Joey Dauben's Trial Starts Today

Whether he is out on bond right now or not, doesnt make much difference as his Navarro County trial finally gets under way.  Lets get a recap of what we have been told:

The case against Joey
4 years ago at a church camp in Navarro, Joey is charged with sexual assault with a then 15 year old boy, he is charged with three different counts but you could sum the whole thing up as just one sexual encounter.

We have heard that this boy is going to say that this occurred in a bathroom and out in the boat on the lake

There are going to be numerous witnesses that can verify that Joey and this boy were alone in both of those locations

Joey and this boy exchanged internet messages after this incident possibly pointing to Joey being worried about the boy claiming something happened at the camp that night.

Joey's Defense
We have heard from Presley and Daddy Dauben, as well as the prebuttal that Brandy was ordered to put out right after his arrest, that this boy is someone who accuses people of this repeatedly.  They have always directed our attention to Joey's coverage of Kevin's House as the explanation.

So I spent some time reading through Joey's "book" on the convoluted chapter of Kevin's House.  Here is what I think they are saying.  Joey's messianic leader was Bill Reilly.  Reilly was also a probation officer who sent many of his subjects to Kevin's House.  The guy that ran the place is accused by Joey through several inmates, of abusing the boys sexually.  Those that spoke out about this abuse would have their probation revoked by Reilly and back to jail they would go.  Joey finally ran the story about this abuse and linking it to his pastor.  This got him "excommunicated" from Reilly's church.

So I guess we are to infer from this that Joey is saying that Reilly got one of his boys to make this claim as payback for Joey running the story on Kevin's House.  The whole thing is so twisted and convoluted that its very hard to make sense of anything, but there thats my best guess as to what Joey's defense is going to be this week.

    They are going to blame the victim and point to conspiracies.

    It should be an interesting trial. Do we have any way to follow it? Is there any MSM coverage? Is anyone attending?

    4. There is a four-page paragraph in the Corsicana Daily Sun today quoting DA Lowell Thompson as saying the trial will take about a week. The short story mentions his conviction in Ellis County recently, but it does not say anything about him being out of jail on bond.

  4. Trail is apropos since it's going to be a TRAIL of lies and perhaps a TRAIL of tears for the victim, ever think of that? More victim blaming by perps. This world SUCKS and those that have stood by Joey have really screwed their own cases. You cannot say one case is the god almighty truth and then go and commiserate or date with someone accused of a horrific crime like this against a child! Would the Fembots' heads explode if they for one minute that the victim IS telling the truth? This is too sad of a train wreck to watch, even I'm not that morbid.

    1. ^^^ who's this one Ginger? I'm not familiar with him/her. If Joey is guilty, I hope he goes to jail TRSS. I think much of the evidence will be because of the seizure of Joey & his family's tech. devices, ipads, laptops, etc. I think there was proof of something sexual that went on at the bible camp.

      Unless Joey pleas out, I can't see him being found not guilty. When the Texas Rangers become involved in investigations, they make certain all their ducks are in a row. They have as close to 100% conviction rate as it could get statistically. I think Joey is on frucked duck. Maybe by Friday, we'll have the answers.

    3. I've been covering trials for over 30 years. You never know what is going to unfold until they get underway. It is actually the best theater there is to be had. You wouldn't believe how many people attend trials just for the show, especially murder trials, when they don't any of the people involved. There have been many times that I thought a conviction was a slam-dunk or vice versa and been blown away by what came out during the trial and how the jury responded to the evidence.

  8. Technically speaking, Joey Dauben is not accused of pedophilia, which is defined as a sexual interest in pubescent children (usually about 12 and under) by someone of the age of at least 16. He is accused of having sex with a minor of the age of 15, who was too young to give his consent under state law, which makes him a child in the eyes of the law. However in terms of human development, a teenager really isn't a child and sometimes can be incredibly sexually aggressive. And before anyone starts clobbering me with their keyboards, I'm not saying it is OK to have sex with teenagers, just that pedophilia is not the correct term in the case. I thought maybe you girls might like to chew on that one in the meantime until there is a report about the day's activities in court.

      Our giggling sarcastic reference (is an inside joke sorta).. how Connie and Presley run around telling everyone in the world they're all pedophiles except Connie's dad Tim Bedwell, who's currently sitting in an Alaskan jail facing 36 counts of child sexual assault, some counts with a weapon. Some of those children he allegedly raped were prepubescent.

      While Connie falsely accused her own ex of child molestation and eventually lost all rights to her child and Presley is claiming Joey is also falsely accused, everyone else in their world IS a pedophile. They call the Pope, Obama, most of the gov't and all the judges pedophiles. (literally). So the 'joke' was written for them.

