Did David Webb Cause Joey Dauben To Recieve The Max?



As people continue to reel from the especially punitive sentence Joey received today, one has to wonder why Judge Lagomarismo would choose such a severe penalty?  The sentencing was originally set for Tuesday but he moved it till today presumably to take more time to research it.  The anger of this Judge was especially evident in his maxing out the probation at 10 years after the 30 year sentence.  This is one pissed off judge, so what sent him to such extreme measures?

Joey's behavior in the courtroom, particularly his testimony certainly irked the Judge, but I think there is something more at work here.  I think someone alerted him to the vomit inducing article that David Webb wrote after the sentencing.  David Webb had already been called to the court for being Joey's mouthpiece while in jail, so Judge Lagomarismo knew the connection.

In Webb's "alcohol binge" article, he clearly blames the consumption of alcohol and the boy not saying no (and being alone) as the main culprit of the rape:
"To the best of my knowledge Dauben was straight, but apparently anything can happen late at night when two people are drinking alcohol alone."
and
"It didn’t matter that the teenager, now 20, testified he willingly participated in the sexual activity, and that he came from a broken, troubled home that probably contributed to him being alone late at night drinking with an adult 12 years older than him."
Ok, obviously that has already been covered on here, but lets draw our attention to another quote in this article:
"The once-promising writer who started off in high school as a sports reporter for a small town Texas newspaper an hour out of Dallas acknowledged to me after the verdict he was highly intoxicated on the night of the crime."
Red alert, Red alert.  Joey clearly testified that he had only had a "swig" to drink and he wasn't even buzzed.  Most judges don't like defendants perjuring themselves in their courtroom.  Webb, in his quest to write a blame shifting article on Joey's crime may have caused the Judge to come down in such a punitive way.  What an ironic way to end this story full of irony, his friendship of Webb very well may cost him an additional 9 or more years in prison.

  2. This is my last comment on the blog, and Ginger, I hope that you will post his prisoner number etc., on this site.

    I personally believe the sentence was too harsh. Though Joey did wrong, he did not physically "rape" the child / beat him / or heavily manipulate him. The victim was 14 not 8, and yes, there is a difference, and I think any logical person knows there is a difference between the ages. Still a child.... But fully into puberty.

    I believe that the crime was all done concurrently. It went from different sex acts to different things, at the same time. It wasn't like day after day he visited the boy.

    I do not think Joey's crimes should have gone unpunished, but I do not believe Joey is such a hardened danger to society as to need 30 years in prison.

    Who else gets 30 years for 1 sex act?

    Who else gets 30 years for a crime?
    Murderers
    Bank Robbers (often not)
    Mafia members
    Gang Members

    This was way too harsh, and I don't agree with it, even though I saw it coming.

    Joey is not a "danger" to society. I'm not worried Joey would ever rob a bank, or murder my family. He would have been better off on a sex registry with probation and perhaps a little time served. After his Ellis conviction, he had 5 years of probation to slap him to never do that again.

    After this conviction, if he loses appeal, he will begin his life again, as an old man.

    I do feel for the victim, but I also believe that this harsh of a punishment victimized Joey. He needed to get on that registry (which he refused that and probation I understand but still...) and had somebody looking over his shoulder...

    So sad....

    Knowing Joey personally, I assure you, he wouldn't have pulled a home invasion on you, and raped your daughter (or son) in front of you. <-- I see that as a 30 year sentence.

    His crime was severe, but this is too much. I can't agree with 30 years.

    I think many on here were saying "he could use a good 5-10 years".

    Anyway, for what its worth, I appreciate the updates on Joey. For believers in God, pray for him & the victim.

    If Joey loses appeal (which often happens) his life is really over.

