU going to TDC. As a survivor of being incarcerated with the most hardened, VIOLENT criminals in the state - I can assure you that as much as you prattle on & on, you are about as much TDC material as Joey & should not be giving safety tips to his family online...well meaning as you may be.

I apologize, I just don't want JimmyS to appear on an episode of SNAPPED

    2. JimmyS:

You probably have the best of intentions.
But...You make my head hurt & my eyes are permanently going to cross IF you don't stop pushing the "online prison survival guides" that the Daubens should download & print for Joey.

As a convicted felon & real life survivor of being an inmate of TDC, let me say this as nicely as possible...hush. You watch too much LOCKUP & SCARED STRAIGHT. Like you, Joey aint got any shut up anywhere in him.

You are bound to have ripped the crotch out of your pants hopping back & forth on the Joey is innocent/guilty fence in just the past 48 hours! & at Olympic High Jump worthy warped speed, I might add.

Let me assure you, JimmyS, that everything you have ever seen, heard, read & imagined about TDC? It's minimized compared to the real prison experience. The smells alone are enough to frighten soft little Beaver Cleaver types like Joey.

Joey has already shown in court that he will cry like a little girl under pressure. That pressure in court? Tiddliwinks compared to what just THE guards are gonna dish out to Joey. He won't be able to stop sniveling by the time the 1st big, burly, tatted gang banger starts eye f*cking him like he was an all day lollipop. He will be jerked outta the county transport car upon arrival at TDC intake & made to strip outside at the gate under the rifle tower. He will perform his first squat/cough/spread ass cheeks at this moment in front of whatever guards, TDC work detail inmates & other intake inmates arriving from other counties are present. Only after that, will he be given a paper gown & taken to what TDC calls "reception" aka the dog pound, to begin the 2 week long classification process. And that's just the first couple of hours. There is NO guide, no booklet, no pep talk, no amount of prayer to really prepare Joey for what he is about encounter.

Do not misunderstand me, I'm not saying he doesn't deserve this, nor am I saying that I take any delight in knowing the ordeal that is about to begin for Joey. I have just lived through it, & reading & re-reading you blather about it is mindbending for me. Can you empathize with me, here?

Do me a favor? You download & print that online prison survival guide & read it yourself. It'll keep you occupied for at least 2 hours.

Yeah as I have said for almost two years now to all those that only know Joey from his online rants, he has two personalities. Down in gramma's basement he is a ferocious monster, feeding on anything he can get his talons on. In real life, Joey is a child. He is very weak, insecure, emotional and fragile. Yesterday on the stand everyone got the see the weak Joey. The online Joey has now been executed, and society is a better place as a result. All Joey now has is his real self, and his real self is not what you would want headed to prison.

    5. Thank you for that post Slim, I was beyond tired of hearing about online guides for prison survival! There is no way to prepare Joey(or anyone else who hasn't been there) for the experience.

Maybe Joey can use those writing skills and raw talent Webby sees in him to write a book about it.

Like everyone else, I am not happy he will suffer in prison, but just relieved he is silent and unable to torture anyone else. He is a convicted criminal.

I do wonder what all his previous supporters and fans think of him now though.

They talked of men who have their top teeth beat out so that they can give oral without the fear of bite. They talk it being 90% about race. They talk of it being that you better never let anybody treat you like a bitch, or you'll be one.

  17. BIG difference Jimmy S. between a couple who subsequently married after their "allegedly" consensual relationship and CHILD RAPE!

You said "Like I said way back... I knew a guy who was BARELY over the age limit and his GF (now wife) was under the age limit."

I also "knew a guy" way back when too, a few of them in the 80's-90's that were called out on by usually the gf's parents who apparently, for reasons that should be known to everyone in polite society---a relationship between a 18 and 15 year old's is illegal---which there are reasons for these laws.

  18. So it took a jury less than a hour to convict him in Ellis county and then this jury took only 2 hours to get him on all 4 counts. Then it looks like Joey gets up their for an encore in his sentencing phase and convicts himself without the da having to say a word. Joey says he takes responsibility but he didn't do it. Then he starts crying and telling the jury about all the evil child predators he discovered and no one will do anything about it. I can just see the jurors smirking at that point thinking "don't worry, we will do something about the evil you have seen".

