For Windsor, Its Always Someone Else's Fault



As we continue to look at the mountains of documents filed in the Maid of the Mist case, and appeal, we see a clear pattern of a complete lack of personal responsibility from Bill.  The judges are mean to me, I'm just a pro se litigant, the housing bubble popped and took all my money.  But what really drives Bill over the edge is when a judge uses a word that perfect describes his actions.

114. Judge Duffey even branded me as a “litigious plaintiff” in the order dated July 30, 2009 (attached hereto as Exhibit 2). “Litigious” is identified as “tending to engage in lawsuits.” (Exhibit 3 hereto.) A “litigious plaintiff” is a person who tends to file lawsuits.” Judge Duffey has no basis to say that. He would have no idea what I have and haven’t been involved with in terms of litigation unless he has false information obtained from some extra-judicial source. Other than Maid of the Mist’s totally improper lawsuit against me, the only lawsuits that I have been involved with personally for the last 15+ years were two legal actions involving real estate (one was an eviction in which my wife and I prevailed but never got paid, and the other was a small claims lawsuit by an attorney trying to buy our home that was dismissed because it was improper under the law). A third lawsuit was filed against me in California by a National Park Service employee who claimed his photograph taken by me at a National Park while he was on duty should not have been used on my personal travel web site. My insurance carrier paid the man $1,000 to go away. My 15-year history as what Judge Duffey describes as a “litigious plaintiff” is that my wife and I sued some people who bounced their rent checks on our unsold Ohio residence, stiffed us for $30,000 or so, and refused to vacate. Contrary to Judge Duffey’s presentation in the order dated July 30, 2009, that I am involved in “three cases,” the truth is that I am involved with one issue: Maid of the Mist and their attorneys. Maid sued me wrongfully. I have sued Maid. 115. The “litigious plaintiff” case that Judge Duffey cites in his order is Martin-Trigona v. Shaw, a case in which a litigant had filed over 250 lawsuits and used litigation as a cruel and effective weapon against his enemies, who are more often imagined than real. Trigona has reportedly sued literally hundreds, if not thousands, of attorneys, judges, their spouses, court officials, and other human beings. His lawsuits have been pursued with "persistence, viciousness, and general disregard for decency and logic." He has used legal pleadings to ventilate his contempt and hatred of persons of Jewish heritage and to level accusations which "have often been personal, have often emphasized racial or religious affiliations, and have often involved the members of ... judges' and counsel's families." The purpose, nature and effect of his resort to multiple litigation has been to involve as many persons in as many confounding legal processes as possible.

Judge Duffy hit the nail on the head, and Bill objected http://www.youtube.com/watch?v=Dx32b5igLwA. He then selectively choose 15 years because more than that would definitely prove the Judge's point. But what is particularly amazing is how Bill has an out of body experience as he characterizes the Trigona case as something far different than what he is doing. Unlike Bill, Trigona filed tons of lawsuits as a cruel weapon against his enemies, many of which are imagined. This monster even included "judges, court officials, their spouses and other human beings in an effort to involve as many persons in as many confounding legal processes as possible". Right, and we can all see how this Trigona monster differs from what Bill is doing?

  9. From Judge Duffey's denial of Bill's motion to recuse Duffey:

    28 U.S .C. § 144 requires a district judge to recuse himself and "proceed no further" when a party files both "a timely and sufficient affidavit that the judge before whom the matter is pending has a personal bias or prejudice either against him
    or in favor of any adverse party" and 2) "a certificate of counsel of record stating that it is made in good faith." 28 U.S.C. § 144. [Footnote 1: In addition, "a party may file only one such affidavit in any case ." 28 U.S.C. § 144.]

    The potential for abuse of a statute requiring nearly automatic recusal is obvious, and each of those two statutory requirements safeguards against the abusive use of motions to recuse under §144 as an improper litigation tactic.

    The only certificate of good faith that Windsor submitted is one that he himself signed. Indeed, Windsor acknowledges that every attorney he contacted or attempted to contact to review his motion to recuse and attest to his good faith was
    "either unwilling . . ., [unable], or . . .unavailable" to do so [36-2 Mot. at ¶ 23].

    Unfortunately for Windsor, failure to include a certificate of good faith signed by
    counsel of record is "fatal" to a § 144 motion filed by a pro se litigant.

    Windsor seeks a waiver of that statutory requirement because he is proceeding pro se. The law in this district and circuit, however, is clear. The requirement that a party file a certificate of good faith signed by counsel of record serves a critical
    function in preventing the tactical abuse of § 144 by litigants. Id. In every federal case that he has litigated pro se, Windsor has filed motions to recuse or disqualify the presiding judge, sometimes as many as three in the same case. [Maid of the Mist I 361, 406 & 470; Maid of the Mist II 17; and 17 & 36]…

    306. This affidavit is accompanied by a “certificate of counsel of record.” As I am the only person of record and I am a pro se Plaintiff, the certificate is from me, and it is made in good faith.