      Lighten up sweetcheeks, not everything is meant to be taken so literal ;)

    4. rare reporter...laws do not have "pedophile" laws per say as it is a mental disorder and pedophilia is not in the statutes anywhere that I have seen.If pedophilia is brought up in court it is usually by a mental health professional. Statutes have crimes against minors of certain ages. Pedophilia is a mental disorder not a crime. I did see where Justice DiTomaso of the Superior Court of Justice defined it as a person afflicted with a serious mental disorder, a mental abnormality known as pedophilia, a sexual perversion in which children are preferred as sexual partner in the case of R v Byers. If you are going to report on court stuff may as well get the legal definitions. Yes judges define terms too. In the judges eyes, if asked, pedophilia could fit the crime me thinks.

    5. I have seen some people in various places use the terms "child-rapist" and pedophile to describe Joey Dauben this year. Of course, he hasn't been convicted yet of anything in connection with the Navarro County charges so that's jumping the gun. In Texas the charge is sexual assault of a child if the alleged victim is under the age of 17, I believe. So there obviously is no differentiation in the law regarding prepubescent and pubescent victims. But on the face of it, one seems worse than the other if there is not an act of force involved and it is not incest.

    6. Actually Webby, depending on the state, there are differences in charges and that also allows for different sentencing structure for the judges. Which I think, is a good thing. I think someone who violent rapes a 4 year old with a weapon should receive a different sentence than Joey raping a teenager.

      Take this example of Connie Bedwell's father, difference in charges:

      Some of the charges are sexual abuse with a minor under the age of 18 and some under the age of 13. Then you can get into different classes of felony's depending on the severity / crime. Anal, oral, vaginal, penetration, no penetration, etc.

      Back to Joey. In Texas, it is a crime to have ANY sexual contact with teens if you are an adult. I take offense to the reference that some teens are sexually aggressive (therefore that must make everything OK??) While you are correct in your opinion, some teens CAN be aggressive, that does not give ANY adult the right to take advantage of them at all.

      From my point of view, I see you may be blaming the victim in Joey's case already, if in the event Joey did have sex with this teen, its somehow the teens fault? Without even speaking to the victim of Joey, you appear to have made some incredible assumptions and pre-determinded things I presume because of your discussions with Joey.

      I don't care IF the teen was drunk (don't know if that's true or not). I don't care IF he was sexually aggressive. I don't care one damn bit if he offered Joey all the pie under the sky. JOEY was the grown up. The laws are the laws are the laws!!! No adult has the right to take advantage of teens for sexual purposes period! If Joey did this - he is grown up enough to face the consequences of HIS actions.

      I don't care if the teen was mature for his age, worldly or lived in foster homes (David Dauben excuses).... I've heard an awful lot of bashing this young man even though at the moment - he IS presumed to be a victim of rape.

      I think you've listened far too much to the Daubenista's surrounding you and your ability to remain unbiased has flown out the window.

      Lets all focus on poor baby Joey and NOT a teen who may have been taken advantage of and possibly didn't have the 'emotional maturity' to make a healthy decision at the time.

      But you just had to do it anyway, didn't you Yappy? Some teenagers are sexually aggressive. The streets of big cities are full of underage male and female prostitutes. No, it is not OK for an adult to have sex with a minor, but it is possible to see how the minor could help influence the situation. Yet, I agree it is still the adult's responsibility to ensure it does not happen.

      I'm speaking hypothetically and not under the influence of Daubenistas because every last single one of them claim no sex occurred period.

      At this point, I have not heard the alleged victim's testimony. So far I believe what Joey has told me, that there was no sexual encounter at all. I suppose that could change after listening to the testimony from the victim.

      In fact, during trial coverage I have often found myself believing the prosecution's case that is presented first, then switching to the defense's side and going all over the place before I finally reported the jury's verdict, which I generally just reported and tried to explain how they might have reached that conclusion.

      My ability to report without bias has not been damaged. I am in fact able to look at from many more different perspectives than you are. All of you keep accusing me of bias when in fact it is yourselves who are biased based on your hatred of Joey Dauben's reporting on his blog.

I believe in my opinion, you have been swayed by what Joey has said to you over however long you have been in touch with him, his loopy fiancee and his conspiracy-crazed daddy dauben. You haven't spoke with the victim, you don't have his side nor any actual details of the 'alleged' crime.

      if you're going to make statements how teens can be sexually aggressive while speaking about Joey and this trial, it's not hard to jump to a conclusion that you are implying THIS TEEN was aggressive. That's where I took offense to your statement.

