David Webb's Biased Coverage of Joey Dauben, a Systematic Review

David Webb, who has now added "asshole" to his list of insults to readers of this site, says his coverage of Joey has been fair and professional, while I say he was biased.  Well lets don't just take my word for it, lets take his as we review all that he wrote about this in a chronological order.


The Beginning
The connection between Joey and David emerged before Joey was jailed.

So over at the Dallas Voice, David latches on to this story that Joey had been after for a while, going after the mayor of the barely a community Seven Points for hiring his partner to a police position.  They take down the mayor and then Joey appears to become David's main source for news in his next article.


David uses emails from tea party members to Joey to form the basis of this story which became a non-story as it never amounted to anything.  What we can clearly see emerging here is a little cabal where Joey goes out and makes the news while his buddy David runs the story under the guise of a legitimate news outlet.  Joey's entire adult life has been dedicated to forming these kinds of unholy alliances so there is no doubt about his intentions on this, one can only speculate as to if David really knew what he was getting himself into here.

The Arrest
After enjoying some moderate success with his first two stories with Joey, David then see's Joey arrested on the horrific charges of child molestation.  He was no doubt in shock as he didn't even cover the original arrest.  Not until after he had some time to go over everything with Joey did he decide to put his foot back into the Joey mess with this story:  This is where David decides to start drinking the conspiracy kool aid:


Now again keep in mind that the Daily Light reported that the reason Joey didn't have a public defender was because he never signed the form, something David was unable to find in his "investigation".  Instead, David tries to twist a conversation he has with the court coordinator into some kind of sinister conspiracy to keep Joey from representation.
"Melissa Butler, court coordinator for Judge Lagomarsino, said today that Dauben has been appointed an attorney. “I don’t know who you heard that from, but he has been appointed an attorney,” she said. When asked when the appointment occurred, she admitted that it had just been done Monday. She noted the request had just been filed recently. When advised that Dauben claimed he had filled one out in December, she had no explanation for why it had not been received by the judge. “It did not make it to District Court,” Bulter said. “I don’t know who he filled it out with, but the judge didn’t see it until yesterday.”
Butler said Corsicana attorney Steve Keathley had been appointed to his case, but a call to the attorney’s office revealed yet another surprise. At first, a member of Keathley’s staff said the attorney had refused the appointment. When asked for details, she revised her statement to say the appointment was never received. Finally, she transferred the call to another member of Keathley’s staff who said, “You’ll have to call the court. We decided we couldn’t handle the case” and quickly hung up when asked for her identity.
A follow-up call to the judge’s office failed to get anyone to answer the phone. A message left on voice mail has so far not been returned."
That story, the wording, the way he slants the answers and the lack of full evidence would lead the average reader to believe that Joey was a victim here of official oppression.  The rest of the article is a puff piece sounding like Joey wrote it himself.
Then we have this article:
Its pretty fair in its coverage but the headline is meant to sway.  
Then we get this story/non-story:
Here, Joey is going after the Justice of the Peace in Navarro for her threatening to throw away the key if inmates keep requesting a court appointed attorney.  This if a feeder article into the original one of Joey not being granted a court appointed attorney.  The conspiracy runs even deeper, again this entire article is fed solely on the words of Joey to David.
Then we get this article:
Another interesting headline, but the content of the story is astounding.  David still can't seem to comprehend that Joey is just a blogger and even though its clearly spelled out by the State in the charges against him, David doesn't even mention that fact.  Instead, he continues his conspiracy agenda.
"The case is odd because journalists charged with crimes in connection with their reports usually are working in foreign countries, not within U.S. boundaries. Civil lawsuits typically are the route disgruntled subjects of media reports take when they seek remedies, but in Dauben’s case the Red Oak Police Department filed criminal charges."
Whats really odd is how someone with his credentials failed to do even a basic investigation of what Joey was being charged with and why.  At no point in time, throughout this entire article did David get any other information other than what came from Joey either in the form of a letter he received or in quotes.  He, once again, let Joey write the article for him.
Here we have another story written straight out of team Joey.  Nothing from Wilson, Carroll, or the officers that did the investigation.  No reference to the incitement charges, just Joey talking about them criminalizing a civil case.
Then David gets subpeanoed in the Navarro case for being Joey's mouth piece.
Its at this point that Webb is no longer working for the Dallas Voice and we must follow his remaining coverage at just his blog The Rare Reporter.
Conclusion
David and Joey started a little media alliance where Joey could filter all the news he creates into a controlled media outlet in David.  Then Joey is arrested and eventually David signs on to become his mouthpiece for him while he is in jail.  David ignores all of his journalistic standards and begins writing the narrative that there is a conspiracy against Joey by the powers that be both in Ellis and Navarro Counties.  This is especially evident in his lack of reporting from the other side on those charges.  David's bias gets him canned at the Dallas Voice and now he has to finish his career trying to make something out of being a blogger.  I really wouldn't have seen this connection if David hadn't been so insistent on us looking into his connections with Joey.  They were always out there as clear as day, I just guess with everything else going on we didn't bother to check but thanks to David we now can see it.