    1. Jimmy I also knew Joey. I also knew and saw his arrogance. One reason for the sentence is the lack of remorse. That in and of it's self will land you the max time allowed.
      Yes Joey needs to be registered from this point forward. I personally believe that he would have been better served with one 10 year sentence. The judge saw things different. I dont think putting Joey away for 15 years before probation eligibility serves anyone any thing other than lip service.
      Fact is that Joey was convicted for 4 felonies. The Jury could have handed him 20 years on each count. The Jury decided on 3 10 year prison sentences and one 10 year probation. During one physical encounter there were 4 crimes committed. the three acts of penetration and the one act of getting naked with the victim.
      Each act of penetration was escalated so it constituted a new charge. I think the 10 Circuit Court of Appeals will reduce his sentence to 20 years plus probation so the reality is that Joey will do 16 years total time and then serve the rest on parole/probation. But time will tell.

I wish no harm to anyone, yet I stated earlier, that boy will not make the 15 years. Texas prison workers are under paid and half aren't the brightest. That is why his safety should be a concern.

    5. under Texas law each act of penetration is considered a separate act even if it occurred in the same encounter. That is how Joey was charged and thereby convicted.

  3. There are reasons lawyers tell you not to talk to people, and this may have been one of them. I don't really doubt that Joey said this to Webb.

    Webb should have kept it to himself until after today...there was no reason to include it in the blame shifting article, or heck, even to write that BS article about alcohol being to blame.

    How do you feel now Webb? Has he published anything about the sentencing today?

    1. @oceans I agree to a point with Gingers article. There was far more to the sentence handed out today than just a man and a boy. More than a bottle of Wild Turkey. More than an LGBT journalist with an itch to out do Ginger. Joey's lack of remorse, his "conspiracy" claim, and his admission of having one "swig". All of these combined contributed to Joey's sentence. I think even through an appeal the verdict and sentence will stand.

    2. I have to ask if anyone knows how this judge has sentenced other child molestors. It's really sad to have to consider there are so many others out there.

      Joey is a sexual predator. He knew what he did was wrong. He IMO would have continued doing more with this boy if he could. I see him as dangerous. He has no conscience as is evidenced by his other behaviors towards victims of his smear campaigns. He has no common sense, as evidenced by his ridiculous testimony in this case, and his refusal to accept a plea deal when he knew what he had done.

      I think you may be right Curtis(happy birthday dude, may you laugh till it hurts and have too much fun while you celebrate your day). The verdict will stand, and probably the sentence too. I only say probably because I am not familiar with Texas courts.

      Texas law has laid within it the ability to take individual acts of depravity and charge them separately even if it is just "one" encounter. I am sure that is what the jury found and that is how they ruled. The judge concurred and handed Joey his sentence.

    This post is so incredibly stupid that I cannot even get mad about it.

    First of all, Joey didn't testify that he wasn't buzzed, he testified that he was buzzed. He said that he drank beer all day long, but that he only had one swig of the whiskey that the victim brought to the gathering because it tasted so strong. He said that be was not so drunk that he couldn't remember what happened. People can be really drunk and still remember what happens.

    People lose their inhibitions with alcohol. All kinds of weird stuff can happen. People tend to get sexual when they are drinking a lot late at night. That's a fact of life, whether you are talking about straight, gay, mixed or whatever kinds of gatherings.

    Secondly, you are accusing Judge Lagomarsino of judicial misconduct. The purpose of a hearing, which is what they had today, is for the judge to consider evidence. If the judge wanted to consider my column in his decision, he would have subpoenaed me to testify if Joey had indeed told me that. My column would have been entered as evidence. Judges don't just read stories online and in the newspaper and then use them to make decisions.

    I got along just fine with the DA, the judge and everybody else in the courtroom during Joey's trial. The DA told me I had a big following with the state. They liked my reports, he said.

    Finally, the hearing was never scheduled for Tuesday. The director of the probation department said the presentencing investigation report could be ready by Tuesday, but the judge said he wanted to schedule it for Friday, Jan. 25.

    You are an utter idiot, and you are full of shit. I can smell the stench of you from Tarrant County all the way over to Cedar Creek Lake.

      “I was not intoxicated to the point where I didn’t know what was going on,” he said, adding “it was wrong for anyone to be drinking out there.”
      What he told you after the verdict:
      "acknowledged to me after the verdict he was highly intoxicated on the night of the crime."

      Now you can split hairs over highly intoxicated vs. didn't know what was going on but it sounds very evident that what he was telling the jury and then telling you are two different things.

