The jury wanted no part of straight up probation, and from my information I think several of the jurors seemed to want a much stiffer sentence. They arrived at something, I think, everyone, and maybe even Joey, would agree is fair. He must serve some solid time in prison, he must forever be a registered sex offender, but they wanted to give him a chance to rehabilitate and come back as a productive member of society. His penalty is:
3 ten year sentences for the 3 sexual assaults of a child charges, and a $7,500 fine
1 ten year probation which will kick in after he is released from prison for the indecency with a child charge.
The Judge will decide next Tuesday if these sentences run concurrently or stacked and he will be eligible for parole half way through his term
So best case scenario, Joey is out in 5 years and on probation, worst case he could be stuck in prison for 30.
Now, as to today's drama, I think Joey's attorney Ed Jendrzey saved Joey from some extra prison time with this statement:
"He noted that the ex-blogger is small and not strong, and he could be severely injured or even killed in prison." from the rare reporter blog
I don't think after watching him sob on the witness stand that any juror would disagree with that statement. Jendrezy also repeated his claim that this was a very strange case. Well the case itself isn't all that strange, other than the time it took to bring charges, it was a simple rape of a young boy. But what I really think he means by that is that he has a complete nutcase as a client. Remember when Patrick Wilson wanted Joey to undergo a psychological evaluation? Jendrezy was noted as making it very clear to the Judge that he wanted no part of any appeal aka I will never stand on behalf of this crazy kid ever again.
There is no rehab for a sex offender. I pray they don't let him out so he can do it again.

To clear up a few things there is no special unit for sex offenders they all get into general population
ReplyDeleteHe wont be in Huntsville that is generally for more violent crimes and there are about 100 other places he could be sent. If like it is surmised he has mental deficits he will get into a place with "more" relatively speaking mental health facilities
He will spend about 6 months to a year waiting for placement in a transit unit
The Court reviewing the probation issue is a wild card but he wont be on ten years probation after release his Ellis Probation will be over probably be revoked and that sentence will be served concurrently and you cant suspend a sentence for longer than 10 years so he could be on probation for the remaining couple of years if he only does eight stacked or 3 concurrent.
I talked to a couple of Navarro DA's and they admitted the case was weak but the general consensus was there was no explanation for the boat ride and he admitted taking it late at nite under the influence what goes on in that situation was the consensus? Hard to argue that one! They also admitted that there was no evidence of any other sexual assaults better be careful saying he is a predator is not like saying he preyed on this boy and you know Joey only has time to sue people for free now

DeleteI didn't take it that the court was "reviewing the probation issue" in order to consider probation instead of prison. I took it that a presentencing investigation was ordered to assist the judge in deciding whether to stack the sentences, to determine treatment for Joey, to assist TDC in deciding where Joey should be housed and maybe to avoid reversal should there be an appeal (per the laws as copied at the beginning of this thread).

TDCJ does there own analysis doesn't your son talk to you about that? The Probation review is to determine if he should probate The Jury found him eligible. All Courts do it Its for Probation not for TDCJ.

DeleteI would suggest that you read the laws for yourself, but as your reading comprehension level seems a little low I will tell you. TDC uses a presentencing investigative report in their analysis. If there isn't one, they do their own analysis.

Here is a typical day in TDCJ:
ReplyDeleteJoey wakes up. Joey puts on his prison issued white boxers and white pants, shirts and boots. Joey goes to line up for "chow". Joey goes to breakfast and row by row they sit down. Next thing you know, row by row, they are getting up. Then he goes and does the days work involving agriculture, planting gardens etc. He gets a "Johnny" for lunch (sandwich) or gets to come back all dirty and nasty from the fields. Then he goes back out to work again for the rest of the day. They come in about 4-5 and shortly thereafter, does supper. Then he gets to take a shower with his fellow inmates watching. And then, Church, or watching TV, playing checkers, etc. Then it's lights out and .... whatever Joey does with Joey's time. Closes those eyes and thinks about his wrongs (or in his case who he is going to enact revenge upon when he gets out).
I would expect Joey ends up affiliating with one of the prison gangs because he will need "protection" on the inside. They love little petite white boys. Especially sex offenders. Only thing is, they may not accept him. He will do their bidding, and probably sport a prison tat or two. He wont be able to protect himself. He will either be the prison bitch or the prison snitch, and either one of those well.. they end up hurting.