  1. David cannot see his own bias because it's so deeply engrained in him. If you dare to utter a couple of few key phrases, he will make his opinion & never engage his brain again. Yappy said something last night that hit on a point that I was already thinking about. Yappy mentioned projection. David sees his own anger in everybody else. He assumes that he's been prejudged, and he is so obsessed with his own reality that he can't even begin to understand another perspective. I'd been thinking that if any psychologist read the comments on this blog, they'd find David to be the least well adjusted. Ginger has obviously gotten angry with David, but turns that into postings and comments that actually illustrate the grounds for his opinions. Yappy also gives well thought out arguments, but they are heavily seasoned with sarcasm. Yappy pokes because she's giving David the opportunity to show his true colors. NBTDT is generally always well behaved, even when things get heated.In the end, David stands out with anger, resentment, and self esteem issues. David is constantly defending his education and his career. I have a feeling he does this often even outside this blog. Right now, as he reads this, the dialog in his head is singing, "I know you are, but what am I? I know you are but what am I? At least I use my name when I post. I'm a journalist. I have 30 years experience. Neener Neener Neener." I bet David was really well liked in school.

    1. Yeah I think my anger at David isn't so much his support of Joey, or his poorly articulated positions, its his constant victim card. Its people like that who make the world a less enjoyable place to live. You mentioned school, we can all remember those kids that were the tattle tale crowds, the ones that screamed to the principal if you even cracked a harmless joke. They grow up but the keep that behaviour. They are whiners, complainers. And while the principal is no longer in authority, they go to the police or the ACLU on speed dial.

      Anyway, if there is one thing I want people to take away from this post its that in the entirety of all of David's articles on Joey, while constantly quoting Joey even using him to argue the other side and putting in Presley and Shelby's quotes, not once does David take the time to get the perspective of the other side. Not one single quote or press release from Wilson, Thompson (navarro DA), Texas Ranger Bobo, or the Red Oak detective working the Ellis case. Not only that, he didn't even try to get their point of view. The evidence of his bias is irrefutable.

    2. and I realize those guys are not going to go off on a tangent like Joey about conspiracies and what not, and they may not even comment on the case but at the very least you could get hard evidence straight from the source. When you read all of David's stories its like the hard evidence comes through what Joey says it was. We all read the long detailed affidavits describing what law Joey broke, when, why and why he was not a journalist. At the very least you could cite that in between being Joey's personal stenographer

    3. Any of the "criticism" of Joey that he addresses is done so very "delicately." It's thrown in there to give the appearance of objective reporting. When you see them all together, it is obvious that it wasn't a single oversight or time crunch that kept him from getting any comments outside of Joey supporters.

