A Jury Is Seated In The Joey Dauben Trial

David Webb has a very good story on his blog.  Its balanced, factual, and informative.  I think we are wearing off on him.  Anyway, it took all day but they found their 12 jurors.  David says its a mix of men and women (I kinda figured that) but what I think might be interesting is how many men are on this jury?  I think men are going to be more likely to go light on Joey than will woman.  This is again assuming that the course of events are as we speculated.  The boy was drunk, he wanted it, he might have even pressed Joey for it.  Those factors won't matter in terms of guilty or innocent, but they may factor in during the sentencing phase.  I think some men will see this in terms of who made the advance and if it was the boy, they might be lenient on Joey in terms of a sentence.

Hopefully today we can start to hear the case that the prosecution has against Joey and the speculation can be replaced with facts.  Will Brandy Owen be called in to testify?  I have my popcorn ready.

    From what I gather....
    So the child IS NOT from a foster home. By all appearances the child IS NOT gay and the child was very reluctant to admit this AND it was admitted repeatedly a long time ago, not 4 years later as stated by Dauben. And JOEY made references to having another shower with him on his myspace? Yah, baby joey is not at all creepy.

    What a flipping smear campaign the Daubenistas have spent all year making others believe things that simply ARE NOT TRUE!

    wow I've got to walk away from my computer for awhile.

  4. Yeah very interesting, and good job again Webb. My initial thoughts:

    -the mother/father custody battle and then his leaving the picture is interesting but I'm not sure it has any direct relation to the crime alleged. What stikes me as ironic is that this mother sounds exactly like the type Joey started advocating for shortly after this incident. His way of dealing with his quilt?

    -The Bobo reference to the "shower waiting" myspace message needs some context. On face value that sounds like what may hang Joey. Its sounds just like a message Sandusky was sending to his victims. I suppose Joey could find a way to explain that message but he is going to have a hard time I imagine.

    -The boy is certainly showing all the signs of someone who really was raped and not someone trying to go after Joey. His reluctance to talk about it along with his behavioral isolation after the incident certainly fall into line of someone that really was violated.

    -How is Kevin's house all wrapped up in this case as Joey and his Daubenista's promised? I don't see any connection whatsoever as it looks like these boys have always been in either their mother or father's care.

    1. Bingo! Yes Ginger, that's what I've gathered as well.

      I'm worried about the father. Did he feel so guilty, he did something to himself? If he's actually vanished, I find it so odd given the dad seemed to have a lengthy vested interest in raising his children, even home schooling. Setting aside the custodial issues, that plague most every divorce, I wonder what happened to him?

      He also could have very well gone to the FBI and the FBI told him to go to the local jurisdiction. Generally this type of crime is not FBI material unless it becomes a state to state issue. :(

      Wow. Didn't see that coming. So much for gut instinct. I had to walk away from the computer and take a while to digest it too.

      Yeah, it is interesting that this kid's family situation is sooooo similar to the stories that we've been following. Sort of works right into the heart of AMPP's platform.

      There goes the conspiracy defense - appears none of the players had no clue of Joey's existence, let alone his purpose. Re: the My space message, context is irrelevant in my mind when the e-mail string Joey posted is taken into consideration. Whether there was intercourse or not, the communication was inappropriate.

      Two questions for Webb:

      1) Any idea why it took so long from date of initial report until Bobo met with the boy?

      2) Did the stepmother disappear too, or just the dad?

    4. NBTDT, I know what you are saying with the context is irrelevant, I'm just trying to hold out a possibility, which is extremely unlikely especially because of how Bobo took it to mean.

      I mean lets try and write a sentence that wouldn't sound sexual with that reference...I will try

      "hey, this camp is awesome, there is ball fields, we have lots of hiking and tons of activities to do and when you get done with that there are showers waiting to get clean and ready for bed"

      I know I'm stretching this but that's what I mean by context, I seriously doubt it was something like that but I'm just holding open the possibility because if it really is like it sounds, this case is already over.

      No, not stretching you make a good point. Based on David's report, Bobo seems to have had the same reaction to the message as I did to the e-mail string - so I feel my reaction is validated.

      And, David was right about trials. I've had the same experiences. When you hear the prosecution, it's hard not to agree with their case. In the interest of justice, it's extremely important to listen to the defense. The defense could very well have a string of messages that puts the waiting shower in context.

    My mood matches the gloomy weather, can't imagine how your mood is after sitting in the courtroom listening to the kid's mom. Wow.

    Again, good job, Mr. Webb, I appreciate you going & telling us what's being said in the testimony. Tomorrow's gonna be even tougher.

  8. My only criticism is the title of the article. "Mysterious Disappearance" doesn't seem to match.

    For all the people that support Dauben and say the kid made it up, I think they will be forced to re-think that train of thought. It seems that a young man who was 14 has been traumatized by the actions of a person that is in a position of authority is what sticks out. How sad is it that it appears this young man faces years of trying to deal with this trauma? What a shame.

    1. It must have been extremely rough day. Even the giggly twins and their foil hats have not come online.

      As far as the missing child's dad, it worries me that he may have felt tremendous guilt for not protecting his child and 'disappeared' willingly. It has been known to happen.

      How this has been drawn out by prosecution, I can't see Joey digging out of this hole. The jurors in the room are 'regular' non conspiracy people who think like the majority of us. Since the trial is booked at best for a week, safe to say none of defense will include Joey's JFK/ Bohemian grove/Amber killer/Kevins house BS. Because that's all it is, BS.

      Joey thought he was smart enough to run around seeking a 'defense' in advance to prove he couldn't possible rape children........ too bad Joey thinks no one is smarter than him.

      Long day, long night. So sad. Thanks SC, great reply and yes, what a shame.
