Bill Windsor, Hopelessly Adrift at Sea



Reality is the bitter enemy of Windsor.  As I have been highlighting, this little fugitive trek Bill started out on is really backfiring on him now as he is beginning to realize that he can no longer scare anyone with his usual terrorist threats.  He can keep screaming and yelling and cursing any and everyone that has ever come into contact with him, but he is still drifting away into his own abyss and no one is left hear his cries.

No matter how many times he tries his criminal case on facebook, and no matter how hard he tries to convince himself that he is inflicting pain on others......the results are just not there.  Ohh and Bill, here is the other huge problem for you.....you have to go appear before the MT court before you can start making your criminal defense argument.  I'm sorry, but they are not going to make up special rules for you.  You can make all the demands you want, but you are the last person on earth a "somebody" is going to listen to.

Bill decided, over the weekend, to elevate his wilful insubordination of a protective order over cases of rape.  His temper tantrum knows no bounds as he continues to demand attention and fear.  Even his loyal followers are now confused over which references is another lame attempt at humor, and which one is just another empty threat.  As he continues to drown his sorrows away in a bag of chocolate (his version of "changing his appearance") once the sugar rush wears off.....his bitter life long foe, reality, sets right back in again.  Day 43 of not being in a courtroom has taken a toll.....he doesn't seem to be able to hold out much longer.  But a court appearance will equal prison.....what an ironic situation for a life long vexatious litigant.

He dug himself into a hole the only way he'll get out of--is to go to court and answer (something he doesn't like to do. Ever) It is ironic like you said. He may be a millionaire but that doesn't make him immune from prosecution. Something I think he never thought of before.

    4. Windsor is not from Georgia--he's from Texas. Although he wasn't born in Texas, he grew up in Texas, went to school in Texas, went to college in Texas, married and raised children in Texas, and started many businesses (and law suits) in Texas. I think he moved to Georgia to be with his family and grand kids, but of course we know the evil Joeys took his family away from him, so he moved back to what he considered was his true home: Texas.

      In the MoM case, Windsor claims he spent apx. $1.5M on attorneys. He claims the attorneys lost the case because they forgot to file a crucial affidavit of a women who overheard a conversation between Windsor and a MoM executive. Windsor claimed the agreements in the conversion constituted a verbal contract. Did you get that? Here we have a self-proclaimed serial CEO who wants to enforce a verbal contract for a multi-million-dollar deal over the phone! What's wrong with that picture?

It is so ironic, that it was Montana where BILLY BO ran aground, and @ the U of Mont, and it was Lab TECH, S B, who led the charge, which has now ensnarled two states in the BILLY cyber bombastics, played out in CYBER- WWW-land. MoM caused BILLY to snap, tragic in some ways.
      He figures there are 1,000s and 1000's of gullible people on the WWW, who will read his crap and swallow it, hook line and sinker. He is taping into the vein of hate for lawyers, and those who got a raw deal in the justice system. His trip to Missoula was his Waterloo. His inept handling of legal pleadings in Montana, has forced issues going into uncharted waters. Here things stand, the 2nd decade of the I-net, and the U S justice systems dealing with the tantrums of unhinged Uncle BILLY.
      His claims on being a biz man, how true are there, so he sold T Shirts,
      and had a few rag trade magazines, is he really a tycoon ?

I am offering a signed pair of my dirty socks, Left over 1/2 drank bottle of Michigan Micro Brew from the other night and a 1/2 smoked Fine Cigar from once again celebrating my win of $250,000 from Windsor which is making 5% annually and at about over $1,000 a month in interest until paid. I love vacations. I will be writing windsor a letter soon but it won't call for his resignation. He will be getting lots of 8am wake up calls, Mid-afternoon calls and late night calls on that cellphone of his. Family members might get calls asking for his whereabouts. This is all because of great debt collectors who will be looking for that $250,000 owed. I might even hire a private detective to follow the postal mail and all. I hear some of the tools used will be Spokeo, and other awesome places. So while bill will be hanging out in one place it will make it easier to find out where he is. I love it when a place comes together, while I go back to smoking my cigars.

      He chose to go on the lam, not appear back in court when the Governors signatures came in.

    2. He just doesn't get it. When he gets arrested, the state that arrests him isn't going to research his charges to see if they are valid, which they are. They are simply going confirm a FELONY warrant exist. When the warrant is confirmed, they are done. No trial, no discovery, just a jail cell until MT or Texas get there to pick him up. I hope Bill continues convincing himself that 17 states can't arrest him. That idiot will try to sue more people soon and when he does, game over.