      His continued use of the word journalist to describe Joey is especially telling. I really really take issue with him saying Joey issued an apology and a retraction. Did he read the apology & retraction? He says he's responsible in one sentence but then shifts sole responsibility to his informant. He basically says he'd do it all again when he says that nobody gets it right all the time. I'd hardly consider that a heart-felt remorseful apology. And, from the documents we've all seen, Joey didn't do anything to offer a personal apology to the guy, not a handwritten letter, not a phone call . . nothing, just an open letter published on his little blog - after being contacted by an attorney. I wouldn't have accepted that "apology" either. Mr. Webb further shows his bias in reporting that Joey issued an apology. . . like that should have erased all transgressions.

    4. yeah his criticism of Joey in print is simply that Joey is a muckraker, a term Joey is fond of actually. Wilson made a point to the jury that Joey never once apologized in person to his victim, either by phone, letter or even email (and its not like he didn't know where he lived). His "apology" was like you stated a opening sentence amounting to I screwed up and I'm sorry. Then on to blaming the source and calling her all kinds of names and threatening her.

  2. Exactly! Webby's sources are Joey and those revolving around him. That is not journalism. You might as well almost call it plagiarism by proxy. Was Webby canned at Dallas Voice or did he resign aka retire?

    1. I dont know, but he was covering the Joey case fast and furious for the Dallas Voice and once he was subpoenaed in the Navarro case that was the end of his coverage there, his blog and cedarcreeklake.com where his only outlets after that.

  3. After the gag order hearing at which I was subpoenaed Dauben promised his attorney he would quit sending out press releases and contacting reporters. The Ennis newspaper also covered that story. That's why the stories basically stopped until bail was revoked and there was a trial. I was not "canned" at the Dallas Voice. I was writing columns for a number of publications around the country, and I decided it was time to quit doing that as I was planning extensive travel in the summer in Europe. I am retired at this point and receiving Social Security checks. As you have previously noted, I am old. Your speculation about an alliance between Dauben and I is wild to say the least. Talk about a conspiracy theory. There is just one more story to be written by me about Dauben, and that will be the conclusion of his trial in Navarro County. My blog is pretty much inactive now by my choice

    1. Maybe you are right, those parts were just simple speculation on my part based on the sequencing of events, but then again you can't prove you are right either.
      But what about the main point? The clear bias you show by only quoting and bringing one side of the story?

    2. The other side was the allegations against Dauben presented by law enforcement agencies. Dauben's side was his response to those allegations.

    3. yes and those allegations became charges, and they are written with details backed up by factual evidence. For instance, the charges were that Joey was not a journalist and therefore the rules related to free press do not apply. Wouldn't that have been some pertinent information readers should know while you go on and on about how rare it is for reporters to be charged with this? You dont have to agree with their contention but to overlook that would be journalistic malpractice

I don't think that issue came up until Dauben finally got a court-appointed attorney in Ellis County, and the DA said in the asset forfeiture case that First Amendment rights don't apply in forfeiture cases. I included that assertion by Wilson in the story. The first I heard about the question of whether a blogger is a journalist came up in the Navarro County hearing when the DA asked me to outline my credentials. It was at that time I learned the DA was rejecting Dauben's lawyers' free speech argument. I don't think I wrote anything else about the Ellis County case until his trial. I refer to him a blogger and a website publisher, and I note that his case illustrates how much trouble a blogger can get into if they don't practice accepted professional journalism standards. I always do, and I guess the fact that I never got sued by anyone for libel is reflective of that.

      With the advent of newspapers creating websites blogging became a part of the profession. Newspapers are going to blogs only eventually. That's already started so its just a matter of time. They would already have done it if they could get the advertising bucks they need off of website publishing only.

      I think perhaps you are also not aware that my pieces I wrote for the Dallas Voice and other publications nationwide appeared as opinion pieces. Most of my stories for the last couple of years or more appeared on the Viewpoints Page, which is the editorial page. I used to be an investigative reporter, but I quit doing that when I retired from full-time employment. It was then I started column writing and became known as an opinion writer. I did write a couple of cover stories for the Dallas Voice early this year because I was asked to do it by the editor.