    1. That was very bizarre.. I was thinking the same thing.

The evil predators like the Red Oak guy. Or the evil predators that take poor confused children to the shower and fully molest them.

I sort of wonder if he wanted jail....

    3. Jimmmy, I think your experience on this website will help you grow as a person. You might start seeing the world as much more complex and nuanced one than what you originally thought. In that way, I hope you are able to take what you learned from here and grow as an individual. Truth is black and white, but the world we live in is gray, the sooner you learn that the better.

      Delete
    4. Blah never mind. Thought I read of him accusing some guy in Red Oak of molesting and had to recant after the man's name was ruined.

This all has been a huge awakening about Joey for me. I had no idea. I just knew him to have a knack for going against government corruption. Like I said, I really knew him mostly YEARS back when he worked for the Ellis County Press.

I guess not knowing all this time exactly what was going on, kind of made me defensive for him. It's hard to break the "clean cut" aspiring conservative image I thought he was, and his aspiring reporting -- and change into a monstrous child molester that tugged at the heart strings of Amber Haggerman's family and destroyed many names falsely.

In 2002-2004, Joey was different... Or at least the Joey I knew.

I have to admit in all seriousness that I wonder "why??".

    5. OMG Jimmy, that's why Joey was CONVICTED in Ellis County. He lied about the guy. The guys' ex-wife is also facing charges for false accusations. See, here's a prime example to the damage Joey has done to yet another innocent man/ person in the world.

    7. Jimmy,Dauben didn't "want jail", he thought the rules don't apply to him and he is smarter than everyone else. Just like his rants about government and how he had been responsible for exposing corruption, he figured he was articulate and intelligent enough to convince the jury his tale.

It seemed he spent a majority of his life trying to make a name for himself to show his dad he made something of himself. I also think that a possibly reason for him to testify was again to show his dad how he a"man" and deny ever doing anything like this until the very end. However, the jury didn't let Joey carry on the charade any longer to his father. Anyone ever notice how he always seemed to talk about his dad in the past tense in his radio shows? I thought his father passed away whenever i heard him speak about his dad. His ego and his desire to show his dad he was finally somebody were the reasons he couldn't take a plea bargain. What would he have told his dad if he took the deal and accepted being a life time registered sexual predator? He didn't have to tell his dad, the jury did.

      Delete
    8. Yeah his dad is probably the most responsible person other than Joey for the situation he is in. No other person in this world fed Joey's inner beast like his dad did, and still does.

      Delete
    9. Case in point, his boy is about to go to prison tomorrow and what is Daddy Dauben talking about on his FB page? A link between a drug and these people that do school shootings and the conspiracy behind it.

Again I will say the second biggest mistake Cheri made in her life (the first of course was marrying him) was not going through with that divorce. If she had, maybe things would have been different. People like him who suffer from severe mental retardation should not be a parent, its just cruel to the child.

      Delete
    10. Ginger Snap,

Respectfully, I both agree with your point and disagree.

There comes a point in people's lives where they have to pick up the reigns for themselves... There's just a realization... If his parents enabled him, he was old enough to see his peers, and other people near his age getting married, moving out, etc.

He lived apparently as a transient. I contacted somebody who knew him in out in Ellis last night, and apparently lived in with somebody in Palmer too...

Parents & childhood, sure they have influence.

Despite the conspiracy and stuff his dad could have placed in him, I'm sure he didn't place child rape in him.

If he taught him in some funky way to prey on the weak, Joey could have easily went after a "not so determined" spouse to boss around. (not that I advocate it). If Daddy Dauben did this with his wife, then that's their business. Joey could have done the same. There are MANY women out there who are desperate just for somebody to love and stay with them. If Joey wanted, he could have had a spouse, ruled the roost, and been a member of society (I assume) like Daddy. His daddy though owns a home, and has been a productive member of society.

Instead Joey raped a young child.... Not just any rape, but GAY rape. I know many people don't think it matters (and it really doesn't entirely) however, man on female rape doesn't cause confusion of sexual orientation. Here we have a man who is gay raping and confusing a boy.

I just can't blame daddy for that. He was 26, well old enough to have taken up his own reigns - despite how he was raised.