    I attempted to get an attorney to also provide a certificate. I contacted the attorneys whom I know except those with the firm of Raley & Sandifer as
    we terminated services with them. Each attorney that I was able to reach advised me that they either had a conflict or did not want to risk retribution from a federal judge. I contacted legal Aid, but they only handle poor people. I contacted the ACLU, but they have a six week waiting list. The law reads “counsel of record,” so I ask that my Certificate be all that is required. Respectfully submitted, this 4th day of August 2009.

      As for the alleged "death threats" posts he keeps making- It is just like all his other "death threats" posts. One minute it's Obama who put a hit out on him, and the next it's haters. I haven't seen any, and the fact that he likes to pretend the movie "Kill Bill" is a direct aim at him, is by far the most reaching one of them all. Knowing the movie- which was about a woman who had been done wrong by a guy who took her kid and everyone who protected the guy. Has absolutely nothing to do with Windsor but that's how he likes to spin things. What the hell is "colorable" about bullshit allegations like that?

      That he can spin 'Kill Bill' the movie into being about him just shows how truly narcissistic he is. The world revolves around Bill don't cha know.

      While he may not like the title, it's got nothing to do with him. But he grasps at any threads he can. I remember when he claimed there was a government hit taken out on him LOL- how does he even come up with this stuff? And why would anyone believe him?

      Beyond that, he attributes comments made about watching that movie to many people, when it was not made here. It's pathetic that he thinks the whole world is out to get him. All because there are so many people who disagree with him, or just plain don't like him or his tactics of harassing people online and in court.

      See, Bill really believes that everyone should be on his side, and never question his statements, tactics or anything else he utters. I bet he thinks his farts smell like flowers. ;)

On the other hand, he also engages in patently self-defeating and self-handicapping tactics, For instance, he sent Sundance a request for discovery and is trying to embroil them in the Ellis Co. suit, but why? Does he really think Sundance will now accept any production of his--EVER? Talk about pooping in your own mess kit...

  12. I have been re-reading some of Bill's court filings. He should be better at this after all these lawsuits, and filings. They seem to be all over the place now. While I have always found them to be excessive, he has devolved in his focus. I guess that's what happens when you have so many lawsuits running concurrently.

    I do find it ridiculous how he threatens/promises to sue judges who rule against him, and claims anyone who does not agree with his misinterpretation of the law to be corrupt. If he was being objective, he might see how outlandish his filings are. Maybe he really is trying to lose.

      I do have to wonder why Windsor, who is so big on writing his affidavits didn't write one about his ownership of the Lawless America Association. The only thing I can think of as to why he hasn't done so, when he is trying to sue for damages in part- to his association, is that he is hiding something. He hasn't filed an affidavit to prove he is trademarked and when, copyrighted and when, or anything to prove he has any legal rights to Lawless America. How strange.

    4. First of all, this document doesn't seem to show up in the court filings yet, so that must mean that Windsor gave Crystal Cox this copy to post up for him, since he has admitted he can not mention Boushie's name.

      Secondly, he repeats himself numerous times like he forgot where he was, or he is just trying to pad the numbers to make it appear longer than it is.

      Third, when he makes a statement with his definition or understanding of what Boushie was saying, when reading what Boushie wrote, it does not match at all. Much of it was sarcasm, hyperbole, mockery, of which no one would take seriously. Such as "Boushie admitting to being a Government paid blah blah" when Boushie says "ya right, I am a Gubberment blah blah." which was making fun of Windsors B.S. claims to begin with.

      I can't even continue. This thing is so bogus, clearly Windsor dramatics, trying to make something out of nothing. I still believe that Crystal Cox was behind the majority of the stuff Windsor is trying to pin on Boushie, and the fact IP addresses can be changed makes it very easy for someone like Cox, who has manipulated the WWW and was listed as Windsor's techie person to be behind this crap.

      "Wow! IMO, the inference Billy makes--to assert the term "Piemagedon" is some form of veiled death threat bends Windsor's credulity to the breaking point. The term is clearly a play on words and part of the on-going trope and inside joke regarding Windsor's pie-eating/liking found on the blog. Given the venue (a blog) and the context (a critical opinion of a public figure), a reasonable person would see the term as it is: at most, nothing more than rhetorical hyperbole well within bounds of protected speech.

    6. There is definitely some hyperbole in there. I've learned a lot more lately about aps and programs to change IP & caller ID. The problem in finding the truth is that Cox, Bill and Booshie are very good at misleading people. But there was enough of what Booshie posted on FB, this blog and other blogs to support some truth in Bill's accusations, IMO.

      What really confounds me is that Bill used my comments to support his claims about Booshie but he is trying to sue me for conspiracy, being a vicious cyber stalker, a thing, scum and a brain surgeon.