    5. Now you are really confusing things. Joey "finally" got a public defender in the Navarro Case, not the Ellis case. Now Joey raised the issue in the Navarro case related to his bond restrictions as he was not allowed to access the net. Joey claimed that he derived his livelihood from this but it was denied as documents showed that was not true.

      Ellis County case is entirely different. You have the actual charges which we read all the search warrants and affidavits that clearly and systematically showed that Joey was not a journalist. The simple definition is if you derive I think its like 75% of your total income from it, you are one (regardless of blogs or newspapers). Joey had no traceable income so this would not apply. The Ellis county case is pretty clear in that they knew he would argue the journalist shield rule.       Fundamentally not true, bloggers are not required to practice the accepted standards. Joey broke the law, the same law that applies to you me or anyone with a heartbeat. Joey tried to claim the journalism shield as his defense of breaking the law but that is where the blogger claim comes in. Part of the reason Joey went down hard and fast in the Ellis trial is he never really understood the nature of the charges against him and you still seem confused about this as well.

    6. If Joey had followed professional standards he would not have gotten in trouble in Ellis County. there was a long delay in the filing of charges in Ellis County. It happened after the Navarro County charges were filed. He knew it was going to happen, I gather, but he didn't get an attorney for some time, which is why I said finally. I don't understand how fraudulent use of identifying information applies. I could see it easily if the charge was intimidation, harassment or threats. Dauben didn't steal someone's identity. He didn't pretend to be somebody else. What was the fraud committed. You're right. I don't understand it.

David, Joey refused to get counsel because a scam artist named farris convinced his daddy SHE was not only going to bail him out but also pay for a 'CPS" attorney of all things from Sugarland Texas. There is a livestream clip with her speaking directly to David Dauben where she's dictating to him NOT to get a public defender and Dauben was agreeing with her because HE believed her sick lying scum ass.

      Joey HAD no professional standards to follow Webby because he's not a journalist. Note: Joey does NOT have the credentials you have. No education. No degree.

      Measuring how you approach this, any 9 yr old could be a journalist too. Ridiculous. Of all people, I'd think bloggers calling themselves journalists would be highly defensive to those (YOU) who had to work hard to obtain the degree and then start from the bottom up.

      There's another side to Joey's case(s), his VICTIMS. you completely ignore them. Why? I don't understand that one bit.

    How the hell do you expect to get a public defender appointed before the actual charges are filed? I mean sure, if you were going to get your own guy you would, but you can't get a public defender until you are actually charged (unless I'm in some weird universe I dont know about).

    Fraudulent use of Identifying information: A person commits an offense if the person obtains, possesses, transfers, or uses identifying information of another
    person without the other person's consent and with intent to harm or
    defraud another.
    Usually, as you mentioned, this is used when someone steals a credit card or something but notice the wording "harm or defraud another". Thats where Joey's little bit about saying he should die if he did it plays in. Now thats a judgment call, and thats why we have juries. As I said on my old blog, if Joey made an honest mistake and a true apology once he realized his error, no jury would have interpreted it that way. But since we are talking about Joey, who not only didn't really apologize, but he continued to commit similar offenses well after this first came up, left the jury with no other possible interpretation but the one they rendered.

  5. At this point my plan is to leave all of this up to our legal system to sort out. However that turns out I will accept. I plan to write a story about whether he is convicted or not, and what sentence he gets if convicted. In other words, I just want to wrap it all up and go on to more pleasant experiences. That was a large part of why I quit writing my columns, I'm tired of controversy. I'm too old for it.

      Ahhh, I think I can give you that one on the Navarro charges but I can't in the Ellis charges. Please direct me to the article where you fully explained the charges. All I ever read was fraudulent use of identifying information, but you never really explained that charge. Then you further confuse the charge by going back to the 1st amendment issue.

      Coming on here with an axe to grind isn't a great way of avoiding controversy.