  19. What I am looking at is if it gets consecutive or congruent? If he gets say 20 years on each count and serves it congruent then he is eligible for parole in five years. If he gets that same sentence to be served consecutive then he wont be eligible for parole for 20 years. He will have to serve one quarter of the total sentence.

    ReplyDelete
    Replies
    1. I could be wrong, but I believe that these are considered aggravated charges & that means 80% of the sentence must be served before the offender is eligible for parole. Concurrent means the sentences will run all at the same time. Stacked means each sentence will have to be served & then time on the next sentence begins....

      Anyone else?

      Slimmy

    2. yeah he could be looking at 80 years in prison which is life for him, which I think is crazy. I mean we are not talking about a guy that killed someone, I would think he deserves a good 10-12 legit years and then try and assimilate to whatever the world is at that point.

I'm glad Joey's internet life is over, but I hope he has a chance at starting a real life once he gets out of prison. Presley are you listening? This goes for you too, I hope your internet life ends and you start a real life from not on.

      Delete
    3. Even if he gets 5 years each count, and had to serve 80%, it's 16 years.

I have a bad feeling this could go for a long time. Especially by his words at the end. It's like he buried himself deeper and deeper.

The only honorable thing he said was "I would have not been merciful to people in my paper in my situation", and went ahead and asked for probation.

But THEN like your above post said, he goes on and talks about OTHER molesters and how they never get punished.... WOW.

      Delete
    4. Prosecution asked for his sentences to be stacked, consecutive, running one after the other.

There's NO way Joey will be getting probation. That jury was in there for 2 hours. MINUS the 45 minutes it usually takes to fill out all the forms required, they deliberated at best for 30 minutes. THAT type of jury will not be giving Joey prob. or a couple years. He IS facing hard time. Joey's own outrageous arrogance coupled with his parents inability to convince their monster to take a plea are the reason he will be 'suffering' for some time to come.

For an entire year online we've been pointing out the almost perfect record of conviction rate with the Texas Rangers. Joey's parents admit to reading everything that is online, they've seen it time and again yet refused to find a way to convince "Mr I'm going to be President one day"... to take the plea with no time served?

A few bricks short of a full load; lights are on & no one is home; few cards short of a deck, a few screws short of a hardware store, not the sharpest knife in the drawer, about as sharp as a marble, a burger short of a combo meal, elevator doesn't go to the top floor, a few beers short of a six pack, one twist short of a slinky - THE MAN forgot to pay his brain bill!!!

    5. Here is the way I look at it Jimmy, I have deep sympathy for people who suffer great calamity through no fault of their own. I really do. Joey, someone who I think I know better even personally than you, chose the calamity that awaits him. He was given a choice every step of the way and he chose the wrong path. So knowing that, I feel less sympathy than I would someone who never had those choices.

      Delete
    6. And yeah yappy, that's my problem with Daddy and Mommy Dauben. I know they love their boy. I know they are both suffering deeply right now, but BOTH of them had an opportunity to step in even at the very end and mitigate this situation yet they chose to keep their heads in the sand, and not only that, Mommy even chose to take the stand and continue the fairy tale that is Joey Dauben right to the bitter end.

    7. Donated his brain to science before he was done with it & eats his soup with a fork.

Ginger mentions martyr and I have no doubt that's what Joey wanted to become. To be a martyr, you have to have a following. His own fiancee that spoke about having children with him a couple months ago is too busy on FB crying how Connie was banned from 1 of her FB pages, hasn't uttered a word about her now convicted child raping boyfriend. Theres' no one out there ranting or calling for this crazed conspiracy baloney Ellis county political establishments heads, or rallying for justice for Joey.
      *crickets*.

I wonder if he ever received that $200 that Vickster raised for him a year back? That would come in handy for his new canteen budget....

    8. So I am a little rusty on what the prison sentences are for this crime. Yes he should have taken the plea. Yes he should have not said a word in his defense. Joey defeated himself.
Now all that is left is for the time to be announced. I wonder if they will give give Joey credit for the time he served in County lockup?

      Delete
    9. I think they will give him credit for time already served, but how excited can you get about that when you get, say a 15 year sentence?

      Delete
    10. Yeah but a martyr for what?
"The wrongly accused child molester martyr".

So those he wrongly accused were no martyrs even though they lost their names.

But a real child rapist becomes a martyr.