      Instead of whining about being clobbered online with a keyboard, I'd prefer you do what you just did... "clobber" back and be clear about how you feel.

      Otherwise I'd go on my merry way and make ASSumptions instead of giving you a chance to explain.       Given the Texas Rangers are involved, they do seem to have a good reputation in the state of Texas as running a very tight and clean ship. I have to think that the Rangers have more than a teen saying yup, this happened.. case closed. I think they have the goods on Joey.

      And I have no hatred for Joey, Webby so I'm going to clear that part up for you since you stated it.. Hate doesn't live in this gals heart Webby.       Where my concern is regarding your 'bias' in this... is that you're also wearing your journalist hat while discussing and writing about it. Therefore it is your job to remain unbiased.

      I've never heard you ask about Joey's victims or care to ask. What about people who cried themselves to sleep at night for endless months because Joey felt he had the right to attack them, their family, or whatever he pleased? What about people who Joey basically would continue to repeatedly rip open deep deeeeep wounds and painful memories. Memories and a life they'd rather find a way to move past and find some joy in life? What about THOSE people Webb?

      I'm not sure you actually care to talk to any of them. You have only spoke with Joey and I wonder why. I believe you have a heart and maybe someday you will decide to sit down with some of Joey's victims, even if its just to listen. not to write their stories but only to hear the pain HE REALLY put people through. Innocent amazing wonderful law-abiding kind and generous people.

      Maybe you'd have a change of heart or at the very least an understanding to WHY some of us on here dislike baby Joey and the harm he's brought to others.

      Hatred of Joey's reporting isn't really the issue. Joey lied. About a lot of things. And by his own admission, he lied with malice. Even the people that I know that were hurt by Joey don't hate him. When I say his name, they just roll their eyes - disgust is probably a better word.

      In speaking only for myself, I am biased for 2 reasons:

      1) Once I know somebody will lie, I have no confidence that anything coming out of that person's mouth is the truth. I will look at all sides to verify everything before forming an opinion.

      2) Joey's e-mail exchange with the boy was posted. We have no way to know whether all or part was posted. But, the part that was posted indicated to me that Joey was attempting to engage the boy in an inappropriate way. If I were the boy's parent and saw that exchange, I would have called the police immediately.

      All that said: it's because of the bias I have formed that I am so interested in BOTH sides of the story. No matter what I think of Joey, I want him to have a fair trial. Without a fair trial, no matter what the jury decides, the questions and doubt I have will never be satisfied.

      Suspense kind of stinks. I consider Joey a friend. I only knew him for his conservative government stances and his fight against taxes/needless spending.

      I've known him since he worked for the Ellis County Press.
      I do not know him capable of what he is accused of.

      Re: your post @ 4:40 - I understand and agree with some of what you said. Rape can happen at any age, with or without force. I think it's the power position on an adult that makes sex with a minor a crime, even if there is no force. But, that's why we have trials, so the accused can present a defense for his specific circumstances.

      I don't think anybody here has made a judgement regarding Joey's quilt or innocence. We are, however, interested in fairness, details and proceedings. So get to writing - or I'll come to court and sit right next to you all day, all week...

  11. I'm glad the trial is finally underway. With all the oddities, weirdness, and disgusting things that I "learned" about several people affiliated with Joey.... I am glad it has started.

    Glad there is a clear cut thing going on now. Let the evidence prove he is guilty, or let the lack of guilt prove his innocence and clear him.

    Just to ask for full clarification -

    How long is the DA going for?
    How many charges are there exactly now?
    I'm pretty sure he opted out of a plea deal, but not positive.
    Is there any convicting evidence against him?

    Is this basically this guy's testimony against his?

    I mean - People seeing Joey alone with the kid is not really TOUGH evidence...

    But if this kid can describe the events and (GAHHHH!!!) What Joey looks like etc., he could be toast.

    3. I'm not going to be reporting what anyone thinks. I'll be attending the trial and reporting the cases that are presented by the prosecution and the defense and the witnesses' testimony. If a jury is seated today, I will report all of the facts about what went on in regard to getting 12 people the defense and prosecution both approved. I'm not holding a gun to anyone's head to read my story. If you truly have no confidence in me, then I wouldn't bother reading it.

      Of course we'll read the story, whether it's based sources connected to Joey or not. We are just less likely to pick it apart if you are there. I was hoping you would go because if you are there, I don't think you can help but write about both sides. And, I think you will be convinced that the jury has reached the right decision, no matter which way it falls.