      The Judge was going to decide which way he wanted the sentence to be. Its a judgment call, he is not up there to re-try the case but if he gets wind that Joey was less than forthcoming on his testimony, which of his two options do you think he will take?

      Now if you are smelling stench, that's more of a personal problem. I certainly wouldn't blame that on the entire county of Tarrant.

    3. While I do not believe Mr. Webb's articles and blogs were the focal point for Joey's verdict, they might have contributed to it. But that is speculation on my part.

    5. Part of the PSI is to gather evidence regarding all aspects of Joey's life including those he surrounds himself with. A PSI would not request Webb to testify, it is not standard protocol. The PSI investigator was provided critical information.

      @ Mr. Webb. I have read your articles/blogs. I have found some of them to be outright disturbing. Others to be one sided. Yet others to be somewhat balanced.
      While you play both sides of the fence. (I am guilty of this myself.) Joey will sit and wait for yet another lawyer and the court and the citizens of Navarro County to pay for it, Where will your motivation come from? Will you rehash Joey's old stories? Pick up where he left off? Do what he could or wouldn't do?

  6. There was more punishment evidence that was not presented in court. I assume due to a judgment call on the part of the prosecution. As far as the stiff sentence, think about this from a judge's prespective. The judge is an elected offical. This case has been reported heavily in the media. What are the types of cases must the public perceive judges tough on? (murder, rape, drug dealers, child molsters). It is politically expedient to give the maximum sentence on this case. If the public sees the judge as tough on crime, then the judge gets reelected.

      Actually they can and do use hearsay in their decision making process of sentencing. You are wrong. The judge could very well have used your article without calling you to testify. It was a hearing not a trial. Rules of evidence do not apply. You wrote that Joey made those statements to you. That was all he needed to see in order to use it in his decision. If he wished. Ginger didn't say anything about "accusing Judge Lagomarsino of judicial misconduct" nor did he imply it. Those were your words and your implications.

  11. @Spawn: A judge would never make such a critical decision about someone's fate without confirming to his own satisfaction that the information is correct. It is standard procedures in hearings.

    I think the judge has a right to know what has been written about him. I actually think he is a fair man trying to carry out the will of the jury's decision and the community. You have defamed him.

    You people have been calling for Joey's head on a stake for a year so it is the height of hypocrisy for you now to be talking about how shocked you are by the severity of the punishment.

    Some people have even commented that they hope he gets raped and killed in prison. It's not going to go over so well if something like that actually happens to him. Groups have been held liable in civil court judgments for influencing violence against people since the late 1970s.

    You are just about the sickest group of people I have ever encountered.

    2. I actually have no problem with the sentence structure Spawn. Joey by his own standards got off light.

      Unlike others here, I think he will do okay in prison. Not saying it will be fun or easy. But I think he will survive...or end up in a special protection unit. He has a long time to learn the ropes.

      I believe in long sentences for child predators who do what joey did. I wasn't in court, but I believe the victim expressed his pain. I believe the judge did what he felt was appropriate. Joey committed the crimes. Joey pays the price.

      Most here made it very clear they did not condone the comments nor agreed with the 1 sick blogger wishing Joey was raped. No one made a comment wishing he would be killed. Had some of your hateful words regarding the family of this boy cause the judge to pause. Had some of what Joey shared with you cause him to reconsider leniency?   14. No one here is defaming this judge David, I disagree with you.

    Anyone who said horrific things about joey being raped in jail is sick themselves. I have never seen Ginger call for joey's head. I know I never have.

    I am surprised the judge went with the consecutive sentences, but I wouldn't say I am shocked. Judges across the country have been known to come down hard on sexual assault cases, others don't. It really was up to this judge.

    Joey really did do this to himself. He did what he wanted without regard to the consequences. He has a lot of time to think about that.

    You need to get over the fact that we were right about Joey being a criminal, and that he was found guilty for what he has done. You should also remember he got away with doing so much to people who didn't deserve it. It's not a happy thing no matter how you look at it.