If I was a shrink, I'd say his entire reporting career against all those he accused of molesting (falsely), was his own guilty conscience coming forth.

If that is correct, then it is incredibly creepy to consider his fascination and accusation against "Amber's Killer". I just keep asking myself "why on Earth would anybody get involved and tug at their hearts like that"?

      Delete
    16. Yappy, you misunderstood what I posted.

      Read it again.

I did not call the guy in Red Oak Evil. I said he was "evil" from what Joey made him out to be. Quotes. I said Joey ruined his name and recanted later.... I did not know that's what led to his Ellis Felony. I haven't been paying attention.

I also did not say he was falsely accused. I said "I can't imagine Joey doing something like that".

I also said that I knew Joey mostly in his ECP (not ECO) years. When he worked for the actual newspaper. He was a good aspiring reporter then. Good with words. Very conservative (so it seemed).

Imagine knowing somebody that seemed this way THEN the next things you hear (wow) -
      he raped a child
he blamed others for child molestation when he did it
his girlfriend was molested and has two last names
his girlfriends friends were all molested and their children
then you see a video on "daddy's worm"

Then you find out he went after Amber Haggerman's family (probably in fascination) and bugged them so bad they had to repeatedly tell him to stop!!!

So yeah, I was kind of defensive, especially at first. It was like what-the-heck...

Then he goes to trial, (after I know this info) and somebody I know says the accuser also threatened o accuse Bruce H. of molestation.

I DID NOT defend Joey then. I said I thought it would get thrown out and that I was not saying Joey DID NOT do it.

However I did say that the accuser threatened BRUCE to lie on him, which I still believe Bruce. I do believe the accuser did this.

I also believe Joey DID rape the child, and that Bruce was threatened probably for affiliation.

I ALSO re-canted, and ate crow about being wrong on the outcome of the trial.

Yappy take a chill pill. Look Yappy, my life is not all about Joey. I'm learning stuff as I go. I am not against you or anybody else on the blog. I disagree with stuff, attack when attacked, but I'm "learning". It is bizarre. Much I have to read twice just to make sure I did not read it wrong. Chill.

Even before that if he had any character at all he never would have allowed himself to be placed in the situation that got him convicted in the first place.
Financial bankruptcy was not his only flaw. Morally bankrupt as well. One question I have is why did Joey not confiscate the alcohol to begin with and simply walk away? Better yet why did he not inform the parents? The answers are found in the Bankrupt statements above.

@ Curtis: you make some good points. re: the alcohol - I doubt that Joey bringing it to the attention of the parents would have made any difference. According to testimony, the adults were drinking heavily. It was the adults that brought alcohol to a CHURCH outing. They left out the entire purpose of the camping trip - to celebrate and worship God. This camping trip appears to be just an excuse to get drunk in a park with other drunks.

Also, I recall this was not the first account of Joey drinking with kids. It's interesting that Joey seems to identify more with adolescents then he does with adults or with his peers.

      Delete
    6. Yeah that brings up another aspect of this....Joey's fake religion. Showing up at night, drinking with some boys, raping one of them, and then going to bed and leaving first thing in the morning. This is how Joey practiced his religion.

Joey, like Conster and Presley, all use religion as a tool to give them unquestioned authority over something. None of them are any more a real Christian than Charles Darwin. But they use it to beat everyone over the head with it and claim authority. I guess for slackers in life this was the only way the could even pretend they know what they are talking about. Its not like any of them could ever speak of something in a professional way (meaning they have a degree and specific skills and experience to qualify them to speak as an authority on a subject)

    7. Wait, I might need to take that back in terms of IBedwell. She can probably speak as an authority in performing sex acts on strangers. I do have to give her that one.

Another thing about the outing - I do think the boy's dad was negligent, which created the opportunity for Joey. The only suggestion that Joey was a counselor came from the victim - the boy thought Joey had standing in the congregation. The Church denied Joey was a counselor. In testimony Joey said he wasn't supervising the teenagers.

Child molestation is a crime of opportunity but it's not the only bad thing that could have happened that night. What parent in their right mind gets drunk, goes to bed and leaves a kid alone with a man (or woman) the parent doesn't know????