      Dauben also allegedly threatened the man with violence on his website, according to an indictment returned by an Ellis County grand jury in January."

      You went pretty close to explaining everything. Still though, it would have been nice to cite the actual language in the penal code that Joey was being charged with so that when you let Joey take into conspiracy land, at least the readers would have the code to look at and compare with what Joey was preaching.

    4. ahhh, its prolly not Shelby, no one is more direct than Shelby. The verbiage would make me think its connie (especially the lightning and lesbian references) but I think connie has too many other slander campaigns going on to waste time with our site. Thats why it leads me back to presley herself. This is all probably part of a little game of theirs. Lets consider, they get David worked up in a tizzy and get him to come on here and post with a few axes to grind. Then the site gets taken down (for being considered a hate site), after that we have Cheri's post on David's article referring to us as "hater sites" (which by the way is curiously missing now). And then this whatwould joeydo site goes up calling us cyberbullies and haters. I'm not too worried about it, staying a step ahead of the Dabuenistas just means you didn't fall and break your leg, so I think we can handle the children's playtime games. All it does is verify that we are doing our job and starting to have a lasting effect. For instance, joeyisalittlekid is becoming google synonymous with Joey Dauben.

    I finally found you guys! If you're going to try to leave me again, please slip me a note in my locker breaking up with me b/c not knowing what happened between us and not having closure was agonizing.

    I've missed you guys! When I thought the site was gone, I had to resort to reading Teen Mom and Honey Boo Boo updates to achieve the same mind numbing effect that I get from reading anything that has the stench of Dauben associated to it.

    My thoughts:
    (1) In regard to the Ellis County charges, I'm glad to see the actual language from the penal code put out here. It's clearly written and statutory analysis breaks out the crime into elements - Joey's actions fit those elements. I get what David is bellowing about on the "if-they-can-do-this-to-joey-they-can-do-it-to-anyone" soapbox but, let's be honest, Wilson wasn't setting precedent here for general population. Wilson and Carroll aren't on a crusade to clean up cyber bullies or hamper free speech. Joey thrived on posting salacious gossip about others and he took it too far that time. Do you guys remember some of the articles he posted? (I never followed the ECO but I had the ignorant pleasure of being FB friends with him and seeing all his “breaking new stories” disgrace my newsfeed.) He gossiped about other's finances, marriages, orange space ships, parenting, etc right along with child porn and sex rings. He posted with reckless disregard, most of which was grossly inaccurate. Libel? Slander? Definitely. But what remedy does that give the plaintiff? Spending money on legal fees to confirm in a court of law that Joey is cyst on the ass of society and rendering a judgment against him that might as well be mandated to be paid in Lucky Charms marshmallows because you can't get blood from a turnip especially when the turnip is an asshole? That criminal trial wasn't a conspiracy; it was karma.

    (2) The Joey is a journalist controversy (I just puked in my mouth a little when I realized you could take my actual words out of context and assert that I wrote, “Joey is a journalist” in black and white. Joey, in true Joey style, could write a whole story on how I legitimized him as a true professional based on that one remark and then post subsequent comments on his own story under different, fictitious names about how I am secretly gay or that I have a pet unicorn.) If journalists take any concern with Joey Dauben, it should be in regard to the mockery he has made of the profession by trying to pass himself off as one, quite similar to the beef the male gender has with Joey. You don't need an education and dossier to be a journalist. You do need credibility and to exercise due diligence in reporting facts. Those concepts completely contradict every fiber of what Joey was/is about which makes him just a baboon with an inferiority complex because he was picked on all six years of high school. I'm thinking of starting a petition to forever bar Joey from uttering the 1st Amendment let alone trying to use it as an affirmative defense when put on trial for all his self induced bullshit.