    I don't see the hypocrisy here you do. You are free to walk away if it is bothering you so much.

  17. ahhhh, ok, I'm back from the gym, got my drink in hand and now I'm ready to do one of my favorite things.....slap down old man webby.

    First of all, did you notice the title of my post...the first word was "Did" and the title ended with a ? You know what that means? It means its speculation.

    The Judge made a decision. He had case law to back him up either way he wanted to go. This means its a judgment call. He is the only person that knows for sure why he did what he did and until he decides to tell us all, we are free to speculate. Welcome to America.

    Since the law would back him no matter what he decided, it could have been anything that pushed him to this decision. Maybe he didn't like Joey's testimony, maybe he read something in the NYT the other day that said sex offender repeats are increasing, maybe it was a political statement, maybe it was a statement that he is hard on sex crimes, maybe he didn't like the way Joey looked at him this morning, maybe he talked to Judge Carroll and Patrick Wilson about Joey's career leading up to this or, maybe he read your article and didn't like what Joey said to you.

    The idea that the Judge would have to call you up to the stand and enter your little blog as evidence in order to consider its content is just stupid. This is no longer a trial, its a judgment call.

    So I can blog and speculate about whatever theory I want. So can you, the only difference is my blog is being read by thousands of individuals around the country on a daily basis.

    Of course they love you David, you were an outstanding asset to the prosecution. Your stories helped show them exactly what kind of defense Joey was planning to mount.

    Too long. One romp. Not forced. Still sick. But 30 years? Too long. Wish the judge would reconsider. Joey would be better off with a non-stacked... Serve 8, stay on probation with registry. At least then he could still have life and grow up.... Now he'll be 70 probably when he's finally done with probation.

      This is an archive of the Libertarian Politics Live online radio show. For a while Joey hosted that show while the regular host was away. This show had a special guest, Shirley Q. Liquor.

      This episode appears to have been removed from LPL's radio account, but I saved it because it was about the best radio show I'd ever heard. Shirley comes on about 29 minutes in. Interestingly, this show, according to my records, was from September 25, 2007, the Tuesday before the events.

    In regards to sex with a minor:

    Why does he need to clarify this? Are there people that think there is a gay sex loophole for statutory rape? Or is it the other way around?

    And yes yappy, Webb had to include the detail that the victim didn't object. Webb has ZERO grasp on how child predators and grooming works.

    Webb you are revictimizing the boy by making that an issue without any qualification. Remember the testimony regarding grooming? Joey set the scene to make the boy feel awkward and inexperienced and uncool for saying no. His testimony regarding the canoe and washroom basically summed Joey up as presenting it as "everybody does it" rite of passage type thing. That is Not a result of a few drinks. That is calculated. Joey had either done it before or he was following in the footsteps of somebody who did it to him. Joey found a boy that fit the general profile to be easily groomed, he assisted in lowerinf the boys inhabitions, presented himself as a cool role model type, and proceded to seperate the boy from the pack. Textbook grooming. So it is no surprise the boy felt he couldn't say no. Joey set him up. The boy told a girl the very next day and she didn't believe him. Don't you think at 14 that would be embarrassing? Can you imgine the trauma and self doubt and confusion for this boy? Obviously fucking not or you might show a little compassion for him and write something worth a crap.

    2. Absolutely. It's a crime. Period, but Webb admits that it is a crime and it is wrong, but he keeps wanting to try to minimize it by letting us know it was consensual. But, there is a reason that minors are not able to give consent to such acts with adults, and Joey played on every one of those.

      Can you imagine what Webb's article would have been like if the kid were a couple of years older and Joey a couple younger? How many new excuses would Webb throw out in honor of Joey? As the events happened, this was between a child not yet in high school and Joey who was old enough to have completed grad school. Those should be very different ages and maturity levels.

      I just don't think Webb understands the reasoning behind the statutes. He doesn't think back to the CHILD that Joey raped. He only sees the young man that testified in court. I'd say Webb needs to spend some time around 14 year olds to see just how inexperienced and young they are, but I'm not sure anybody wants their kid around him. He is waaaay too apologetic for Joey. Creepy.