  17. The false statement picture is quite amusing. Not only did "Mr.M" record someone on video calling them a sex offender, he himself stated it in posting the video on his timeline. I know the person who said it is, in my opinion, a complete loon. No one checks out these "stories". More than likely most are for lies and revenge...I said most. Some stories I'm sure really happened. Bust as for the false statements, that makes him just as guilty in my eyes for recording it and posting it.

    Actually, I Windsor never appeared. I spoke to the court reporter he hired who was upset with Windsor. He said he got lost and could not find the place to her. He then filed sanctions against them both asking for a sum of about $4,000 a piece. While he stated to the court in Missouri that this was for his travel and lodging. Then he says that his entire trip there was for a TV series. What one was it?

    Let Just say you made it on the show and people thought that the show sucked and your idea sucked and well for the most part told other people you sucked and that your documentary stunk. Then what? There are mega million dollar films that come out and thousands of people dislike them. I don't see them suing everyone who told everyone they know and commented all over that the movie was not good. This film is not even a film it's people's testimonies to congress that never occurred in a real congressional hearing and it is a propaganda film for people to join your movement.

    If it wasn't for you stopping in April on your path for Grand Jurys you would be right there with your own Seal serving papers just like the National Lliberty Alliance. Another group who believe forcing change onto people is the right thing to do. I once heard David Schied say if they can not have Grand Juries he would resort to his second Amendment rights. Well.. I hope he does not make that mistake. Maybe he will gain the fact that you can not have the Grand Juries as he wants. Along with Bill who has this predetermination to Harass those with Political Thought in life that are opposed to him.

    1. I'd have to say that the FBI was watching Windsor long before Boushie allegedly made any comments Windsor must still be shaking in his baby bill booties over that phone call. But for Bill's own plans written out on his Lawless page for treason to all, the fact that Paulson now waits for his sentence, and all the others linked to Lawless (who have been discussed many times here) which Bill states is his, he's leading...they are just following, he probably wouldn't have hit their radar.

    Very good Windsor. Remember you said that when it's proven that you still don't have a Trademark to this date. In fact, remember this for all the lies that you have told that will come back to bit you.

    1. Actually the filing for the Service Mark for the "Lawless America" logo or name is botched. Bill continued to let the USPTO file it as Lawless America Association LLC which is not an entity at all. The filing is false and not correct. It states that it is working as a PAC. Non-Profits can not be PACS nor can they work in the political realm. That is what Bill is working in. Basically I do not see this copyright ever going thru.

      I was advised today that we didn't make the cut. there was no explanation given, but I can't help but wonder if it is because they read online that I'm a pedophile, a pedophile lover, anti-guy, a racist, a terrorist, a scam artist, a liar, a person who enjoys sex with animals, etc., etc. Perhaps too controversial, or maybe they just didn't like me.

      It's never fun to be rejected for much of anything, but this had everything else on hold, so now I can move again. In the end, I doubt that I would have gone with them because we would have lost all control of the film.

      Other than that, I think it's a great piece of information you put together along with your opinions based upon the information you have obtained. Pretty much anybody that isn't a "nobody" would have the same questions, thoughts and opinions as you have, after viewing this information. It looks like a whole bunch lies to me. Lied in each filing, in order to just get something in print, for the appearance of being legit. Is it fraud? Is it perjury? Whatever it is, it isn't honest in my opinion.

    Enclosed is a complaint that I have sent to the federal district court judge in Kansas. I have emailed her at least three times with no response. It has been over three months since I originally contacted her. I have now emailed her to advise that I will file this complaint when I am back in Topeka, Kansas on September 12. I am accepting her failure to respond negatively to repeated requests to constitute a grant of leave to file. I cannot wait past September 12. This approval process that you want is not working well. It has taken judges as long as six months to respond. From now on, I will give them two weeks. If they don't respond in that time, I will take that as a grant of leave to file.

    I have had to file police reports, and there can be no requirement for me to get approval before contacting law enforcement. I was recently assaulted twice and shot at once while in Montana. The police told me to seek a protective order, which I did. When my life is at stake, I have no intention of attempting to get anything that I do approved by anyone. One last thing, a legal action has been filed against me by a man in Montana who has threatened to kill me at least 16 times. I am filing a countersuit. There IS no way to get approval for countersuits since they have to be filed so quickly.

    2. The problem is that Bill believes the process should work out the way he believes it should. This is how thinks all the time of course. First he emails the judge. Of course we all know they will never answer emails. Then he sends regular mail which reaches the clerk but that is not the process either. They put it into the trash can because asking permission is not like getting a signature from epstiens mom. He just doesn’t get it. I hope he never figures it out. If he was really interested in playing by the rules set up currently and the processes instead of making threats of lawsuits and using force via grand juries to execute them then change laws to make things his way verse using the political process we have now then things would be different for him. Bill seems to threaten anyone who does not make things work out for him the way he wants it. I don’t understand it.