      Delete
    11. Once I learned about the alcohol I started to rethink this whole thing. Then to learn that Joey was on the boat with the victim changed my mind about Joeys innocence.
I doubt that Joey would ever accept his actions as anything other than right in his mind. By his actions I mean in the trial and just before he was arrested. Maybe what has happened with all of this will make Joey more responsible in the future (IF HE SURVIVES HIS PRISON SENTENCE) But as soon as he can play internet tough guy again he will be right back to the same old Joey.

    12. Not being there, it is hard to judge where the alcohol came from but just from seeing Dauben's discussions about alcohol consumption and his embarrassing display on the Hagerman girls birthday, I'd be more inclined to think it came he brought it.

"But as soon as he can play internet tough guy again he will be right back to the same old Joey."

Exactly. So, which part of all this do you expect will cause Joey to become "more responsible"? Joey has a long, well documented history of doing the wrong thing, admitting he was wrong when he's caught, then doing it all over again without reservation or hesitation - and NEVER an apology.

    14. ^^^See what I mean Yappy. With Mr. Butler. We probably BOTH knew Joey at a different time. Ellis County PRESS. The Joey I knew then I couldn't have imagined raping a child.

It's a tough pill to swallow. Before I knew all this "other crap", I knew Joey as an inspiring Journalist, activist, and actually "clean cut". Seemed a straight shooter, who had a girlfriend.

It's easy to be more skeptical if you knew Joey then.

But obviously now, it's all over. It's like a punch in the gut...
It's like Ace Ventura learning the female cop was really a man... The crying game. You wonder "how the heck did I affiliate....".

Anyway, I am not alone in the shock.

I still believe Bruce, but was wrong about the trial outcome...

      Delete
    15. Also as a note on Butler's comment & the prosecution.

It is NOT the responsibility of Joey to take away the alcohol. The adult in the area is not responsible for other people's children. I do not think it was Joey's job to take the alcohol from the teen. Taking the alcohol can constitute theft believe it or not.

However, as an adult, I do believe in that situation the adult should alert the teens parents. If parents are NOT available, the adult should absolutely make it clear the teen should not be drinking AND remove themselves from the situation.

The prosecution made it sound like Joey was "in charge" of the teen drinking. If Joey supplied the alcohol, of course, then he was responsible for sure.

But if the kid really did steal his dad's booze, then Joey arriving on the scene was not responsible to take it away.

But in either case, he hung out with the drinking teen. Went in the boat (this looks really bad). Then raped the poor kid.

      Delete
    16. In the scenario described in court, my belief is that it WAS Joey's responsibility to take away the alcohol. Why? Because he was a youth counselor tasked with the responsibility of supervising the teens. Teachers take alcohol from kids at school, at school dances, etc., because they are tasked with the responsibility of supervision.

Now, it would have also made sense for him to alert the teens parent(s); but minus that option, he would have been well within his rights to confiscate that booze and turn it over to the pastor. If a teen violates a rule while at camp, they become subject to having the material item taken away; this isn't rocket science.

      Delete
    17. Joey was 26. Logic dictates that the adult discovering the minors in possession do something about it. Joey was the first adult to discover the drinking (Joey's testimony) and instead of removing the alcohol and himself from the situation he sat down and had a swig (his testimony also).
Joey decided to do the wrong thing from the word go. His decisions lead to his conviction. It was a poor decision but Joey has a difficult time figuring out the right one.
Granted the parents were drinking but that is no excuse to allow your kids to drink or not have another member of you camping party inform you that your child is drinking. Personally I would have taken the bottle and marched the kids back to their parents. any responsible adult would have.

      Delete
    18. I find this conversation very odd. Joey was / IS a sexual predator. he was purposely using alcohol to lower the inhibitions in the teen in order to rape him. He methodically did this in a calculated way which tells me it was not his first time at bat - so to speak. Why are you focusing on Joey doing the morally responsible thing? Predators do not think like you're thinking in terms of what the appropriate thing to have done in this circumstance.

Its not like Joey was actually going to go to the parents in the first place. He showed up probably in hopes he could find a teen to rape. Predators like him seek out opportunity all the time. Frankly its the PARENTS responsibility to supervise their teens, NOT assuming there won't be any evil people stalking them.

My son is never allowed to go on hockey road trips without one of us being with him. It will remain like this until he's 18. I don't know who the sicko's are in the world so its my job to protect him from potential creeps that may try and pull the same stuff.