    1. Yeah, outstanding article from Webby. Everything was balanced, his words were carefully selected and the info was pertinent. By far his best article to date, maybe we are wearing off on him even if he wont admit it.

      Two questions come to mind:

      1. Is he seriously considering not testifying on his own behalf? Maybe this is coming from his attorney but I just can't imagine Joey wanting to sit this one out hell he has been testifying on this case to his innocence from day one. Yes he has the right not to, but I just cant believe he would even be considering it.

      2. Webb says "Dauben was most recently released from jail on bond Dec. 24."
      Now you jump my case for not reporting this but what the hell is that? Who, what, where why, how much? Did he escape?

      That's how a bails bond company makes their money. 10% guarantee / $5,000 and if he bolts, the bond company is on the hook for the remaining $45K unless they track his hiney down.

      It was posted on the ECO, right after Joey was arrested. Of course, when the ECO was shut down, the posting was gone. I have seen it again but don't recall where. I'll see if I can find it again.

      I don't want to mislead - there was nothing sexually explicit, no sexual discussion. Joey was trying to keep the kid engaged and the kid was saying leave me alone. It was the way Joey was talking to him that bothered me, like he was courting or stalking him. Joey had it posted as he felt it proved his innocence. I thought the opposite.

    3. I felt the same. this is why I'm certain the authorities discovered Joey's 'crime' with the teen via the seizure of his laptops, etc. not so much from the child coming forward. Its going to be an interesting week.

      It was after the 2nd time I read the e-mail string, which was several months after it was taken off ECO, that I thought these charges came from the forensics, not the kid.

I believe when they took the computers, etc... and did a forensics ON all of that stuff, the authorities came across a potential NEW crime (this navarro thing). I don't believe the child came forward given the timing. I know its two separate cases.

      I guess I'm saying police may have discovered this underage man having sex with Joey and then a few months later, charges are brought. I don't think the kid came in willingly to admit it. I think the police went to him BUT all of that is a hunch.

      Am I making sense? I should call it a night.

      Makes perfect sense. That's been my hunch too - the cops went to the kid, either because of the first or second seizure of Joey's electronics. I think it's possible that the investigation may have actually started with the first seizure, as the cops were looking at Miessner for sex with under age boys.

    @ Webby: I found part of it. Gingersnap and yappy should correct me if I recall incorrectly: the 1st time the string was posted on ECO, it had the kid's name and Joey's name. The 2nd time I saw it, the kid's name was redacted.

    This is the 3rd version I've seen. Joey actually posted the kids name again. But, instead of Joey's name, Joey indicates the exchange is between the kid and someone named Issac. He adds commentary, which makes it harder to follow.

    Joey chopped this sentence up in this version, but I recall that the exchange posted earlier started with this note from Joey to the kid somewhere near the beginning:

    "there is no answer for single and not looking. you have ten minutes to repost with a number that fits you best, or you will be single for the next five years"

    The kid says Joey is weird, leave him alone, Joey keeps writing to him, the kid threatens to report him to police for harassment.

    This version is in Joey's "book", Chapter 11 (I think, hard to tell).

    I've commented here before, and may comment in more detail after the completion of the trial, during which I may be called as a witness. My sense of ethics prohibits me from so commenting before then. "The Rule" prohibits me from attending the full trial, so I can't answer questions about that.

    I never wanted attention, but as a witness in a public trial I may, unfortunately, be unable to avoid it. I'll say now that this case is more nuanced than is being presented here. It's a fascinating story, offering insight into human behavior, from both the accused and the accuser. It's a story that needs to be told - possibly in a book, for which I propose the title "Self-Destruction: The Story of Joey Dauben."

    Gingersnap has been a critic, sometimes harsh, but seems to have a real interest. There is also a legitimate public interest in this case. It is my hope that a more informed discussion will serve the public interest. That interest may outweigh my preference to be excluded from pubic discourse.

      The problem, as I see it, with Connie's comment is that Yahweh believers breed and/or shelter pedophiles that sometimes get caught. Not the other way around. Not knocking anybody's religion or beliefs, but it is a fact - where ever there is a "church" that refers to God as Yahweh, you will find members accused and/or convicted of molesting children. If not for Connie and Joey, I would have never paid attention to this particular belief system or noticed this trend.

      The other thing that came to my attention is, that the Messianic faith started in Europe, England as I recall. They aren't Jewish, as Connie claims. Some guy decided that people of European descent are likely to be descendants of the 10 lost tribes of Israel. Maybe it is so, but I'd think in this day and age there would be some DNA markers to confirm that belief.