Windsor can't file any new lawsuit ANYWHERE without posting at least a 50-thousand-dollar bond against sanctions (and getting the permission of the federal district in which he plans to file). And yes, Windsor knows full well about the TOP. He appealed it twice, once to the District Court and once to the Montana Supreme Court (as that link will show you). Both appeals were denied, the extension stands, and the order is still in place. He's claimed at least twice now that he was never given a chance to appeal it. He's lying. He's also claimed it doesn't apply to him because he's not in Montana doing anything. Another lie. His victim still lives there -- so the order is still good.

    5. Actually I think there are two separate orders (injunctions) for the 50K. The Thrash one and the MT one. MT is different than the Thrash one. I believe the appellate court said it was up to the lower court to decide who it was regarding and how much to impose.

      As I think I've said in previous threads, Windsor would be (is being!) very foolish to proceed in his criminal case without an attorney. If and when he is apprehended, Windsor's fate is largely going to be in the discretionary hands of a prosecutor and possibly a judge—and a well-respected defense attorney is the best possible person to have in his corner under those circumstances.

      Now, it would appear that Windsor thinks that he can beat the Montana charges as a matter of law—which is probably the most significant of the various reasons he thinks he can do without an attorney. I find his legal arguments dubious, but even if they're correct, he's better off with a pro making them than he is with himself. (Not that he's likely to see things that way.)

      I'm not at all convinced that "no attorney would take Windsor." Presuming he has the kind of money stashed away that many folks here believe he has, I have to believe that there would be plenty of practitioners willing to represent him. (Many of us are accustomed to dealing with difficult clients.) It could be a significant problem if Windsor demands that his counsel litigate in the manner that Windsor himself litigates, though. He'd be a horrific "backseat driver," if he sees fit to behave that way.

      Finally, while under ordinary circumstances a criminal defendant has the right to represent himself, that right is not absolute. A defendant who wastes the court's time (or patience) with delaying tactics or other nonsense can be forced by the court to retain counsel. Given Windsor's litigation career to date (and the recognition of same by Montana courts), I think there's a very good chance that his request to represent himself would be rejected right off the bat. Those are quite possibly the wages of "paper terrorism."

    11. I also see the issues that Windsor will have in this criminal case, is that he will more than likely try to turn HIS criminal case into a "See, look what he did..." appeal/civil suit deal. It's all he knows. He can't answer his charges without saying but, but...I have massive evidence. None of that will matter. It's a did you do this? He'll lie, they'll show the evidence (that he never has) and boom. One lie down.

      Just looking at all the justifications he's attempting to distract from his own actions, is a pretty good indicator at what he'll attempt in a court. However, the criminal Judge won't allow him to play his side stepping semantic games like the civil court in TX did.

      It's been said here numerous times, he's got nothing. He did break the law, and he will have to answer for it. His belligerence over the past 45 days surely will also count against him in a negative way. He spit on the Judges, DA's and the protection orders, when he started posting Boushie's name again. Clearly showing no remorse, which in a criminal case, the defendant really needs to do their best to persuade the Judge they have. Not Windsor. No way. Pompous, Arrogant, Cocky, Vindictive Prick. There is not one thing I think an Attorney could possibly do, to help Windsor at this point. He's screwed himself good this time.

      I don't think that's true. You're quite correct that Windsor has made a series of very bad moves that have harmed his legal position—and it's doubtful that any attorney could undo very much of that harm. But I strongly suspect that there is still a range of reasonably possible outcomes (mainly sentencing terms) available to the prosecutor and judge in the criminal case. A good defense attorney could still be a major help in getting Windsor something nearer the favorable end of that range. I don't think he's doomed to a de facto life sentence... yet.

      I certainly can. I think there's a real possibility that the Montana court would do it anyway. As the U.S. Supreme Court ruled in 1975:

      "[T]he trial judge may terminate self-representation by a defendant who deliberately engages in serious and obstructionist misconduct.

      "The right to self-representation is not a license to abuse the dignity of the courtroom. Neither is it a license not to comply with relevant rules of procedural and substantive law."

      Faretta v. California, 422 U.S. 806, 834 n.46 (1975) (citation omitted).

      Alternatively, the Montana court could give him an instruction along the lines of "Okay, you can represent yourself for now—but if I see one more burst of craziness from you I'm going to appoint you a lawyer." It seems to me, though, that the antics he's already been up to in the Montana criminal proceedings have quite possibly worn out his welcome on Faretta terms.