@ Jimmy: it's not like child molesters hang a sign around their necks so their friends will know that they do when nobody is around. My kid has known Joey and 1 sister since 1994 and was as surprised as everybody else by the charges.

As regards the alcohol - you are missing the point, again. Who supplied it doesn't matter. It's a fact: JOEY WAS DRINKING WITH A MINOR. I'd be willing to bet your next pay check the only reason Joey wasn't charged with contributing to delinquency is because there is too much s/he said and no proof about the source.

      Delete
    20. I am merely pointing out what Joey said in his testimony. I am not saying anything to defend him. I am showing that what Joey wanted the jury to see was a lack of good judgement. What he ended up giving them was insight to a child predator.

@ yappy: I'm with you. I didn't take my eyes off the kids until after 18, for the same reasons - too many sickos and unsupervised teens. I was called the meanest, most overprotective parent in the world while the kids were young. Even some other parents thought the same of me. Now, the kids thank me. And the parents that were critical, their kids didn't turn out so well. Those same parents today say I did the right thing and they wished they would have followed my example.

    22. Yes, I'm just hypothetically saying that the prosecutor seemed to imply that Joey would have been responsible or in charge because he was the adult near teens drinking. I disagree. He should in courtesy tell the parents.

HOWEVER, it really doesn't matter in this case.

I'm just saying that if any random adult walks into a situation with teens drinking, they automatically are not in charge or responsible for the teens actions.

Agreed, never take your eyes off your children. They are your responsibility. If the accuser's father had been watching well, none of this may of happened. OF COURSE, it is not the father's fault, but his son could have been spared misery.

Joey never figured out how to know which outcome he was seeking.

And that is one of the many reasons why this whole situation is sickening: because the focus continues to remain on poor Joey and his losses, instead of a child who endured hell, stood up to fight for his rights, and ended up taking down a madman in the process. That's what we should be highlighting.

As for the victim, I am choosing not to make him relive what happened to him every day. I am instead focusing on what will happen to Joey as a result. I agree the victim should be applauded but with all of the Joey abuse he has suffered physically and emotionally I am choosing not to mention much of him.
Joey has a world built around himself that is now cracking faster than an egg ready to be fried. That world is the internet. For the Courts to force him to remove the world is what caused him, in part, to break emotionally at his trial.
Joey didn't cry because he was remorseful. Joey didn't cry because he hurt this teen, Joey cried because he was going to be forced to live in a world that will be very different from the world he lived in.
This teen, now a man, has faced his ultimate evil. Defeated it and wants to be left in peace. I cant give him back his teen years but I can leave him in peace.

    5. Ginger I think it more to the point that his world shattered before his very eyes. Joey never cared about this teen. His only concern was that this teen has just destroyed Joeys world. Proof of that existed in Joeys hit piece against him.
Joey got what he wanted from people or he slandered them relentlessly. The proof of Joeys insanity exist in the pages of his internet published book. I call it "John Margetis: The Second Coming Of Stupid"

Here's support for Gingersnap's assertion that Daddy Dauben is the root of all conspiracy theories.

On his FB page he's posted an article about the death of John Noveske in a one car accident. The accident is called "mysterious" and a link was made between the accident and a FB post by Noveske several days before his death. The FB post lists alot of teenage shooters and points out that they were taking anti depressants or anti psych drugs.

    1) Go figure, the shooters were troubled kids. How is that a conspiracy?

    2) According to Oregon St. Police - Noveske failed to negotiate a right curve in the road, crossed over the left lane, hit two boulders, the car rolled, Noveske was ejected. So, no mystery there: Noveske was probably texting or looking down and obviously was not wearing a seat belt.

    1. Yeah I need to clarify something, when I say I hold Daddy and Mommy Dauben responsible I don't mean that to apply to Joey raping the young boy. I know they are vomiting at the very thought of that and had nothing to do with that desire inside Joey's warped brain.

I do hold them accountable for Joey's world view, his never taking responsibly or accountability for his actions, his arrogant self righteous demeanor. And as we all know, Joey could probably do another 15-20 years in prison for crimes he hasn't been charged with relating to his slandering of others. He finally got popped for one of them, but he could have easily had like 10 other felonies on him for the same thing. That's why this website exists, that's where many of the posters who complain about Joey are coming from.