    (3) I hope David sticks around. I enjoyed this site before but I think he raises the bar for comments posted by facilitating some interesting debate. I had no idea who he was before he appeared here and, while I have no beef with the stories he wrote about Dauben and no opinion to slant, I think the stuff he's written here is way more entertaining. David, if you go on another gay cruise, please drop us a note that you’ll be taking leave? Just so I don’t worry that you’ve left for good and get the blues, mmkay?

      @ Novice: welcome back. Very well said, I ditto every word you wrote. I think Joey pushed for civil suits because they didn't really punish/bother him. Hey, what's another $300k judgement (on top of the other 29 or so) when you have no credit, no traceable income and wages can not be garnered?

      # 2 was a revelation for me. It didn't occur to me that Joey was posting comments on his own stories under different names. I guess that's why he's so convinced we are all Gingersnap.

      Joey is a twisted loser who thought he had the freedom to write whatever popped into his tiny little head without repercussions. He likes to gather others with vendettas and call it publishing. What they all lack is any proof, and what they all have in common is delusions. SMH, the violence his little group wants to incite is what is scary.

      And while I post as anonymous, it is because I have a stalker. That and I don't need Connie harassing me any more. LOL, or accusing me of being her ex because I say she is full of crap and crazy as a loon<---there is a hint here as to who I am ;)

What really bugs the Daubenistas the most I think is that as much as they want to reduce this blog down to me and my 7 different personalities posting as different names, this blog, like the last one has a very steady following. The old site had about 1,000 or more unique IP hits a day and this one is almost back up to that number. Now you can throw out random traffic and the fact that the same people will have at least one other IP access. So I like to divide the number by 3, so I think we have a solid 300-400 people that follow this blog.

  10. I wonder what Joey's actual traffic was like back in the day.

    I'd like to thank everybody for their thoughtful responses last night. It was nice reading comments without hostility. I don't think David thought it was possible, but he hadn't read enough to see that the opinions here are based on fact. While many of us have reached similar opinions on Joey's actions, it isn't just because this is some fear mongering hate-blog. Like I've said before, I believe that once you do a little reading on Joey, you form an opinion. Some people may think he's some underdog fighting viciously. Others see him turning into a monster & hurting people. I still think David is biased. It's not his fault. It's just the way it is. Personally, I think we all see ourselves or somebody we know in Joey. David probably sees a little bit of himself. Joey wants desperately to be a writer & to have his voice heard. David saw a spark and some "potential" in Joey. He knew Joey's missteps, but he thinks that Joey isn't motivated by evil. Joey is could be like a kid brother. I think that's why I find Joey interesting. I've known lots of people that shared Joey's underlying convictions. I have a friend that was an elected official in West Texas by the time he was 20. I have another friend that wrote a book (that was acually published) while he was in college. Oddly enough, that book was about the JFK assassination. That kid was also heavily into politics and considered himself a Libertarian at the time. I have a friend that started his journalism career straight out of college by going to write for the Dallas Observer. To stretch it even further, Joey wanted to be in a band. Well, I have a friend that just got written up in Rolling Stone this past month. Even the fight against internet predators . . I know people who were involved in the "To Catch A Predator" series for Dateline. Personally, on paper, my friends or I have shared a lot of common interests and aspirations as Joey. I know people blazing the paths that he tried to go down. So when I see somebody that I might have been friends with go so far astray, it's really troubling. He had sooo many opportunities. He even probably had good intentions for the most part. He claims to fight corruption, but he's a textbook example of letting power go to your head. Not that he really ever had that much power. To me, Joey is like the young police officer that messes up an entire investigation because he didn't follow procedure. Everything gets throw out. Only worse. Joey is out there "arresting" the wrong people and diverting attention & resources away from the real criminals. The Amber Hagerman investigation is a prime example. He hurts the family by getting their hopes up & his little investigative journalism wastes police time that could be spent on other leads / other cases that can be solved.

    2. I think his traffic was pretty high on the old ECO, and of course that also went to his head. When you go around the country every day slandering a different individual, you sort of have a built in readership just by that alone. People clicked on that site with the thought "is this the day he goes after me".
